We appreciate the opportunity to respond to Ms [redacted] ’s complaint and allegationsBelow is Jim F [redacted] ’s summary of the situation: [redacted] has no legal right or recourse as a result of this transactionShe is basically a renterShe “rents” her mother’s homeShe has no written or legal contract to purchase or rent the homeThe Owner and Seller, [redacted] , was released from the Listing Agreement in writing by all parties involved in the Listing Agreement.The Seller asked to be released because her daughter and daughter’s boyfriend, [redacted] , changed their mind, decided they wanted to buy the house and determined they didn’t want to pay RealtyQwest for being involved in the transaction and helping complete the saleNo agreement was entered prior or in conjunction with any party for RealtyQwest to not be compensated for our professional services as RealtorsThey simply felt they could change their mind and buy the house and force RealtyQwest out of the AgreementIn an attempt to “force” RealtyQwest out of the contract they made all sorts of outlandish allegations of my professionalism and why I asked them to do what I askedAs is reflected in her allegations in her complaint to you.The way I became involved was through a call from ***’s mother, [redacted] , who used me to buy her home many years agoShe called me and asked me to stop by the house and tell her what I thought they needed to do to the home to sell it for top dollar and what I thought I’d be able to sell it for because she and her whole family were planning to move to Tennessee, buy some land, buy a trailer to live in and basically needed to liquidate everythingI met [redacted] and [redacted] at ***’s houseThey were planning on moving to Tennessee and basically needed to do the same thing as ***[redacted] and [redacted] over the course of the next couple weeks called to explain the situation with their house and how they were trying to get money out of it to move onIn a nutshell, they said that [redacted] was a refused to sell them the home as they agreed to verbally, they put over $30,(unproveable) into the house of their own money and said that [redacted] would not be fair and give them what they felt they were dueI became very suspicious of many things they were telling me as I got to know them better because they never had any money to do basic inexpensive house repairs and didn’t pay [redacted] several times at their own admission for the rent.I did discuss with them that I would be happy to get them in touch with a mortgage guy I like to use and he could help them buy the home from [redacted] They refusedOr [redacted] refusedNot sure which but they asked me to sell the home so that [redacted] could basically cash out and give [redacted] and [redacted] whatever she thought was owed them since she made many of the mortgage payments without rent coming in I have no idea what [redacted] and [redacted] agreed to.The only reason I recommend using the lender I like is because I know him, I trust him, I know he knows what he’s doing, I know he’ll be truthful and honest with me and if he says he can get something done he’ll get it doneIf he can’t he’ll work with the client to get them to a point where they can get financingI don’t know if all of that is true from my clients’ lenders because I have no experience with them and don’t know what they are or are not capable of doingMost lenders will not work with the clients to help them get to a point of being financeableI felt this was the best advice I could give her since I don’t do anything with the mortgage and don’t have any direct knowledge of her credit score, financial or income situation or expense situationOnly the minimal information that [redacted] has offered.I don’t really care which mortgage person they use and have never made it a requirement that they use any mortgage personI only strongly recommend it because I don’t like wasting time on waiting for people that don’t know what they’re doing and try to do things their own way which may or may not workIt was clear [redacted] was going to do her own thing and didn’t want me involved so I didn’t push it furtherI did again recommend she call the mortgage person I like when she decided she wanted to put in an effort to buy the homeI had and have no knowledge of her contacting any other mortgage company( [redacted] ’s comment about voiding his own contract is so confusing I don’t even know how to respondWhat does that mean?)The contention she made that she was going to buy the house and I didn’t support that is completely and utterly in every way shape and formThey have been in communication with [redacted] for the last years trying to buy it and either were unable or [redacted] was unwillingWhen they concluded that it would be better for them for whatever reason to sell, cash out and move to Tennessee that’s when I listed the homeWe talked numerous times about the key options: 1) get [redacted] financed and “buy” the home from [redacted] for whatever price [redacted] wantedThen [redacted] could sell the house for as much as she could and pocket whatever she could after expenses (this was the much more expensive solution for [redacted] since she’d have to pay mortgage/bank and closing fees/expenses 2) [redacted] sell the home and give [redacted] whatever money [redacted] felt [redacted] was owedLong and short, [redacted] and [redacted] decided to list and sell the home with me.To this day I still do not know what they agreed to and for how muchThey refused to communicate any of those details to me so was unable to put anything together in writing or make any calculations of what they’d receive or need to sell the home for what they wanted out of it [redacted] threw out all sorts of numbers that I could not commit to and told them I don’t see how both [redacted] and [redacted] are going to walk away with as much money as they want based on estimated sale price and expenses.They didn’t convince [redacted] to let [redacted] buy the house until several weeks into the listing when everything about the listing (showings, repairs, communications, cleaning, etc.) became too much of a “nuisance” for them[redacted] to my knowledge has put in zero effort to get financed to this day and as far as I know does not even qualify for a loanI’ve talked to her about getting approved since at least August in case option was a possibility and to my knowledge she still hasn’t done anythingThey have significantly falsified all facts to achieve their end goal of removing us as Broker from thecontract once they learned enough from Jim and apparently are confident they can buy the house themselvesIt took me getting involved and having conversations with all parties that got them to a point where [redacted] and [redacted] could work together that they have not been able to do for the last yearsIf they had to “sell almost everything we had to pay for repairs” I question their true ability to qualify for a loan especially when the repairs were less than $1,and probably less than $500?The goal from day one was to sell the home and get top dollar for the [redacted] so she could pay back [redacted] or do whatever the of them figured outThey also set the price at $129,when I felt the condition of the home warranted $110-120kSeveral of the showing feedback responses we received basically said the exact same thingI supported the $129,and advised them what they needed to do to best position them to earn top dollarSome advice they took and other advice they ignored [redacted] complained all the way through about fixing anythingWhich surprises me with young children to have broken windows in the house and to have virtually removed all heat source from the houseIf they truly planned on staying they would not have removed the wood burner in preparation to take it to Tennessee (which involved patching the ceiling and roof, etc.).At the time of listing [redacted] and [redacted] had no interest in buying the house and felt the best way to get their money back was to sell the homeAny statement they’ve made to the contrary is false.So, I listed the home, did all my regular marketing (brochures, internet advertising, pictures, signs)I even dropped my commission to 2% (2% on my side and 3% to whoever represented the buyer; there were no limitations or exclusions of who that buyer would be) to help them out and because [redacted] was going to give me her listing as well and had used me in the pastI was detailed with them about what needed to happen in order for us to sell the home at top dollar whatever that turned out to be and help them get their money backThey had brokenwindows, stained carpet, broken garage doors, etcI advised them that they needed to fix things and clean things and make the home as presentable as possibleIt wasn’t until later that I realized that they had no source for heat in the home, after having removed the wood burner, which really surprised me with young children, let alone anyone else who lived in a house.While I was taking pictures of the home and capturing all the details about the home for the [redacted] Marketing/Listing sheets I realized they had no furnace or source for heat other than a small electric wall unit in the dining room and bathroomI asked my mortgage person I use frequently (the same person I advised [redacted] to call since at least August) what the FHA guideline requirements were for a buyer to finance a home and he told me the windows couldn’t be broken and there had to a be a source for heating, among other logical things like no holes in the roof, siding, plumbing that works, electrical that works, etcSo, the repairs I recommended to them were completely necessary to sell the home and making it available to the largest pool of buyers who use financing to buy a home and not just cash buyers.I shared that information with [redacted] and [redacted] and told them all the things they’d need to fix for the home to qualify for FHA or USDA financing which would most likely be 90%+ of the buyers we would meet [redacted] didn’t like it but did it anywayThat was probably the beginning of our relationship weakeningHe did not like me being firm with him and not bending to his bullying/intimidating tacticsLuckily for them, they pushed the wires back in the wall form the original baseboard heat and could buy new baseboard heaters for under $Which [redacted] still was very unhappy about.They apparently told me weeks prior that the wood burner they were removing and taking to Tennessee was the only source of heatI don’t recall that conversationIt probably just didn’t click with me that they would not have a furnace in the homeIn all the years, I’ve been in real estate I’ve never seen that so was very surprised when I uncovered that fact for myselfThey also said they told me about the restriction on showing times but if they did it could only have been at the 1st meeting weeks priorIf they had (reminded) told me at the time of listing I would have refused the listingThe restrictions she’s stated in the complaint were never discussed prior to me finding they weren’t happy with the showing schedulesI believe that they did not consider restricting the showings until it became a “nuisance” to them and they didn’t realize how challenging it can be to sell your homeIn hindsight, I should have spent more time on this topic but felt they had a good handle on things overall and would be supportive of the “do anything” to sell the home attitudeWhen I first met them, they were highly motivated to move to Tennessee and sell everything and get as much money for the move as possibleSomething changed.Keep in mind the financial benefit is almost all theirs and is very little mine especially at a discounted commission rate and a very difficult home to sell due to poor condition and being overpriced for the condition making my time and effort significantly greater as a resultTo cancel showings and significantly reduce showing windows significantly increased the difficulty in marketing their home for saleThe showing restrictions they’ve stated are none that we discussed prior to or during the listingThey were not even mentioned to the best of my recollection until basically the end of our relationshipThis issue really is irrelevant and just a convenience excuse to go a different direction for them.Once I put the home on the market we had a showing the next dayI didn’t have time to put the lockbox on the door and the sign in the yard or get the key from [redacted] So, I went to [redacted] ’s work at her request, got her key, made a copy, put her Rottweiler outside (that doesn’t like me) so she wouldn’t attack the people at the showing, got [redacted] her key back, made the brochures and made sure the showing could get inside.Over the next weeks we had several showingsAt least every other day if not moreIt wasn’t until I asked them why they cancelled a showing request that I found they weren’t happy with the timesThis is another area of the many topics I don’t know what to believeThey did not complain about the showings after numerous texting back and forth and phone calls.I took the home “off the market” (which means no more showings or inquiries were allowed; I did not remove the sign or the lockbox in anticipation of “putting the house back on the market” once they got things sorted out on their side), at [redacted] and [redacted] ’s insistence and communicated the fact to [redacted] , because they had decided to refuse to show the homeInstead of continuing to cancel showings and hurt potential relationships with other Realtors in the area and their clients I advised them to figure out what they wanted to do for showings and the showing schedule since they couldn’t figure out the times with me on the phoneI don’t recall them ever talking to me about any time restrictions until this momentI also asked if they were serious about selling the homeLater they said they wanted to buy the home themselves but didn’t know what [redacted] would do because they had such a bad relationship with herI told them I’d call [redacted] and ask if she’d work with [redacted] to buy the home and if she’d sell it to her and what she wanted out of the dealI told [redacted] to take a couple of days and figure out what she wantedOf course, I wanted to still be involved in the transactionI’ve done a lot of work and would be doing a lot of work to make the transaction come to fruitionNext call I got from [redacted] he was extremely nasty and rude and made up all sorts of disparaging slanderous comments about me and falsifying everything that happenedI quickly told him he wasn’t going to talk to me that way and I knew what they were up to in cutting me out of the transaction.I sent an email to [redacted] and [redacted] and advised them that for us to Mutually Release each other I wanted $1,for my services renderedLong and short, [redacted] didn’t understand why I wanted the $1,so explained all the work and activity and money I’d already put in to selling the homeShe asked if I’d take half and since I didn’t want to keep fighting over it I agreed to settle for $on the condition that my sign and lockbox were returned in the same condition and that it was amicable release and that neither party would speak negatively of the otherWhich is why it’s highly disappointing that I must respond to the Revdex.com in this letter after we had apparently made the agreement and apparently were on the same page[redacted] has made several of the mortgage payments herself recently to help [redacted] and ***When I first got involved the home was not even in financeable condition [redacted] and [redacted] apparently don’t have the money to properly maintain their home and I am very skeptical whether they will ever qualify for a mortgage.Bottom-line, [redacted] and [redacted] have devised a plan to disparage and denigrate Jim F [redacted] and RealtyQwest and remove us from the contract and save themselves money by not paying for the services they hired Jim and RealtyQwest to do once they learned enough from Jim’s advice and determined they had enough information where they could purchase the home on their ownThe letter to the Revdex.com in my opinion is nothing more than part of their “plan” and the details [redacted] has manufactured in her complaint are irrelevant and largely allegationsMerely a means to an endNothing more than In an attempt to “force” RealtyQwest out of the contract they made all sorts of outlandish false allegations of my professionalism and why I asked them to do what I asked. As is reflected in her false allegations in her complaint to you.The way I became involved was through a call from [redacted]’s mother, [redacted], who used me to buy her home many years ago. She called me and asked me to stop by the house and tell her what I thought they needed to do to the home to sell it for top dollar and what I thought I’d be able to sell it for because she and her whole family were planning to move to Tennessee, buy some land, buy a trailer to live in and basically needed to liquidate everything. I met [redacted] and [redacted] at [redacted]’s house. They were planning on moving to Tennessee and basically needed to do the same thing as [redacted].[redacted] and [redacted] over the course of the next couple weeks called to explain the situation with their house and how they were trying to get money out of it to move on. In a nutshell, they said that [redacted] was a refused to sell them the home as they agreed to verbally, they put over $30,000 (unproveable) into the house of their own money and said that [redacted] would not be fair and give them what they felt they were due. I became very suspicious of many things they were telling me as I got to know them better because they never had any money to do basic inexpensive house repairs and didn’t pay [redacted] several times at their own admission for the rent.I did discuss with them that I would be happy to get them in touch with a mortgage guy I like to use and he could help them buy the home from [redacted]. They refused. Or [redacted] refused. Not sure which but they asked me to sell the home so that [redacted] could basically cash out and give [redacted] and [redacted] whatever she thought was owed them since she made many of the mortgage payments without rent coming in I have no idea what [redacted] and [redacted] agreed to.The only reason I recommend using the lender I like is because I know him, I trust him, I know he knows what he’s doing, I know he’ll be truthful and honest with me and if he says he can get something done he’ll get it done. If he can’t he’ll work with the client to get them to a point where they can get financing. I don’t know if all of that is true from my clients’ lenders because I have no experience with them and don’t know what they are or are not capable of doing. Most lenders will not work with the clients to help them get to a point of being financeable. I felt this was the best advice I could give her since I don’t do anything with the mortgage and don’t have any direct knowledge of her credit score, financial or income situation or expense situation. Only the minimal information that [redacted] has offered.I don’t really care which mortgage person they use and have never made it a requirement that they use any mortgage person. I only strongly recommend it because I don’t like wasting time on waiting for people that don’t know what they’re doing and try to do things their own way which may or may not work. It was clear [redacted] was going to do her own thing and didn’t want me involved so I didn’t push it further. I did again recommend she call the mortgage person I like when she decided she wanted to put in an effort to buy the home. I had and have no knowledge of her contacting any other mortgage company. ([redacted]’s comment about voiding his own contract is so confusing I don’t even know how to respond. What does that mean?)The contention she made that she was going to buy the house and I didn’t support that is completely and utterly false in every way shape and form. They have been in communication with [redacted] for the last 4 years trying to buy it and either were unable or [redacted] was unwilling. When they concluded that it would be better for them for whatever reason to sell, cash out and move to Tennessee that’s when I listed the home. We talked numerous times about the key options: 1) get [redacted] financed and “buy” the home from [redacted] for whatever price [redacted] wanted. Then [redacted] could sell the house for as much as she could and pocket whatever she could after expenses (this was the much more expensive solution for [redacted] since she’d have to pay mortgage/bank and closing fees/expenses . 2) [redacted] sell the home and give [redacted] whatever money [redacted] felt [redacted] was owed. Long and short, [redacted] and [redacted] decided to list and sell the home with me.To this day I still do not know what they agreed to and for how much. They refused to communicate any of those details to me so was unable to put anything together in writing or make any calculations of what they’d receive or need to sell the home for what they wanted out of it. [redacted] threw out all sorts of numbers that I could not commit to and told them I don’t see how both [redacted] and [redacted] are going to walk away with as much money as they want based on estimated sale price and expenses.They didn’t convince [redacted] to let [redacted] buy the house until several weeks into the listing when everything about the listing (showings, repairs, communications, cleaning, etc.) became too much of a “nuisance” for them.[redacted] to my knowledge has put in zero effort to get financed to this day and as far as I know does not even qualify for a loan. I’ve talked to her about getting approved since at least August in case option 1 was a possibility and to my knowledge she still hasn’t done anything. They have significantly falsified all facts to achieve their end goal of removing us as Broker from thecontract once they learned enough from Jim and apparently are confident they can buy the house themselves. It took me getting involved and having conversations with all parties that got them to a point where [redacted] and [redacted] could work together that they have not been able to do for the last 4 years. If they had to “sell almost everything we had to pay for repairs” I question their true ability to qualify for a loan especially when the repairs were less than $1,000 and probably less than $500?The goal from day one was to sell the home and get top dollar for the [redacted] so she could pay back [redacted] or do whatever the 3 of them figured out. They also set the price at $129,900 when I felt the condition of the home warranted $110-120k. Several of the showing feedback responses we received basically said the exact same thing. I supported the $129,900 and advised them what they needed to do to best position them to earn top dollar. Some advice they took and other advice they ignored. [redacted] complained all the way through about fixing anything. Which surprises me with 2 young children to have broken windows in the house and to have virtually removed all heat source from the house. If they truly planned on staying they would not have removed the wood burner in preparation to take it to Tennessee (which involved patching the ceiling and roof, etc.).At the time of listing [redacted] and [redacted] had no interest in buying the house and felt the best way to get their money back was to sell the home. Any statement they’ve made to the contrary is false.So, I listed the home, did all my regular marketing (brochures, internet advertising, pictures, signs). I even dropped my commission to 2% (2% on my side and 3% to whoever represented the buyer; there were no limitations or exclusions of who that buyer would be) to help them out and because [redacted] was going to give me her listing as well and had used me in the past. I was detailed with them about what needed to happen in order for us to sell the home at top dollar whatever that turned out to be and help them get their money back. They had brokenwindows, stained carpet, broken garage doors, etc. I advised them that they needed to fix things and clean things and make the home as presentable as possible. It wasn’t until later that I realized that they had no source for heat in the home, after having removed the wood burner, which really surprised me with 2 young children, let alone anyone else who lived in a house.While I was taking pictures of the home and capturing all the details about the home for the [redacted] Marketing/Listing sheets I realized they had no furnace or source for heat other than a small electric wall unit in the dining room and bathroom. I asked my mortgage person I use frequently (the same person I advised [redacted] to call since at least August) what the FHA guideline requirements were for a buyer to finance a home and he told me the windows couldn’t be broken and there had to a be a source for heating, among other logical things like no holes in the roof, siding, plumbing that works, electrical that works, etc. So, the repairs I recommended to them were completely necessary to sell the home and making it available to the largest pool of buyers who use financing to buy a home and not just cash buyers.I shared that information with [redacted] and [redacted] and told them all the things they’d need to fix for the home to qualify for FHA or USDA financing which would most likely be 90%+ of the buyers we would meet. [redacted] didn’t like it but did it anyway. That was probably the beginning of our relationship weakening. He did not like me being firm with him and not bending to his bullying/intimidating tactics. Luckily for them, they pushed the wires back in the wall form the original baseboard heat and could buy new baseboard heaters for under $200. Which [redacted] still was very unhappy about.They apparently told me 3 weeks prior that the wood burner they were removing and taking to Tennessee was the only source of heat. I don’t recall that conversation. It probably just didn’t click with me that they would not have a furnace in the home. In all the years, I’ve been in real estate I’ve never seen that so was very surprised when I uncovered that fact for myself. They also said they told me about the restriction on showing times but if they did it could only have been at the 1st meeting 3 weeks prior. If they had (reminded) told me at the time of listing I would have refused the listing. The restrictions she’s stated in the complaint were never discussed prior to me finding they weren’t happy with the showing schedules. I believe that they did not consider restricting the showings until it became a “nuisance” to them and they didn’t realize how challenging it can be to sell your home. In hindsight, I should have spent more time on this topic but felt they had a good handle on things overall and would be supportive of the “do anything” to sell the home attitude. When I first met them, they were highly motivated to move to Tennessee and sell everything and get as much money for the move as possible. Something changed.Keep in mind the financial benefit is almost all theirs and is very little mine especially at a discounted commission rate and a very difficult home to sell due to poor condition and being overpriced for the condition making my time and effort significantly greater as a result. To cancel showings and significantly reduce showing windows significantly increased the difficulty in marketing their home for sale. The showing restrictions they’ve stated are none that we discussed prior to or during the listing. They were not even mentioned to the best of my recollection until basically the end of our relationship. This issue really is irrelevant and just a convenience excuse to go a different direction for them.Once I put the home on the market we had a showing the next day. I didn’t have time to put the lockbox on the door and the sign in the yard or get the key from [redacted]. So, I went to [redacted]’s work at her request, got her key, made a copy, put her Rottweiler outside (that doesn’t like me) so she wouldn’t attack the people at the showing, got [redacted] her key back, made the brochures and made sure the showing could get inside.Over the next weeks we had several showings. At least 1 every other day if not more. It wasn’t until I asked them why they cancelled a showing request that I found they weren’t happy with the times. This is another area of the many topics I don’t know what to believe. They did not complain about the showings after numerous texting back and forth and phone calls.I took the home “off the market” (which means no more showings or inquiries were allowed; I did not remove the sign or the lockbox in anticipation of “putting the house back on the market” once they got things sorted out on their side), at [redacted] and [redacted]’s insistence and communicated the fact to [redacted], because they had decided to refuse to show the home. Instead of continuing to cancel showings and hurt potential relationships with other Realtors in the area and their clients I advised them to figure out what they wanted to do for showings and the showing schedule since they couldn’t figure out the times with me on the phone. I don’t recall them ever talking to me about any time restrictions until this moment. I also asked if they were serious about selling the home. Later they said they wanted to buy the home themselves but didn’t know what [redacted] would do because they had such a bad relationship with her. I told them I’d call [redacted] and ask if she’d work with [redacted] to buy the home and if she’d sell it to her and what she wanted out of the deal. I told [redacted] to take a couple of days and figure out what she wanted. Of course, I wanted to still be involved in the transaction. I’ve done a lot of work and would be doing a lot of work to make the transaction come to fruition. Next call I got from [redacted] he was extremely nasty and rude and made up all sorts of disparaging slanderous comments about me and falsifying everything that happened. I quickly told him he wasn’t going to talk to me that way and I knew what they were up to in cutting me out of the transaction.I sent an email to [redacted] and [redacted] and advised them that for us to Mutually Release each other I wanted $1,500 for my services rendered. Long and short, [redacted] didn’t understand why I wanted the $1,500 so explained all the work and activity and money I’d already put in to selling the home. She asked if I’d take half and since I didn’t want to keep fighting over it I agreed to settle for $750 on the condition that my sign and lockbox were returned in the same condition and that it was amicable release and that neither party would speak negatively of the other. Which is why it’s highly disappointing that I must respond to the Revdex.com in this letter after we had apparently made the agreement and apparently were on the same page.[redacted] has made several of the mortgage payments herself recently to help [redacted] and [redacted]. When I first got involved the home was not even in financeable condition. [redacted] and [redacted] apparently don’t have the money to properly maintain their home and I am very skeptical whether they will ever qualify for a mortgage.Bottom-line, [redacted] and [redacted] have devised a plan to disparage and denigrate Jim F[redacted] and RealtyQwest and remove us from the contract and save themselves money by not paying for the services they hired Jim and RealtyQwest to do once they learned enough from Jim’s advice and determined they had enough information where they could purchase the home on their own. The letter to the Revdex.com in my opinion is nothing more than part of their “plan” and the details [redacted] has manufactured in her complaint are irrelevant and largely false allegations.
