This is in response to the customer's complaint: I'm sorry that you are not satisfied with our reply to your previous complaint I also understand that it's frustrating to have repairs and maintenance between tenants In regards to the lawn, the previous tenants sprayed it themselves, they fertilized it themselves and I would not say that it is severely damaged There was not an issue with the lawn when we did our inspection on March 6thThere were a few sparse areas, but the grass had not started to grow and creep yet due to the harsh winter, and it was not possible to determine whether the sparse areas would come back or not Realty World does not have control over the fact that the area saw a more extreme winter than is typical for this area, and we are not able to determine if grass is going to come back or not before the appropriate season This is not something that the tenants could control either As for the closet doors that are off track, these types of closet doors often have this issue and it is due to wear and tear The tenants did not abuse these doors or operate them improperly, so therefore we cannot claim this against their security deposit You are stating that you feel that we should have had these repaired before turning the property over to your new property manager, but if we could not claim them against the last tenant's security deposit and we have no money coming in, we had no money to fix these No property management business is going to make repairs to your property from their own pocket Finally, in regards to the carpet, there were a few minor stains but nothing that would fall outside the realm of wear and tear Carpet does age and it does sometimes develop stains when people are living in the house and using it, but it was nothing that was egregious or would warrant or enable us to make a claim against the last tenant's security deposit In conclusion, Realty World did not do damage to your property The previous tenants did live in your property and hence your property experienced wear and tear Your expectation seems to be that your property should be the same as when you left it years ago, but wear and tear due to regular usage is not something that we can prevent or penalize a tenant for Further, no where in our agreement with you does it say that we can prevent wear and tear, nor does it say that we are responsible for such I'm sorry again that you feel that this is unfair, but this is part of being a landlord and is to be expected with any rental property

To Whom It May In regards to the BBB complaint ID [redacted] we did a walk thru of the property after the tenants vacated on March 31, 2014. The carpets were professionally cleaned, the previous tenants patched the walls however did not touch up paint since the paint was not provided by the owner and the tenants maintained the yard per the lease. According to our attorney who prepares the lease per Florida Law, unless there are actual holes in the walls we are unable to claim against the tenants security deposit. Also, according to the attorney only watering, mowing, edging, and cutting back bushes are the tenants responsibility. An actual lawn spray service is to be at the owners expense. There was nothing that we could withhold from the tenant as it was all due to normal wear and tear to the home which the tenants were in for 3 years. There is also two closet doors that are off the hinge which have been fixed before by our handyman. They keep coming off track so the tenants just placed it to the side but again they were not broken by the tenant. We sincerely apologize that the owner [redacted] is not happy with our response but we are unable withhold a tenants security deposit without grounds to be able to. I am rejecting this response because:
I received an email from Realty World Executive Group about my property on 6 Nov 2013 and it said, “I just wanted you to know that we did an inspection yesterday at the house and everything looked good.  The only issue was a broken sprinkler head in the front yard, so we will go ahead and send our irrigation person out to fix that.  Thanks!”. They are stating that the actual lawn spray service is to be at the owner’s expense, but as the owner I had no way of knowing that my lawn needed servicing. I am stationed in a different location and that is the reason I hired their company to manage my property. During the inspection they failed to mention that my yard was severely damaged or that it needed a lawn service preformed. It did not get like that overnight and now it’s going to be more expensive because it was neglected for so long.
The two closet doors were not broken when Realty World Executive Group took over my property and if the handyman repaired the doors, it should have been done until the job was completed successfully. The posts on the doors are broken and cannot be placed back on the tracks. This should have been noted during the final walkthrough and their handyman should have repaired it again prior to them releasing my property.
My carpet has paint on it; this should have been noted also during the final inspection. There is no way that should be consider normal wear and tear and it wasn’t removed during their professional carpet cleaning.
