His employees used the materials on hand to create the fix for a problem MrGray claims I causedI hardly think soPerhaps the patio should not have been dug as deeply on the end that was not removed? Am I in love with his choice of stamp? (It is not the Ashlar I requested; I don’t know what it is) Not really, but am I willing to live with it? Yes Should he have made the concrete colors match? YesShould I have had to call repeatedly to make this happen? Absolutely not! I also have the voicemail from ***Gray stating that the coloring of the concrete had slipped MrGray’s mind and that it would be taken care of either Monday, September 12, or Tuesday, September 13, weather permittingThough I also mentioned the handrails, nothing was mentioned about making them right in her voice messageI did call again and left another message stating that no one showed up and fixed the colorBy Friday, September 16, my patience had passed with having calls ignored and an unfinished job, despite his having my full payment for weeks By the way, the weather was perfect both days, in addition to many others the job could have been finished It is unfortunate that a complaint is needed to get his attention Had MrGray completed the work in a timely manner, and the weather DID allow for it, I would not have filed a complaint, but because he ignored an unfinished job and my calls, I am completely frustrated with the situation It is because of this that just doing what was right in the first place won’t fix it It is the sum of the issues and lack of timeliness that causes me to believe I am owed – after all, he has had the use of my money for more than five weeks while I have a still an unfinished project for no reason, only excuses Regards, [redacted]

Revdex.com: I have reviewed the response made by the business in reference to complaint ID [redacted] , and have determined that this does not resolve my complaint For your reference, details of the offer I reviewed appear below It does not appear MrA [redacted] understood the heart of the issue I was introduced to his agents, Daniel S [redacted] and Mark B [redacted] as financial advisors As financial advisors, his agents explained to me that they are legally bound to provide financial advice serving my best interest I had not even considered buying any type of insurance prior to meeting them, but they introduced whole life insurance as not only a way to protect myself but also as the best investment vehicle available to me, repeatedly mentioning 6% annual returns with a minimum 4% guaranteed They even repeatedly tried to demonstrate that whole life policies would generally outperform the market in the long run due to market fluctuations Through their presentations and models, I was led to believe that cash values were not only similar but superior to equity in a retirement account because they could be leveraged at a more favorable loan prior to retirement should I try to buy a house or require other large expenditures At retirement, I was led to believe that cash values were about as similar to cash since they could be spent down When we reached the investment conversations, I realized that Dan and Mark intended to invest all my free remaining cash flow (excluding employer match in a 401k) into a taxable brokerage account claiming that the whole life insurance policy would cover all the financial needs a 401k and IRA might fulfill It was at this point that I had great doubts about their financial plan Upon my father’s death and the payout of his whole life policy, I realized that cash values are not in any way shape or form similar to cash, and without the cash values the returns were nowhere near as good as your agents had presented What I learned was that cash values are essentially just a line of credit to borrow against the death benefit While some dividends may be paid up to the principal tax-free and may provide some money for retirement, there was evidently no way to ever truly spend the full amount of cash values and the closest method to achieving this would be to take out loans against the policy and pay for both the loan and all associated fees/interest through the death benefit None of this was explained in the presentations, and had I known that whole life insurance worked this way I would have definitely recognized life insurance was not an appropriate product for me at this time and not have purchased whole life insurance At no point did Mark B [redacted] or Daniel S [redacted] reveal their compensation for selling me a whole life insurance policy either Had they been upfront about this, I could have recognized the conflict of interest and been far more scrutinizing I am not alone in this deception, as I have discussed whole life insurance throughout this entire process with [redacted] , the coworker who introduced me to your agents, and he had the same initial impression of cash values but has become similarly disappointed with your agents upon learning the above facts On April 11th 2017, I called [redacted] Life Insurance directly, who advised that I speak to the agents who sold me the policy because they may be able to help me recover more of my annual payment than just the surrender value I subsequently met with your agents on April 19th, who tried to convince me that the whole life policy was the best financial product for me and that they would not be able to get more than the $surrender value I found this too difficult to believe, so I texted Mark B [redacted] on 4/20/to see if there were other options and whether PA Code might apply since I happened to see it while searching the internet for solutions Mark emailed the following response on the same day:***,Sorry I cannot help you any further We will also be terminating your investment accountsAny disputes you have moving forward can send to [redacted] I called [redacted] Life Insurance again on 4/20/and a different agent suggested the same thing, that I should speak to the sales agent Feeling frustrated and cornered, I filed this Revdex.com complaint that night Since then, I have learned that there is clearly an arbitration process with [redacted] Life Insurance and/or the Pennsylvania Insurance Department that can result in having this policy rescinded with a full refund So that we are on the same page, based on MrA [redacted] ’s letter he is alleging the following:1) Owning $1,400,whole life insurance and $1,600,yearly renewable term life insurance is suitable and appropriate for a year old single male with a yearly gross income of $95,and no loans, debts, liabilities, or assets despite his only named beneficiary being his retired mother who would not need a penny of that death benefit to maintain her lifestyle2) For the same individual described above, purchasing $1,400,of whole life insurance was and still is the best financial decision in terms of investment and savings.3) While the agents did not receive the full year’s premium, they did not receive upwards of $each for selling me the whole life policy.4) The phone agents I spoke to at [redacted] Life Insurance (phone number [redacted] ) were wrong to say that there are instances where the policy can be refunded in full5) The phone agents I spoke to at [redacted] Life Insurance (phone number [redacted] ) were wrong to redirect me to Mark B [redacted] and Daniel S [redacted] since they are apparently unable to help in any of the processes necessary to returned a greater portion of my payment than the surrender value.6) Despite the fact that Mark B [redacted] and Daniel S [redacted] did not reveal their conflict of interest and compensation for selling me the whole life policy, they were not acting in bad faith.7) Despite the fact that Mark B [redacted] and Daniel S [redacted] did not provide me any help or explanation regarding the insurance complaint process they were not acting in bad faith To continue MrA [redacted] ’s analogy, his agents tried to sell a television with features it did not truly have and I can only hope that [redacted] and I are the only two clients who have been misled I have attached some of the documents used by his agents that were used to lead me to believe whole life insurance would be a good investment and also misled me to believing it was comparable to equities Regards, [redacted] ***

Revdex.com:
I have reviewed the response made by the business in reference to complaint ID [redacted], and have determined that this does not resolve my complaint.       Mr. Gray has totally missed the point of my complaint! The patio is nice; this is not the issue! Forget about the moving of the fireplace; that was only aggravating. As far as the stone on the fireplace, that is in the contract. He is correct that I called to thank him for making right what his employees had done wrong.  I have pictures that were taken of his employee holding a tape measure with a line and a chair sitting cockeyed (downhill) on the patio pad he claims was well done. The employee called and told someone from the company that I knew what I was talking about and what was there was wrong. Mr. Gray did not come to the site to even evaluate the issue. I had to text the photos to him. I am happy to provide those pictures, should someone need/want to see them. The men who did the cutting out and replacement of that concrete had an unpleasant job to do on an unbearably hot day, and I acknowledged their effort.     He is correct that I have 2 more columns than we had agreed upon; however, those columns and walls are where the patio was to be as circular as possible and to encompass a tree, which it is not and does not. I have his drawing ONLY because the manager of my HOA scanned and sent it to me – never did Mr. Gray provide it. When I received it, I called and told [redacted]. Gray that I did not want the project to continue. I   spoke with Mr. Gray and he told me to trust him – I would be happy with the finished project. Mr. Gray had decided that though he was told I did not want the fireplace centered, he would center it. I told them the project needed to stop; that was when he sent Randy to figure out something to make things look right.  His suggestion put the fireplace where I wanted it, but he added a wall and two columns I agreed to so the project would look right. The tree is outside the patio rather than being incorporated in it. I did call to thank him for trying to make things look right.     When I expressed my concern about the landscaping washing onto the patio, his employees said that some kind of wall would be needed because they had dug deeper to correct the slope. (It should be noted that typically a patio slopes the ¼” per foot away from the house; in this case, it slopes to the side, toward the neighbors’ property.) His employees used the materials on hand to create the fix for a problem Mr. Gray claims I caused. I hardly think so. Perhaps the patio should not have been dug as deeply on the end that was not removed?      Am I in love with his choice of stamp?  (It is not the Ashlar I requested; I don’t know what it is) Not really, but am I willing to live with it? Yes.  Should he have made the concrete colors match? Yes. Should I have had to call repeatedly to make this happen? Absolutely not! I also have the voicemail from [redacted]. Gray stating that the coloring of the concrete had slipped Mr. Gray’s mind and that it would be taken care of either Monday, September 12, or Tuesday, September 13, weather permitting. Though I also mentioned the handrails, nothing was mentioned about making them right in her voice message. I did call again and left another message stating that no one showed up and fixed the color. By Friday, September 16, my patience had passed with having calls ignored and an unfinished job, despite his having my full payment for 5 weeks.  By the way, the weather was perfect both days, in addition to many others the job could have been finished.  It is unfortunate that a complaint is needed to get his attention.     Had Mr. Gray completed the work in a timely manner, and the weather DID allow for it, I would not have filed a complaint, but because he ignored an unfinished job and my calls, I am completely frustrated with the situation.  It is because of this that just doing what was right in the first place won’t fix it.  It is the sum of the issues and lack of timeliness that causes me to believe I am owed – after all, he has had the use of my money for more than five weeks while I have a still an unfinished project for no reason, only excuses.

I am sending this response in regarding the complaint filed by [redacted].  First of all, there are always two sides to a story.  When we sign a contract, the start date OR work to be done is always upon weather permitting no matter what the date is on the contract.  [redacted]....

[redacted] received a VERY NICE job.  She had my guys remove the concrete when there was nothing wrong with it which caused the wall to have to be put in.  She was to get about 15' of wall and she got way more wall than that, over 20'.  She was to have 2 columns put in on this job and ended up with 4 or 5 (at no extra cost).  I sent guys over to move her fireplace and it was not there yet like she said it would be and yes my guys were sent back again.  These guys have been being taken off of other job sites to go back to her house for the fireplace.  She had the fireplace moved because she didn't want to wait for someone to come back to her home-this was not fault of mine.  My guys are not just sitting around waiting for her to call they are on other job sites working.  This was being done out of courtesy for [redacted].  I was out of town toward the end of her job and she had made some demands, and when I disagreed she threatened me through my worker who had called me.  She said I'd either do this or that or she'd see me in court.  I said "then I will see her in court".  This is WHY the contract was written up on notebook paper for her to sign before we went any further with the work.  [redacted] failed to mention of course that the fireplace was also put in and that I not only installed it but I put cultured stone on it WITHOUT being paid.  The cost for this would be $2000.  She called on August 3, 2016 and left a voicemail which I saved.  The message stating how pleased she was with the job.  The voicemail also stated the job looked a millions times better to her and she was pleased with the crew and wanted to say she was extremely happy with what they have done and she wanted to say thank you! [redacted] had the plans and at anytime she could have said No I don't want it this way instead she allowed us to continued.  She kept in contact with me along the whole process of the job including any issues she may have had, we seemed to work through.  The only thing I need to do and I am willing to do is match the color of the patio and change out the handrails to match the color of her existing rail which I told her I would do.  I AM NOT REFUNDING ANY MONEY to [redacted].  Though I may have had materials left over from another job and used on her job-I still had to pay for that material-IT DID NOT COME FREE TO ME.  [redacted] got a very nice job and was very pleased with it she just wanted us to come back to make the color match on the concrete and replace the hand rails to match.  I will come back as I said I would and match the concrete color and replace the rail to match color of her existing rail. Clarence G.

[redacted] The complaint I filed against [redacted] has be resolved. He came and completed the job.

Owner called in and explained that they are on the way to finish the install of the damaged window and it will be completed today. Owner also stated that he feels the complaint was placed on his company in error because the windows have a warranty through the manufacturer of the windows and they are...

responsible for paying for the install of the new window and that was the hold up on the install of the new window. Also the customer didn't want to have a window installed over the winter months so it's been pushed back to the spring. Once the warmer weather came, the business has tried to get in contact with the customer to install the new window and the customer has had to reschedule numerous times. Finally able to get into the home today to get this install completed.

Revdex.com:
I have reviewed the response made by the business in reference to complaint ID [redacted], and have determined that this does not resolve my complaint.  For your reference, details of the offer I reviewed appear below.
It does not appear Mr. A[redacted] understood the heart of the issue.  I was introduced to his agents, Daniel S[redacted] and Mark B[redacted] as financial advisors.  As financial advisors, his agents explained to me that they are legally bound to provide financial advice serving my best interest.  I had not even considered buying any type of insurance prior to meeting them, but they introduced whole life insurance as not only a way to protect myself but also as the best investment vehicle available to me, repeatedly mentioning 6% annual returns with a minimum 4% guaranteed.  They even repeatedly tried to demonstrate that whole life policies would generally outperform the market in the long run due to market fluctuations.  Through their presentations and models, I was led to believe that cash values were not only similar but superior to equity in a retirement account because they could be leveraged at a more favorable loan prior to retirement should I try to buy a house or require other large expenditures.  At retirement, I was led to believe that cash values were about as similar to cash since they could be spent down.  When we reached the investment conversations, I realized that Dan and Mark intended to invest all my free remaining cash flow (excluding employer match in a 401k) into a taxable brokerage account claiming that the whole life insurance policy would cover all the financial needs a 401k and IRA might fulfill.  It was at this point that I had great doubts about their financial plan.  Upon my father’s death and the payout of his whole life policy, I realized that cash values are not in any way shape or form similar to cash, and without the cash values the returns were nowhere near as good as your agents had presented.  What I learned was that cash values are essentially just a line of credit to borrow against the death benefit.  While some dividends may be paid up to the principal tax-free and may provide some money for retirement, there was evidently no way to ever truly spend the full amount of cash values and the closest method to achieving this would be to take out loans against the policy and pay for both the loan and all associated fees/interest through the death benefit.  None of this was explained in the presentations, and had I known that whole life insurance worked this way I would have definitely recognized life insurance was not an appropriate product for me at this time and not have purchased whole life insurance.  At no point did Mark B[redacted] or Daniel S[redacted] reveal their compensation for selling me a whole life insurance policy either.  Had they been upfront about this, I could have recognized the conflict of interest and been far more scrutinizing.  I am not alone in this deception, as I have discussed whole life insurance throughout this entire process with [redacted], the coworker who introduced me to your agents, and he had the same initial impression of cash values but has become similarly disappointed with your agents upon learning the above facts.  On April 11th 2017, I called [redacted] Life Insurance directly, who advised that I speak to the agents who sold me the policy because they may be able to help me recover more of my annual payment than just the surrender value.  I subsequently met with your agents on April 19th, who tried to convince me that the whole life policy was the best financial product for me and that they would not be able to get more than the $1822.70 surrender value.  I found this too difficult to believe, so I texted Mark B[redacted] on 4/20/17 to see if there were other options and whether PA Code 73.127 might apply since I happened to see it while searching the internet for solutions.  Mark emailed the following response on the same day:[redacted],Sorry I cannot help you any further… We will also be terminating your investment accounts. Any disputes you have moving forward can send to [redacted]  I called [redacted] Life Insurance again on 4/20/17 and a different agent suggested the same thing, that I should speak to the sales agent.  Feeling frustrated and cornered, I filed this Revdex.com complaint that night.  Since then, I have learned that there is clearly an arbitration process with [redacted] Life Insurance and/or the Pennsylvania Insurance Department that can result in having this policy rescinded with a full refund.   So that we are on the same page, based on Mr. A[redacted]’s letter he is alleging the following:1)  Owning $1,400,000 whole life insurance and $1,600,000 yearly renewable term life insurance is suitable and appropriate for a 24 year old single male with a yearly gross income of $95,000 and no loans, debts, liabilities, or assets despite his only named beneficiary being his retired mother who would not need a penny of that death benefit to maintain her lifestyle. 2)  For the same individual described above, purchasing $1,400,000 of whole life insurance was and still is the best financial decision in terms of investment and savings.3)  While the agents did not receive the full year’s premium, they did not receive upwards of $2000 each for selling me the whole life policy.4)  The phone agents I spoke to at [redacted] Life Insurance (phone number [redacted]) were wrong to say that there are instances where the policy can be refunded in full5)  The phone agents I spoke to at [redacted] Life Insurance (phone number [redacted]) were wrong to redirect me to Mark B[redacted] and Daniel S[redacted] since they are apparently unable to help in any of the processes necessary to returned a greater portion of my payment than the surrender value.6)  Despite the fact that Mark B[redacted] and Daniel S[redacted] did not reveal their conflict of interest and compensation for selling me the whole life policy, they were not acting in bad faith.7)  Despite the fact that Mark B[redacted] and Daniel S[redacted] did not provide me any help or explanation regarding the insurance complaint process they were not acting in bad faith.  To continue Mr. A[redacted]’s analogy, his agents tried to sell a television with features it did not truly have and I can only hope that [redacted] and I are the only two clients who have been misled.  I have attached some of the documents used by his agents that were used to lead me to believe whole life insurance would be a good investment and also misled me to believing it was comparable to equities.

January 4, 2016Cincinnati Revdex.comCincinnati, OhioRe:  [redacted]Complaint  I.D. #[redacted]Dear [redacted]This letter is to confirm receipt of the complaint filed with your office regarding mold remediation at the home of [redacted]. Our scope of work was to...

clean and remove mold from the joists and ceiling sheathing in the crawl space of the home as well as to apply a fungal sealer and remove the water impacted vapor barrier. We did all of the above as well as wipe down and treat the walls in the interior of the house even though it was not part of the contract. The reason for this remedial work as we understood it was that there had been a plumbing breakwhich left water on and under the plastic vapor barrier causing mold growth. From the beginning [redacted] had made it clear that he didn’t have much money and that they were on a fixed income and that [redacted] was very ill from mold. It was for these reasons that we did a complimentary cleaning and treatment of the interior of the home.We removed the water and moisture impacted plastic from underneath the house. The purpose of a vapor barrier is to prevent naturally occurring moisture and water vapor from rising from the ground and wetting the wood building materials. Since money was an issue we removed only the plastic that was wet or had water under it. [redacted] was to replace the vapor barrier later at his convenience since money was tight.  From the very beginning money was an issue. We bent over backwards to help the [redacted]. Initially our proposal was $2400  and then $1800 and finally $1200 which is very low for this type of work. The work was basically done at our cost with little to no profit. It is important to mention that we did our work and we did it properly. At no time did we guarantee that mold would not return for five years. There are simply too many factors out of our control such as, new pipe breaks, rain, improperly installed moisture barrier, flooding, inadequate air flow etc... Further we don’t believe that it was a failure of our work that caused new mold growth but a failure [redacted] to understand the dynamics in play under his house. In the complaint [redacted] stated that he Closed the vents under the house due to the weather. The purpose of these vents are to provide adequate ventilation at all times and to prevent stagnation of moisture laden air which causes mold. This air movement is crucial even in the winter. That is why the pipes underneath the home should be insulated to help prevent freezing. The cavity between the floor joists and the floor should have insulation as well which will keep the floors from being so cold. The same principle of cross ventilation exist in the attics with gable vent and soffit vents. If the soffit vents are covered by insulation the moisture laden air has no where to go and settles on the truss’ and sheathing setting up a perfect condition for mold growth. The only difference between the two is that there is no moisture from the ground requiring a moisture barrier in the attic. Attics generally have fans, turbines or ridge vents to aid in air movement. Homes that have poor under the house ventilation and heavy moisture  problems generally have a humistat installed which would pull the air and moisture out of the crawlspace. These devices are designed to automatically shut off and on at certain temperatures and are relatively inexpensive. When we finished our work  and left the home the crawlspace did not have any of the above. Lastly ,we have no idea when or if the [redacted] installed a new vapor barrier. However we know that when we left their home there were no pools of water in the crawl space. Yes, the ground was wet and moist from washing and treating the joists and floor sheathing with the mold killer and fungal sealer but not enough to stay wet long enough to cause mold growth.. If the crawl space vents were closed and no moisture barrier was installed it is completely plausible that pent up moisture from the ground eroded the sealer allowing for new mold growth. It is not uncommon to encounter dripping water from pipes and joists where there is no air flow. The optimum temperature for mold growth is between 68 and 86 degrees but can easily grow above and under these temperatures. The key to controlling mold growth is to control water and moisture. In this case it would not matter if the crawl space was sanitized and re-treated if the moisture beneath the house is not controlled the mold would simply re-grow.It is important to mention that when [redacted] contacted me I was out of state on vacation with my family. I told him that I would set up a time to come out and check the crawl space the first of the next week. Before I could return I had received several harsh, ugly and degrading voice mails and emails. In some of them he called me ugly names such as a thief, liar, crook and swindler. This kind of aggressive language simply discouraged me from calling him. If he was this aggressive in his emails and letters who knows what kind of confrontation might have occurred had I gone to his house and disagreed with him. Further,I have attached a copy of the agreement for you to review. I still do not understand why he waited nearly 10 months to contact us. Please feel free to call me at ###-###-####, we welcome the opportunity to discuss the situation.Sincerely,Hugh J.Operations Manager
