I had rented two spaces in the antique mall, and I gave my 30 day notice to vacate. I had removed all of my items from the smaller of the two spaces; however, I had another 11 days to run on my lease for the two spots. The owner of the mall, *** put (I believe they were her items) items in the smaller space. When I advised her that I had items I might want to put into that space until the end of my lease, she refused to remove her items. I advised her that she needed to refund my money for that space if she was going to use it. She refused and continued to refuse. She ignores my demands. The amount is small; however, the principle is large. She owes me approximately $40 for the 11 days that she used my space and prevented me from using it. Unfortunately, it is not financially feasible for me to sue her in small claims court. Again, it goes to the principle of the matter. She has a dishonest character in my opinion, and I want to advise other possible vendors or customers to be on their guard.

Dear Revdex.com,This dispute is not only incorrect it is totally false, I have several witnesses to confirm this if need be,Dear Revdex.comRed Rooster is a Antique Mall and we have several vendors, it is our policy as well as any other mall I know of, if that a vendor is moving out on a 30 day notice, Which *** was, they are entitled to keep their items in the space rented or move out anytime they like, however if you leave your space early it is the stores space to do what it will with it, *** decided to move all her stuff out of this space mentioned early, it was totally empty, I then put 2 chairs in that space to keep our store looking nice, she came in screaming that was her space and she paid rent through the month, I explained to her when she moves her items out it is no longer her space, this isn't a mini storage it is a working retail store that has to maintain a nice look constantly, I then even told her I would move the chairs and she could her stuff back in until the end of the month, she declined, even her second space she moved out of was aprox 100 sq ft, not mentioned here, she moved all her stuff out and left a single pair of boots right in the middle of the floor declaring she had stuff in the space, The most childish thing ever seen, This lady is a contentious, mean spirited lady that know what she is doing is not correct and not anyone's policy at any store but she is doing this out of spite, she abandoned her space and wanted me to leave it empty, our store policy is you rent the space but you must keep clean items in it for sale at all times, we do not rent empty floor space in a antique mall , and again, this lady knows this.She is not entitled to any money back or a negative review, Red Rooster did nothing wrong.Thank you

I am rejecting this response because: *** has an entirely different recollection of the event. At no time did I go into the store screaming, but I walked into the store and went to my booths to see what I needed to pack. When I saw that she had items in my small booth, I sent her a text while I was cleaning out my larger booth. After a number of text messages, she sent her husband to the store and he, in front of the customer service counter, raised his voice to me over who had the right to be in the space. I did not agree with him, and he raised his voice to a scream and left the store in a huff, saying people are just stupid. I simply said in my normal voice, "yes, I guess they are", and went back to my booth to continue packing. I am attaching the texts messages between *** and me on the day in question (December 22). There is a picture of my booth when I left with a text message saying I'm leaving my boots and that I would be back for them. You can see they are NOT in the middle of the floor, but rather against the back wall.

Additionally, if there is a store policy, at no time, during the time there I was a vendor (since 2014) and a worker (from approximately 2015 til December 2019) did I see or hear of such a policy. While I believe it may be common practice for the vendor to tell the owner, he/she is finished with the space when all items have been removed, and then the owner can do whatever he/she pleases with the space. However, at NO TIME, did I tell *** that I was finished with my small booth. I did however, tell her when I was finished with my larger booth, as you can see in the text messages. And, you can see by the text messages, that I professionally asked her to remove her items. My husband did not tell her husband not to move the items, but rather told him to just leave them while he went to get me since I was in the larger booth packing items. This whole mess is an embarrassment to the antique world. Please review the text messages. I just want the $40. I also have a lease agreement however there are no clauses in that state the owner has the right to move into my booth while I have rented it. Common courtesy would have been for the owner to ask the vendor if he/she was finished with the booth NOT JUST TAKE IT OVER.

Should she bring witnesses, I would like to know who they are because other than some customers who were in the store, the only others present were the workers for the store on that day, and my husband and my neighbor who was assisting us in the packing. However, other than the scene at the customer service desk created by her husband, I doubt that any one knew what was happening since it was via text message. Thank you for listening.
