The Buyer Yvonne [redacted], when given the written Sales Contract from HUD -- which explains "Investors" do not get their earnest money back no matter what the cause of failure to close. See attached page out of the written contract. When Yvonne could NOT get the financing --- I explained to her that I could "try" to get her earnest money back or maybe part of it back. She had confusion with the Lender too -- about the amount of money for down payment - she tried to get her Daughter to get the loan but it could not be done.Yvonne [redacted] has received her Earnest money back -- she also accused the Lender of miss-leading her and stated she was going to report the Lender to the Better Business Bu[redacted]u. I have been doing FHA HUD foreclosures for 5 years now and have had no problems explaining the complexity of the HUD Contract. In regards to any Earnest Money dispute we have to abide by Wisconsin State statutes and are not able to determine if earnest money will be returned. the money is held into a trust account and all of our contracts explain how it is handled. I have included the state statutes as well as the wording...
for earnest money that is in the contract.Our agents cannot say that earnest money will be returned unless both parties agree, or there is a court order.However I was informed yesterday that both parties have agreed on a solution.Thank you.
