Dear Kamyar, Costello’s Ace Hardware does not have an online selling site I would have to assume that you went to Ace Hardware Corporation’s website, [redacted] , to purchase the canopy that you saw in Costello’s weekly circular Each Ace Hardware store is independently owned and operated and unfortunately we as an independent Ace Hardware dealer do not have a say in what [redacted] sells and at what pricesWe understand this may be a bit confusing and apologize for any inconvenience this may have caused you We would still like to extend to you the sale price of $for the 10xcanopy Which store is closest to your home so we can make sure to be in stock when you come in? I rented a home for two years from *** *** of Realty Executives in Glendale This complaint is filed at Ms***, who in our opinion, has no ethical standards, has broken (or at least severely bent) several items in the landlord tenant act, and in general, practices real estate with the end goal of financially abusing her clients
We paid our rent on time (sometimes early), took care of the property, fixed things around the home with her approval (avoiding the cost of plumbers, etc), and provided more than days notice to vacate (Oct 31, 2013) Ms*** even provided us a GLOWING recommendation letter to our new landlord Ms*** was out of town during our move out, and advised she would do a final walkthrough upon her return We were never advised when the walkthrough was taking place (I believe that is a violation of the landlord tenant act) On Nov 13, 2013, we received a statement of disposition and deposits, wherein Ms*** accused us of the following:
1-Destroying carpets due to cat urine (we haven't owned a cat in years, but Ms*** inhabited the property before us and did own cats)Charge assessed was $
2-breaking a toilet that was broken when we moved inCost to replace $
3-With Ms***' permission, we repainted the family room and garage She accused us of re-painting the the wrong color (it was the same color stored in the garage marked "family room Oct 2011, which is the month before we moved in)She subsequently charged us for re-painting ($1100)
- destroying plants and sprinkler systems (this is a rural property, and the sprinkler hoses get eaten through by rabbits and other rodents, and the two plants that died were killed by the frost in Feb 2013) Cost for repairs was $
5- losing two garage door openers We only received one when we moved in, and it was left in a kitchen drawer upon our departure In addition, prior to our move out, a garage door opener repairman came out to look at the opener, and advised me it needed to be replaced It hadn't worked for over a year, which we had told Ms*** about, but didn't need to use the door, as our vehicle wouldn't fit in the garageCost to replace was billed at $
The final bill totaled $She advised she was keeping all of our deposits ($2150) and we owed her $
Upon receipt of this request, we immediately contacted our attorney, who, on Nov 20, 2013, sent Ms*** a registered letter outlining our objections to her claims On Dec 10th, 2013, that certified letter was returned to our attorney as 'undeliverable', even though it was sent to the address we mailed our rent checks to for two years, and is the address listed on Ms***' website
It is our belief that Ms*** is attempting to charge us for expenses she incurred to prepare the house for market (it has since sold), as well as charging us for wear and tear on items that are her responsibility as a landlord (wear and tear on carpets, sprinkler systems, landscape maintenance) Photos attached with the Statement of Disposition and Deposits show green, blooming plants, new plants where live plants existed when we moved out, a new birdbath and new plants on the back patio, where nothing would ever grow due to the large Mesquite tree that dropped pods and leaves all over the back patio We did not take pictures when we moved out, as we had the impression that we would have no issues with Ms*** since, on her visits to the house, had never provided any indication that she was not happy with how we were taking care of the property
Since Ms*** has never contacted us again and ignored the registered letter from our attorney, we feel she is happy just keeping our $2150, and has no intention of trying to make this rightThe ethical issue of providing us a recommendation letter, and then trying to charge us for thousands of dollars in damages is just too much to comprehend She is a VERY POOR reflection on Realty Executives, and I would NEVER recommend her for a transaction as important as real estate

Kamyar,We will transfer the xcanopy that was in the Labor Day circular for $to the New Hyde Park store. It will arrive by this upcoming Friday September *** so you can pick it up.We are sorry to hear that our solution of honoring the price is not sufficient enough for you. It's just really bad communication threw the company with their tenants.

Review: when I moved out of the rental house I lived in for 2 1/2 years I was charged $1375.00 for cleaning the yard, house, some dog feces, and taking out the trash. that does't include the 70% of the cost for painting the 950 sqft house or 40% of cost for the carpet that was well over 5 years old. the back yard was over grown and we had collected the trash in bags and put it all in the garage. the other charges we have no problem paying for because they are small understandable cost. Not to mention that in his contact email regarding the disputed amount, he was very threatening and dramatic.Desired Settlement: I would like to not be charged the outrageous amount for the cleaning and paint and carpet. $400.00 to take out the trash is ridiculous along with the other cleaning fees. I dont mind paying for what I owe there is just no way it all totals to 2,953.34.

We are writing a review of one named [redacted] of Realty Executives, [redacted]. Ph. [redacted]. In all the 30 plus years of doing business in Arizona, we have NEVER been so insulted, so rudely treated, and accused of overcharging, and chiseled on to reduce our fees. Even being called a "liar" in a round about way, by this sour and mean spirited person. Every time, we have been on the phone with this individual, she has screamed at us, demanding for us to reduce our fees. Mr. [redacted], recently discovered and being treated, he has high blood pressure. HE DID NOT APPRECIATE HER UGLY ATTITUDE! Plus, the last few days he has been on some added medication (pain killer and muscle relaxers) from a wisdom tooth treatment. In other words, due to his medications, the hot weather too, he was quite irritable when she last called on June 14th, 3:54 p.m. In fact, I witnessed it, as she just started screaming at him over the fees on the [redacted]. She is extremely rude and bad for business for Executive Realty, and Montana Landscaping. Mr. [redacted] lost his cool. Never saw him like this before. Therefore, WE NO LONGER WILL DO BUSINESS WITH REALTY EXECUTIVES, DUE TO THIS INDIVIDUAL UNCOUTH BEHAVIOR. We will not buy houses, nor recommend their management for rentals. We are purging ALL current contracts, that you do not even know about, from our records and discharging them. We do not want to hear from this mean one again! As far as Mr. [redacted] is concerned, he just retired! And he will not drive down to Scottsdale, to buy trucks for the company, go to a movie, eat at a restaurant, if this is the way Scottsdale folks act...RUDE and MEAN! [redacted], you need to get out of the management business (period)! We will not recommend Realty Executives, until there is an apology issued by C.B., for calling Mr. [redacted] a liar, who is a seasoned military veteran of 34 years, who just retired from the USAFR, a decorated Persian Gulf veteran, well educated and experienced in life. If you got yelled at, by Mr. [redacted], he must have had some very darn good reasons, as we have NEVER seen him so irritated, as we saw him on the phone with you today! Dad does not lie, and if you don't like him, it's probably because you are a Democrat, who has NEVER served in the US military, nor appreciated a businessman, who has. In conclusion, stay away from this one folks! [redacted],

Review: [redacted] is the property management company that handles my property and charges a service fee and provides the rest of the rent as a deposit to my bank. The deposit amount should be $1732, this month she has only deposited $1615 and refuses to explain why the correct amount is not deposited. She is short $117.Desired Settlement: Need her to provide the $117 and an apology to the tenants for being non- responsive to their needs.

Review: During our search for a new rental property, we saw a home listed by [redacted] from Realty Executives on [redacted]. We have two large dogs, so when we submitted our application, we had our agent request that prior to processing the application, [redacted] check with the owner of the home to verify that the dogs would be ok. My husband was out of town for the week-end, so the application was only in my name but I did drop off a cashier's check for $70, which was supposed to be $35 per adult for the credit check. A fee days later, [redacted] let my agent know that the dogs would not be accepted by the owner so the application would not be run. We proceeded to send a recommendation letter from our landlady as well as a personal letter to the owner explaining our situation and that the dogs have never done any damage to any home we've ever lived in. We did not hear anything back from [redacted] for an entire week, but because of school starting and a hectic schedule, I was unable to pick up the check for the credit reports. The following Friday, I had my agent call her office to make sure the check would be at the front desk for me to pick up. [redacted] informed my agent that our application had been run that morning - meaning she had run my credit only - and she would not be refunding any of the money. We then requested she refund half of the $70, since she had not run my husband's credit because his information had never been sent to her office, but she refused. She also refused to run my husband's credit as an alternative so we'd have his credit report for the next application. Of course, since our application was incomplete and the owner did not want our dogs, we did not get the rental. We have the mls listing stating $35 per adult applicant, but now she says it's $70 regardless and will not refund any of the money. I feel she should not have run our application at all, considering that it was incomplete and she knew the owner would not rent to us because of the dogs. I have no idea why she ran it at all, but she only ran one credit report, so she should not keep the remaining $35.Desired Settlement: Refund of $70 would be ideal, but at least $35 should be refunded.

To Whom It May ConcernUpon our investigation of the incident with our agent [redacted] and the application charges that Ms [redacted] incurred for the rental property, we have found that Ms [redacted] had follow proper protocol. The fee for a married couple or a single person for application is $75.00. It is broken down as $40.00 for the application and $35.00 for credit. If both releases for credit were turned in together, there would be no further charges. Ms [redacted] only submitted $70.00 the credit release for her only, and Ms [redacted] decided to let it go and accept the $70.00 short $5.00. Contrary to Ms [redacted] the fee was not $35.00 each. Ms [redacted] received 3 applicants for the property and submitted them to the owner of the home for their decision. The owner chose another party that had better qualifications and the decision was not totally based on the dogs. Ms [redacted] could not, after the landlord/owners choice to decline Ms [redacted]'s application, run Mr. [redacted]'s credit report as we are not a consumer credit reporting agency. For your reference, details of the offer I reviewed appear below.As you can see at the bottom of the MLS listing, there is nothing about a $40 application fee. The fee is $35 per adult applicant. Only after we requested that [redacted] return the $35 for my husband's credit report not being run did she come up with this bogus $40 so she wouldn't have to return anything. There is nothing in the mls listing anywhere about an application fee. Regardless, she should have never run our application at all - it was incomplete and we have an e-mail stating the dogs would not be considered by the owner and the application would not be run. She did not communicate for an entire week after that and then decided to run the partial application for no reason. This is totally unacceptable!Regards,[redacted]
