Porterville due to an accident at the rental propertyThe rental property has a swimming pool and I have attached a copy of the Pool Addendum for your review. *** *** called me after I received their letter as mentioned above (see attachment), asking me to consider letting them out of their lease and if they could get their deposit backI explained the lease agreement to *** on breaking a lease agreementShe said she was having a hard time looking at the backyard where they almost lost their son in a pool accidentShe stated that she left her toddler outside while she went into the house to change the baby's diaper and this is when the toddler fell into the pool unsupervisedHer husband pulled the toddler from the bottom of the pool and performed CPR. Prior to ***'s moving into the property, they were fully aware of the pool without a fenceAll windows and doors had beeping alerts on them, but were removed by the ***'s and never replacedApparently, they had installed their own alarm system after they moved in and removed the beepersWe are not exactly sure why they did not have their alarm on during this incident. I have attached the mo/ move-out inspection sheet signed by all parties for your reviewThe ***'s did not leave the home in the same condition as they received itI have attached pictures of the mo/move-out inspection for your review. I am rejecting this response because:
Ms. [redacted] is blatantly lying. There were not alarms on any of the doors. Per our conversation she had agreed that made her nervous and asked our permission to come in and have them installed. They were never installed during our residency there.  We did sign a form knowing there was not a fence; however, it wasn't stated that in doing so they were not complying with state law. I never had a conversation with her personally about the details of the incident. For her to say the things that she said is an attack on us as parents. We left the house in better condition than we got it. We paid the prorated amount that I called the office and received from their secretary. I even came in to confirm with her the amount before writing the check. Ms. [redacted] is now trying to cover herself because she knows her company broke the laws by not having the proper security measures in place. I never was blaming them for the incident. It was a horrible thing that happened and I am happy to have my son well and happy. She called and was so considerate and was so nice. She told me that she had no problem giving us our deposit back as long as the carpets were cleaned. We went above that and had the house cleaned beautifully from top to bottom. We are upset because they told us one thing and did another. She needs to be called out on her actions as manager of that company. We did not do $1100 of damage in 6 months. We kept that house as it was our own. She knows what she said and I'm here to call her out on it. How many times has she done this to others tenants?      I wrote a sincere letter to the rental company explaining the situation and flashbacks. She pretended to be understanding and then single handedly nickel and dimed us out of more than half of our deposit. We are not going to let her get away with it. She is taking advantage of us and our situation.
