Business was contracted to perform Plumbing services not completed. Agreement for services signed 2/11/2018
Plumbing services were quoted and agreed to in writing by both parties on February 11, 2018. at the same time, HVAC install services were also agreed to. Due to lack of funds at the time, the agreement for the HVAC was voided and the %50 down payment for this service was then applied to and added to the Plumbing services, which made the total amount for services paid in full. this was done as a courtesy to the contractor. services for 'Replace water line from meter to last fixture in house, repair waste line and connect fixtures supplied by owner' have not been completed to this date.
Contractor has only dug the front yard from the meter to the outer edge of the house and installed Pex pipe with crimped fixtures; a hose bib installed at the request of client; galvanized pipes removed from basement to the rest of the house and outside faucets.
After 28 weeks, the work is not completed. Contractor has had his apprentice doing the work instead and has not provided his own Generator that is claimed to be needed for the work, even though the contractor has been aware since the quoting dates that there would be NO electric service during his work. Client and Contractor agreed that the destruct of the bathroom and kitchen would be done by client and that tiling and the tub placement would be done by client. It has been 3 months since this has been done. Contractor reached out 1 week ago to complain that the key had not been left at the property and I reminded them that it needed to be arranged ahead of time. At that time, contractor stated that they would be going on the following day - 8/24. No one has called or shown up since that phone call on 8/23
Service and communication have been terrible and I am no longer trusting any future work that is performed by this contractor from this date forth.

Desired Outcome

based on market rates for ***, AL, I am willing to absorb 25% of the already paid for plumbing agrement. Total of $4300 Paid to Mr. on 2/11/2018 by two checks for an agreement of $4100 75% due back to me: $3225.00 for services not rendered

When the contract was signed on 2/11/2018, Ms. agreed that she would have her lights on the next week and that never occurred. However, we succeeded to run water lines up hill while busting out concrete. During the last few months, Ms. indicated that she would have the lights on as soon as the foundation under the structure was completed. However, the lights were never turned on. A few weeks ago, Ms. indicated that she had ran out of money. When I met her at the house, she informed me that she wanted the laboratory relocated to another spot. I then agreed to move it once the lights were turned on but that never happened. Then there was another request to set fixtures where there were only stud walls and no sheetrock on the walls and holes in the floor from which I explained to her that the sheetrock needed to be put on the walls and boards on the floor. However, we went back to move the laboratory and the lock box where the key to enter the house had been placed in previous weeks was removed. In the past months, she had spent all of her time trying to get the house on the foundation modified to satisfy the inspector but still they had not okayed the work which was done. My agreement with her that she would do all demolition in bathrooms but up until three weeks ago she had just completed portions of it. For me to complete my work, sheetrock on the walls and the floors needed to be boarded in. The only work I have left to do per my contract is to set the toilet, the laboratory (which she is moving which would be a change order), and to set the sink in the kitchen, along with putting a drain on the bathtub. My agreement with her from the beginning was that she would have the lights on but the house had so many code violations that the city would not release lights because the house was unsafe to do so. In closing, we can come and relocate the laboratory but the house is no where near ready for fixtures to be installed. She has no sheetrock on walls nor vinyl on the floor. Most of the job costs were due to bringing the water service up a steep incline from which it had to be hand dugged because the machine could not dig it. It isn't my fault that she ran out of money to complete the project. It has never been a problem for her to talk to me in the past and it isn't a problem now.

Thank you for the reply. However, the reason(s) given for the job not being done are not valid - there is nothing on the written agreement that electricity would be needed, as the contractor was aware that there was a wall repair needed before the city gave the OK for a meter. There were multiple promises by the contractor to bring their generator to do the job, that they would 'get it out of the warehouse' and it never happened. the relocation of the vanity was prepped already for their install and should have been no issue. there was no drain installed in the kitchen, still isn't.
Pex pipe does not need to have sheet rock as there are brackets that can be installed.
the issue is the contractor didn't want to bring a generator, or go up 3 flights of stairs, or call ahead to make sure keys were available. By saying that there are 'multiple violations of code' with the property is not a truism and not for the plumber to state as he is not a city inspector. The issue was with the electrician not installing the correct wiring, just so I set the information straight. The issue is not running out of money, as the plumber was paid in full up front for work not performed, so that topic should be of no concern to him at all in order to finish his work during normal daylight business hours.
In regards to the concrete being broken - the area done is only approximately 3'x3' and only 12inches deep. This created a hazardous area that I was assured would be repaired soon. It is still there.
The issue always has and will be that the plumber did not perform the work 'from first faucet to last, and sewer lines inspected and repair as needed' in a timely manner.
Plumber was paid and should have done what was needed in a timely manner.

Dear Mr.,
Sadly, the resolution tool that I decided to use for our conflict is not being properly used.
I understand that you have thoughts and opinions that you have formed and expressed about this project and they have taken the place of what really is the issue here: I am seeking to resolve the problem of my Plumbing contract with you has not been fulfilled.
I understand that my asking for a portion of my money back is not desirable to you, but I want you to understand that, after being disappointed by your performance, I felt this was the best possible scenario to resolve the issue so I could move forward with someone else who can complete the work that I need done.
since you have taken the route of digging out details of conversations I've had with you in the past and have nothing to do with your ability or desire to finish the work, this just adds to the disappointment.
So, to re-state the FACTS: Please note the two cancelled check images - one is for $2050.00 and the other for $2250.00
One for the down payment for the HVAC and the other for the down payment for the plumbing. sometime around the end of February and the beginning of March 2018, I changed my mind on the HVAC and stated to you that I would not proceed with that work, but, since you'd already gotten the check, I wanted you to just keep it and apply it to the Plumbing quote/agreement that totaled $4100.00. I figured I could trust you to apply the money to this and have the work completed even though ALL of the $4100 were already paid to you, since $2050 + $2250 = $4300. For this, I did not ask for any money in return for the difference. I simply needed the plumbing done.
The next fact is that we both VERBALLY agreed on the timing that you provided for completion - you stated that you would be done in 5-7 days or so from starting, which, you stated that you had a *** large job but, once done, you would jump on my project and complete it.
Next fact - you and your team did start on the digging of the earth from the meter to lay out the PEX line. no problems there.
However, at some point, we both discussed that the electricity would not be getting turned on for a while (unknown at the time, per the electrician) and so you stated that you had a generator and would bring it.
Next fact: March 6, 2018 I checked on you by text message and you replied that the line was laid down and that you had to have the generator serviced but should be on site the next day. You were not there.
Sometime around May there was some more line set inside of the house, but there was no connection still from the outside line. the agreed tile destruct in the bathroom was done and I put the tub in with my associate *** and called you to let you know that it was done. The vanity was purchased on May 23 and brought to the property. Fixtures, per the agreement, were purchased on the first week of March and left at the property where they still are.
At the end of May, a hose bib was installed at my request so that I could work on concrete. Up to this time, I'd been carting my own water from my home to use.
In June, a visit was made by you to see what the tub looked like and if the surfaces were good enough for the lines. we discussed that I wanted to remove the shower stall.
At that time, I shared with you that the other contractor with whom I'd had problems because he had no water for concrete had accepted a proposal from me to do the rest of the bathroom destruct and the kitchen so that you would have the area cleared to lay the lines.
In July there was another visit from you but no work done.
In August there was yet another visit from you and it is when I realized I had not informed you that I chose to have the vanity set where the old shower stall was. there was tile and sheetrock up in the bathroom already and the kitchen was cleared off.
When I said I wanted to move the vanity, you stated that you would need the generator and you would get it there the next day. this entire time in June and July I was available every day and informed you of that, but only once I saw someone there.
Regarding the toilet - the floor does not only have plywood subfloor on it, there is tile on it. Please see pictures.
You also took issue that I asked for the lines to simply be capped with shutoff valves so that I could do the tiling and install the fixtures myself, as this is something I've done multiple times at several of my previous projects, as well as with My request that *** products for the connections, but you installed crimped PEX instead. That had to be acceptable, but not ideal, as long as the lines were run to the desired locations and connected to the meter.

After the visit in August, I was told the same thing - the generator was needed and the next day someone would be there with it. this was on a Wednesday, then nothing on Thursday and nothing on Friday. I called on Monday to see what the story was and then you stated that the following Thursday you'd be there. nothing again. then, I received a message from you telling me you'd tried to enter and no key. I had already informed you that I went back to work on August 2nd and so I would not be available and that you'd have to give a heads up so I could leave the key. I placed the key in the lock box the same day and then, no one showed up from then again.
This is what brought me to submit this complaint.
so, now, that there are no emotions or feelings attached to this statement, once more, I expect you to help to resolve the issue, because it will have to be.
this is a very typical thing: no service given, there should be no money received. just like a purchase. No satisfaction, then there should be a return of funds.

I could propose in detail what I want you to do as far as completing the work, but, my trust levels are not good with you, as you have disappointed me, your customer, by not communicating with me or even proposing a workable solution, but instead, you've only gone out of your way to point out what you think I've done wrong with my property.

If you decide that you want to arrive at a workable agreement and keep my trust in you, I am willing to do that and re-work our agreement.

You cannot simply keep my money for not completing the work. That would not be legal.

My proposal is:
UPSTAIRS
Run lines connecting the outside line to the inside of the house. Install pressure regulator for incoming water
Replace/repair the concrete broken to lay the line on the outside
Connect the tub drain
Install lines for shower/tub - install shut off valves
Install toilet line - install shut off valve
Install toilet
Connect toilet
Run lines for *** where old shower stall was. There is sheet rock. The vanity is placed where it is wanted
Run drain pipe for vanity - there is wood subfloor and not concrete to run it to the basement
Connect lines to the kitchen sink
Run Drain pipe for Kitchen sink

BASEMENT
Run lines for tankless water heater
Connect water heater that is at the property
Run cold/hot lines for Washer machine
Ensure there is a drain site for the Washer, if not, install one.

OUTSIDE
Run and connect a line to outside water faucet on west outer wall of the house outside of basement.

SPECIAL REQUEST:

Plumber must have their own source of power as there isn't electricity at the site, nor any is planned in the foreseeable future.
Plumber must complete the work in 5 consecutive days and successful inspection results from City Inspectors must be obtained.
Work must be started no later than the first Monday following agreement to this new contract and MUST end no later than end of business on the Friday following start of work.

All of these have always been part of the job that I thought I'd contracted you for, nothing more or less.

My company will agree to complete the job but we must first come to an agreement. The job can not be done in 5 days because there are several things that must be completed first. The plumbing must have finished walls and floors and your cabinets musts be installed. After that has been completed, I will be able to give you an accurate date in which the job can be completed.
