I entered into a property management agreement with Realty World - Ballard Company about 4 years ago. Realty World - Ballard Company enters into lease agreements with tenants for my property. The last tenants that they leased to, Realty World - Ballard Company allowed pets (namely 3 dogs)on my property and more specifically in my home. The agreement between Realty World - Ballard Company and myself specifically stated "pets allowed outdoors only". The tenants cut a hole in my back door as a "doggy door". The smell of pet urine in the house was unbearable. The dogs tore up the siding on the house and shed as well as corners in the house. The dogs chewed the lines to the central air conditioning unit. Realty World - Ballard Company claims this would be my responsibility for the repairs. I did not enter the agreement with the tenants. Realty World - Ballard Company allowed pets in my home when it was specifically stated no pets in home. Realty World - Ballard Company continues to make repairs (I am guessing as I do not receive a statement with my monthly check even though this has been requested on numerous occasions)to my home and deduct it out of my monthly check. My agreement with Realty World - Ballard Company states that all repairs are to be approved by myself first. I have not approved any repairs nor have I been supplied invoices for any repairs. I have not received any correspondence from Realty World - Ballard Company as to why my checks are not the full amount. My checks arrive at different times every month, sometimes on the very last day of the month if I go pick it up. The reason I was given was on at least 2 occasions the leasers check did not clear, why is my distribution being held due to the leasers check bouncing I did not enter into an agreement with them.Desired SettlementI want Realty World - Ballard Company to repair all the damage created by the last tenants that they allowed in my home. I want all of my rent money returned to me that they took out for ????? as I have not received any notice as to why I did not receive full disbursement, nor were any repairs authorized by myself.Business Response Here is a response from our property manager."On October 20, 2015, [redacted], Trustee of the [redacted] Revocable Family Trust, made several statements to the Revdex.com in the form of a complaint toward myself, [redacted]. The complaint involves Maintenance and Repairs, Leasing and Timeliness of Payments. This is my response as the current Property Manager.On February 22, 2012, [redacted] Revocable Family Trust engaged REALTY WORLD-Ballard Company, Inc., to manage the rental unit located at [redacted]. Both [redacted] and [redacted] signed the agreement.Management services include securing qualified tenants; receiving rent and deposit payments; monitoring maintenance; and performing evictions when necessary.In regards to the tenants [redacted] describes, they did bring pets into the home without knowledge or prior permission. Their lease specifically stated no pets were permitted without an approved application. I did complete their eviction through the [redacted] Justice Court as a result. The pets did do damage to the home, and most of the repairs were completed using the tenants' security deposit of $700.00. There are more repairs needed. On July 25, I spoke to [redacted] who told me to continue with needed repairs. I completed the most urgent repairs and the cleaning using the security deposit on hand.The Management Agreement states clearly the owners are responsible for repairs. My responsibility is to report when repairs are needed. Neither I nor REALTY WORLD-Ballard Company, Inc., are responsible for the damages the tenant's pets did to the home."I also add the following: Our computer program generates a statement with every owner disbursement. The statement with attached bills are emailed to the email address on account which is [redacted], we have no record of a request for paper statement which we would be more than happy to provide. We collect rents and can not guarantee the tenant will pay without fail. If payment is not made, we start an eviction process. To the point of checks and statements being mailed later: If the tenant hasn't paid when we cut owners disbursement checks and statements, as a courtesy we will send a special mailing so the owners can get paid ASAP. As to the additional repairs, the tenants are still liable and the owner can take them to small claims court or collection. These practices are all standard in our industry and in accordance with state law.Thanks,[redacted]Owner
