Dear Mr.:

Our firm represents Mr. Clayton *** with respect to the referenced hail damage repair project. We are in receipt of your letters of January 31, 2019 and February 4, 2019.

Quite simply, you are currently in possession of funds, paid to you by Mr., that you have not earned and have not returned to him. If we are unable to resolve this matter, we intend to file suit to recover the damages that Mr. is entitled to under Colorado Law.

Mr. contracted with Red Oak Exteriors on or about August 14, 2018 to perform hail repair work at a residential property he owns at ***. Prior to January 31, 2019, Mr. became dissatisfied with the work being performed at ***. He informed Red Oak Exteriors that he no longer wished to continue the business relationship after the active work projects were completed.

In a letter dated January 31, 2019, you informed Mr. that Red Oak Exteriors was voiding the contract signed on August 14, 2018 and would not be performing work at ***. In that letter, you acknowledged that Red Oak Exteriors had been paid the sum of $37,497.59 and had performed work totaling $21,947.45, leaving $15,550.14 that Red Oak Exteriors had not earned and proposed to return to Mr. as part of an attempted settlement agreement.


On February 4, 2019, you sent a second letter again terminating the contract and purporting to withdraw the January 31 offer to settle. This letter contains additional charges that we take issue with and also note that one of them violates Colorado Law. First, you claim a total of $14,323.75 for "Siding", "Siding Wraps", and the "Stucco Permit". However, according to an invoice from Peak Stone dated February 5, 2019, Red Oak Exteriors has only paid $9800 out of a total $23,370.80 which also includes a permit at the cost of $387.80. Additionally, your letter claims $500 for Mr. insurance deductible. This amount has already been retained by Mr. insurance company and it is also a violation of *** and *** for Red Oak Exteriors to pay or promise to pay an insurance deductible.

For the above reasons, we assert that Red Oak Exteriors currently has $15,550.14 of Mr. insurance proceeds that are unearned and we demand the immediate return of the $15,550.14 to Mr.. If payment is not received by March 4, 2019, our firm will file suit to obtain the damages that Mr. is entitled to under Colorado Law, which we estimate to exceed the $15,550.14.

Mr. Jeff *** is presenting half truths
1. I did express I no longer wanted to work with ROE after the stucco had been completed. I stayed I would send an official letter with my terms. Note: that letter was never sent due to the recorded phone conversation with Jeff the same evening the text notification was sent.

2. ROE contracts signed do not entitle ROE to any penalty fee's. They where all made up after the fact. All completed work and in progress work was paid to Jeff.

3 Jeff chose to NOT pay third party contractor *** the $ 22k Jeff hired them to complete stucco installation. The contractor only received roughly 45% of the *** invoices. Jeff kept the additional funds, claiming GC contractor, termination and $500 deductible fee's that were completely NONE contractual.

Note: Mr *** paid his deductible directly to USAA prior to fund distortion that was paid directly to the home owner.
Jeff commuted fruad by take the 500$ deductible fee in addition to the other made up fees.

Had Jeff paid the *** invoice in full, he would have received his GC fee roughly $6k once inspections was complete. Jeff abandon the project, kept the *** funds/money forcing me the home owner to pay the balance owed to *** roughly $12k again. This is why I'm seeking damages.

Red Oaks contracts don't support keeping customer funds and not paying 3rd party vender for complete services when customer terminates for whatever reason.

I challenge Jeff to supply a sign document stating fees are valid.

I can prove I always paid in advance for service.

At this point I believe I will have to litigate the issue. I am prepared to supply all payment proof, recorded calls, text, emails and all ROE contact documents that support my claim.

At the end of the day I have a an improperly installed roof that is damaged and un warranty by Jeff and ROE plus unpaid stucco funds refund owed to me.

Jeff and his crew did an excellent job with our window replacement and upgrade. No surprises and a positive experience. I highly recommend Red Oak Exteriors.

It went excellent!!! Before I hired Red Oak for my Solar I researched Solar for over 8 months and interviewed several installers before deciding on Red Oak. I was reluctant at first because of the limited number of installs this company did but this was definitely the best decision I made. Not only I got a competitive price I also received the best service that anyone could ask for. Every time I had a question I called or texted and I received a response within a few minutes. Install was smooth and quick and they completely cleaned up after the install was done. We also had friends that have Solar installed about a month before us (different company} and they are still waiting for *** to install the meter. Plus, my system is awesome - Black Solar panels with Micro inverters where I can monitor each and every panel independently. And my Solar panels are American made!!! It is definitely nice to produce my own energy. Thank You Red Oak!

Jeff was great to work with on getting my house painted. We had only a few days to get our house painted before closing on the sale of our home. The painting was completed on time and a high quality job. Jeff was VERY competitive on price and overall a pleasure to work with. I'd recommend Red Oak Exteriors for and future exterior job!

Jeff and his company did an awesome job repairing our siding. Jeff was quick to respond to our inquiry and flexible in accommodating our schedules. The repair was done efficiently and of excellent standard. Our siding repair looks great! Thank you Jeff, we appreciate your assistance!

Jeff is the best contractor I have ever worked with. He adeptly explained the benefits and shortcomings of vinyl siding, Hardie-Board, and LP siding. He spoke in plain English and answered questions until we understood our choices thoroughly. We ultimately decided on LP's SmartSide, RigidStack, Precision Series Lap Siding with Diamond Kote Pre-finishing. He worked with our insurance carrier USAA and it was a seamless experience.

I would hire him again in an instant and I will hire him without hesitation for the HOA Board of Directors [that I also sit on]. He has no tolerance for sloppy work nor ineffective shortcuts.

I have personally hung more than my share of siding in the course of my life so I know what to look for when things aren't done correctly. So does he. What a relief it was to know that I didn't have to 'eagle-eye' for things to be done correctly.

Jeff is like the Boy Scout of contractors that we wish we all could find. He is honest, trustworthy, and brave. He was an awe
