There are several facts wrong with this complaint.The debtor, Mr. [redacted] was behind on a loan, and the loan was in default.Debtors are never happy when their toys/vehicles are repossessed. So I understand him being disgruntled and why he made this complaint. He fails to take responsibility for his...
actions, and fails to realize repossession is a costly lesson and mistake to make.I repossessed this unit on Wednesday July 27, 2016. July 28, 2016 at 12:14pm I received the release letter from the bank saying he had paid up to them and that I could release it to him after he pays the $100 redemption fee and $20 per day of storage that they allow. It is not my job to call every debtor and schedule with them when they can get their stuff. This is the debtors responsibility to make contact immediately. The first call I got from him was at 2:35pm on July 30, 2016 saying he wished to get it back, I did not answer as it was the weekend and I only work Monday-Friday. However, I did return his call at 5:40pm the same day July 30, 2016. No one answered so I left a voice mail on the answering service explaining the amount due and times he could pick it up. The debtor returned my call Sunday July 31, 2016 at 2:55pm and left another voicmail wishing to come and get it, I couldn't answer as I was at a church event with family.I returned the debtors call at 3:13pm Sunday July 31, 2016 just out of kindness, as I don't work the weekends. He tells me how he really wishes to pick it up that day (Sunday). I agreed to do so even though ordinarily I would not. He leaves me sitting for 30 minutes to meet him with his unit after I agreed to meet after business hours on a Sunday when I don't work, and away from my families normal Sunday activities. I gave him the address and also directions. He somehow got them mixed up and was on the other side of town. So I waited longer for him, he finally shows up and has a friend with him. I meet with the debtor and show him the release letter the bank makes them sign when taking it back. At that point he gets irate over the charges. These are charges the bank told him about at first, and also that I left him on his messaging service. His friend then makes bodily threats against me. I told him I don't even have to meet them on a Sunday, I could have made him wait until Monday and charged another days storage, and that he should be more appreciative. He then told me he was going to make a complaint and I told him to do what he has to do.Understand with debtors they have broken promises, misunderstood their payment dates, ignored contractual agreements and also have had multiple calls from the bank before I get involved. He is upset he got caught and had to pay the penalties, as most debtors are. I have yet to have one be happy and tip me or thank me for repossessing their car, truck, suv, boat, motorcycle or 4 wheeler.If someone told me that I should hurry up and get my stuff back, I would be calling and getting it back ASAP. He was notified by the bank and also myself.There will be no refund, if he is not happy with his banks contract with me then he should choose another bank.As for an apology, I am sorry you missed your payments and had to meet me.
