I hired Mark Orman Construction to re-roof my home in December of 2017 due to damages(leaks) from the hurricane, and the work started on the 15th of the said month. The work was very poorly done and supposedly finished around 12/20/17 but failed the first inspection on 12/26/2017. On 12/28/17 it rained and water started leaking in the same places that were supposed to be a part of the repair. I called Jeff, the operator of the crew and reported this to him. He did not come over immediately. January 2/18, the inspector came and the work on my roof failed inspection again. On 1/3/18 it rained and leaked into my house and I called the contractor and informed him. To summarize these notes...on 1/29/2018, and 2/4/2018 it has rained into my house. The contractor has sent his people here four times to make this repair with no results. I paid 12,000 dollars for the job and he doesn`t want to refund me 2,000 dollars that I've asked for and finish the repairs.
As of now I am seeking 4,000 dollars, and asking that he completes the work correctly.

Desired Outcome

Refund As of now, I would ask that Mark Orman Construction refund me 4,000 dollars of my payment and make the necessary repairs to my roof correctly as they should have been done at the beginning of this project. There is a chance that mold and mildew will soon form in the places that are leaking which could become a health hazard to my family and me.

Mr..'s letter has many inaccuracies, as I will explain below. Despite my attempt to be cordial and even having my wife email him, we were still not given permission to get back out to his house to complete the repairs until he received the money he was demanding. I have many emails with both of us going back and forth with him, but I don't feel it's useful to include them at this time.

Mr..'s emails had been hostile and threatening, even with cursing, because he felt he wanted money back before my crew could come back out. But there's nothing in the contract about him getting a refund. He even accused us of not caring if it rained in his house. He also accused me of never being on the roof, which just isn't true. He stated in one email that we had 45 days to complete any repairs (which isn't in the contract). He threatened to contact lawyers, TV stations, etc.

Finally just today (3/25/18) I received an email from him stating that he had received council and is allowing my worker to come out the complete the repairs, and he is finally not demanding a refund.

Here are the facts:

1) I had been trying to get back out to repair his roof, but he wasn't allowing me send anyone out till he got $2100, then $2000, and then it was $4000. This has been going on for well over 2 months.
2) Nothing is stated in the contract about a refund if the repairs take longer than expected.
3) My crew was out twice to work on the repair, not several times. In fact, the first time Mr J. called, it was raining, and my worker went out within 1 hour.
4) There is nothing stated about a 45 day time limit on repairs.
5) Leaks can be very complicated and they can be coming from a different place than what it appears to be.
6) The Mr.. was not always outside when we worked on the roof, as he went in and out of his house. And I will certify that I was indeed on the roof because I remember that I used Joe's ladder, but Mr.. was inside at the time.
7) The roof failed the first inspection because the weather was cold and some of the adhesive on the shingles wasn't adhering.
8) The 2nd final inspection passed (see enclosed photo). One only has to go to the Orange County Property Appraiser's website, put in the address and see the inspection results.
9) I have wanted to resolve this since it's inception, but Mr.. refused to let my crew come out unless he received a partial refund, until his last email which I received today (3/25/18).

(1)I told Mark that I didn`t want him to send anyone back to my home until I received council to know how to proceed with this situation. NOT until I received a refund. I am still asking for a 4,000 dollar refund because I feel that I was overcharged and the work performed on my roof was not done properly, leaving my home leaking.I have every right to be upset.12,000 dollars isn`t easy to go pull off a tree! (2) My emails have not been hostile or threatening to any degree of violence as he seems to portray them.I had every right to be upset after my roof was still leaking.It`s human nature to be upset about things such as this. What would he do if someone did this to him?(3)I felt it very necessary to send you the emails between us to provide the truth about this matter where as he says they`re not useful to include at this time.He`s really trying to hide the truth.(4) Enclosed in the envelope that I am sending is an email showing that he received a document stating that the roof was to be completed in 45 days.(5)There`s nothing in the contract that says that I can`t ask for a refund.(6) Yes, I went online as well as talked to a professional and got information pertaining to this situation and emailed Mark to send his crew to complete the repairs correctly after the other failed attempts.(7)Mark stated that leaks can be very complicated and come from a different place than what it appears.I would agree, but had Mark come to me and spoke with me concerning these matters as I invited him to after first contact,12/27/2017, I`m quite sure that this situation would never have gotten to this extent.He never attempted to discuss anything about this situation in person, and also didn`t speak in the texts or emails concerning the work. Hmmmm?There was one text where I questioned him as to why he never came to my house after all the complaints that I`ve made, and his response was something to the effect of,"what good is it going to do me to come out there, I don`t fix roofs". (8)I know that Mark has never been on my roof because I have been at home the exact 4 times that he`s been at my home and spent every moment of each time either inside my home and outside. I feel that Mark may be relying on one of his workers to lie for him and say that he was on the roof. He never was.(9)It`s a good thing that I did send you copies of the failed inspections because I see that Mark is attempting to deceive you by saying that the weather was the cause of the failed inspection. The paperwork that I sent you speaks for itself. Also unless Mark is referring to the third inspection as the"second final inspection", there were three inspections as you have as proof.(10)Mrs. Orman emailed me on2/16/2018, and her words were", you paid for a re-roof and that`s what Mark`s crew did and it passed final inspection". Her statement says to me," you got your roof, we got our money, so what if your roof is leaking".(11)No one came to my home in an hour after my first complaint on 12/27/2017, the day after the first inspection failed, and I invited Mark to come over after New Years and let`s talk about it.You have all the emails from me showing that what I speak is true.The person came on 1/10/2018. The complaint that I called about on 2/04/2018 is when the two persons came over in the rain with a flashlight and went into my attic and I followed them to be sure that I saw the same as them to be the leaking area and pulled a muscle in my left side when I accidently stepped on a piece of the dry board and fell through.After they came down, they wanted to go up on the roof and I told them no, it`s raining and dark, there`s nothing you can do here tonight. I had to go to the hospital for hours behind that. I feel that Mark should pay the bill for that incident because had the job been done the first time or the times that they`ve come back to make the repairs I would not have had to be up there.(12)Per my transferring my home insurance Mark knew there was a 45 day period to have the roof done.He has told you that I said that it was to complete any repairs. Not true. I am sending you a copy if this in the mail.(13) I am still asking for a 4,000 dollar refund. My wife and I have suffered mentally from Mark`s attitude concerning this issue. Especially me.(14) I ask you and I ask myself, what kind of business man would take a client through these kind of changes? My personal opinion is a greedy, selfish, and don`t care about you person. The actions and attitude that Mark has projected during this matter have been mostly negative, and through what I have read of the lies that he has sent you, my opinion remains the same.

For the record, I'm not trying to hide the truth at all, and I'm not ashamed of my emails to Mr..! In fact, you'll see that my emails show how patient I've been. I just didn't want to waste these people's time on the Revdex.com site by including emails that just repeated the same things over and over again. Plus, I apologize if I missed any details, which would have been an oversight, as I am trying my best to be as forthright as possible in this matter. I am really tired of Mr.. accusing me of lying, not being fair, not caring if there was a leak, etc. This is only his perception, and it just isn't true!

My wife & I had to stop emailing Mr.. because like his last note here, he kept repeating the same things. We kept asking for the crew to be allowed back to finish the repair, but he refused because he wanted a partial refund before they he would allow them to come out. The attached email, one of many, states it clearly: he wanted a refund before he would allow my crew to go back out. Read this email, and notice his attitude and cursing. My crew was finally allowed to go back on 3/29/18 and this time he wasn't demanding a refund first. And as of 3/29/18, the issue is resolved, and yet he's still upset. This could have been resolved in January!

This will be my last reply to Mr.., as the issue was resolved, since my workers confirmed the problem (3/29/18). I will explain below.

On Thursday (3/29/18), two experienced roofers from my crew were finally allowed to go back over to Mr..'s house and they determined that the leak was indeed coming from the chimney, as we suspected the last time they were out! On 3/29/18 they even checked with water three different times, and this is definitely the issue. I've tried to explain to Mr.. that leaks can come from different areas than where it appears to be. And this leak was not from the re-roof! I even stated this in an email to Mr.. on Feb. 3rd, but he didn't believe me.

One of the last times my crew was out, Mr. decided to follow them up the ladder and into the attic. This is something I do not allow since my insurance doesn't cover a homeowner entering a construction area. Mr. fell through the ceiling drywall, which apparently he blames me for, as he stated: "I feel that Mark should pay the bill for that incident."

My responsibility was the re-roof only, and not the chimney. It's an old chimney and it probably hasn't had any work done on it since the house was built. There were pinholes at the flash protector and the stucco around the sides was porous. Apparently it wasn't strong enough to withstand the winds of the hurricane without getting damaged. My crew chiefs suggested that he get someone to repair or rebuild it.

Attached is a picture from 3/29/18 with one of my workers who has covered the entire chimney in order to protect the house from further leaks. The chimney was not included in the contract but we did this anyway, despite the angry emails we have received from Mr.. Meanwhile, I do care and I sincerely hope that Mr.. can get his chimney repaired before the rainy season starts.

My last report to you was filed before Mark sent his crew here on 3/29/2018, which is why he thinks I`m still upset. And yes I was still upset at that time as I have the right to be, because the situation still had not been resolved. I am first retracting my accusation that Mark was not on my roof as one of his workers informed me that he went up for a short time when I went into my home to retrieve something. Mark doesn`t realize that we`re both repeating ourselves because we both feel that we`re right in our standings about this situation. I agree with him that some things may have been overlooked in our haste to resolve this situation, but at the same time I insist that if this were happening to him and his family his reactions would be similar if not the same as mine. He seems to be stuck on a couple of curse words. On 3/29/2018, Mark sent two of his "clean up crew",(2 men), and three other men,(none of which re-roofed my home)and one of which was referred to as a "professional roofer", to my home to as the situation. After performing their water tests and cutting a hole in my ceiling to be sure where the leak was coming from, it turns out that the chimney is the problem. Since the situation could not be determined from the beginning and especially after other failed attempts, this was very frustrating to my wife and myself, and as I`ve said before, my reactions concerning this matter are very normal for any human being. Had Mark taken the initiative to have his "professional roofer" come at the beginning of my complaints all the conflict and controversy between us could have been totally avoided except for the fact that the crew that re-roofed my home did a horrible job of it, failing inspection twice. Due to the problem not being resolved earlier, one of my bookshelves sustained damage, and as of now I am still seeking a refund of 2,000 dollars because of this, and the poorly performed work on the roof failing inspection twice. I thank his crew for finding where the true problem lies, and now I know that I have to make repairs to the chimney. Also I see where Mark says that this is his last reply to me. First of all there`s a hole that`s been cut into the ceiling of my home that needs to be replaced, and the board that I fell through. Seems that he`s ready to walk out on important issues again.
