Review: In 2012, I wrote a children's book with my sister, Joanne Brady, titled "The Unstoppable Eagles". My complaint is that the publisher we contracted with on our book, Red Tail Publishing, has knowingly misrepresented our book by intentionally choosing to use a photo of an event that I was unable to attend due to a family crisis. I am not pictured in that group photo that they chose to represent our book, even though I was the pri[redacted] author on this book?!? I also received the 2012 Gelett Burgess Gold Medal for Nature Education, I simply was unable to attend this event.I attended numerous other book signing events for the Publisher where they took photos of us that they could have used to promote our book on their website. I believe this was done intentionally by the publisher, [redacted], because she was upset that I was unable to attend that particular event. She even states near the photo, "[redacted], Not Attending", making it sound as if I chose not to attend instead of I was unable to attend due to a family crisis.http://redtail.com/books/the-unstoppable-eagles.htmlThe Publisher has other photos that include me that could easily have been used on their website to help promote our book, but have chosen not to do that, even after I requested that this situation be rectified several months ago.I feel that this is in violation of our Publishing Contract with Red Tail Publishing and would like this addressed immediately!I would like to share this link with friends and family to help promote our book, but I find it very insulting to share a link to purchase the book I wrote from Red Tail Publishing which intentionally omits my photo!Thank you for your prompt attention to this matter,[redacted]Desired Settlement: 1) I request a written apology from [redacted], the publisher at Red Tail Publishing, for her unprofessional behavior toward myself, as a contracted author.2) I request this situation be rectified immediately by Red Tail Publishing by replacing the current photo with a photo that includes both Authors, [redacted] and [redacted], and Illustrator, [redacted], Education Contributor, [redacted]. Or, adding a separate photo of [redacted] next to the current photo.

Red Tail Publishing is a Book Publisher located in Anderson, CA. We received complaint ID [redacted] on April 6, 2015. Ms. [redacted] is not a customer of Red Tail Publishing, rather Ms. [redacted] has engaged in a business relationship as a paid author. Ms. [redacted], together with [redacted] and [redacted] receive payment in the form of royalties from Red Tail Publishing for the rights to publish a story written by Terri [redacted] and illustrated by [redacted]. Red Tail Publishing has purchased intellectual property from Ms. [redacted]. Red Tail Publishing has the right, according to the contract, to use images of authors in promotions. The book, The Unstoppable Eagles (together with the educational back-matter by Red Tail Publishing) was an award-winning book in the Gelett Burgess Educational Category. The authors, illustrator, publisher, educational contributor, and editors were all recognized for their contributions. The award ceremony was set at a date and time specifically at Ms. [redacted]’s request. Ms. [redacted] did not attend. Her sister, [redacted], accepted Ms. [redacted]’s award on her behalf. A group photo of medal recipients (publisher representative, authors, illustrator, and educational contributor) was taken at the event. The editors only received certificates, the photo was only of medal recipients. Since Ms. [redacted] was not present, she was not in the photo. We have previously requested, verbally and in writing (Dec. 2013), for Ms. [redacted] to provide a photo of herself with her award medal and certificate to be included as an inset with the official award ceremony event photo. Ms. [redacted] has not done so. When Ms. [redacted] provides said photo, it will be included as an inset. Ms. [redacted] was not excluded from the ceremony, nor was she excluded from the photo. She did not attend the event and therefore is not in the event photo. All Red Tail Publishing titles, including the story purchased from Ms. [redacted], are available through Amazon, Barnes and Noble, as well as independent sellers through Ingram distribution channels. Ms. [redacted] is certainly free to refer persons to those websites or stores for the book titled by her. We certainly hope Ms. [redacted] will provide a photo of herself with the award, as previously requested, so it can be included along with the other award recipients who were present at the event. The use of an official event photo is in no way a misrepresentation of a book title.

She did not attend the event and therefore is not in the event photo."I was never asked to give Red Tail Publishing a photo of myself with the Gelett Burgess Medal so I do not know what Ms. [redacted] is referring to? I would like to see the correspondence that she is referring to from December of 2013? I never saw this correspondence and if I had seen it, I would've taken immediate action and sent the photo requested? I emailed her in February, which I sent you a copy of, and never received a response from her regarding this issue?The only correspondence I have ever received from Ms. [redacted] in the past several years has been our minimal royalty payments from the book we wrote that her company published in 2012.As I mentioned, I was unable to attend the event that Ms. [redacted] is referring to, due to a family crisis. Ms. [redacted] refuses to acknowledge this and it sounds as if she is continually accusing me of intentionally not intending the Gelett Burgess Award event? If she would like me to provide her with Medical Records for my son's 3 and 1/2 year illness, I would be happy to do that? My complaint is that Ms. [redacted] has chosen to promote a book, that I was the primary author of, by using a photo of an event that I was unable to attend due to a family crisis. My sister, [redacted], and the illustrator, [redacted], both concur that I was the driving force behind this book and that I should be included in any photo used to promote our book, The Unstoppable Eagles. We hired Red Tail Publishing in good faith to promote the book that we wrote, and I feel that by intentionally using a photo of an event that I was unable to attend to promote our book is not abiding by our contract. When I refer people to the Red Tail Publishing website to purchase the book that I co-authored, they only see the photo of the event that I was unable to attend? They ask me why I am not represented by my own publisher? Good question! If you check their website, they have photos of all of their other Authors included in the promotion of the books they authored? So, why would I as a contracted Author not be treated equally? Does that not raise suspicion on the way they are promoting me as an Author, and the book that I co-wrote? Red Tail Publishing was hired by us to promote our book and I find that difficult to believe that Ms. [redacted] is doing her best to promote a book that I co-wrote by excluding my photo and by including the comment, "Terri [redacted] "Not Attending" How does that represent me to all of the people who come to their website to purchase our book?Would Ms. [redacted] exclude a photo of herself on one of her own books that she authored? Would she do the same to any of the other Authors that contracted with Red Tail Publishing? The answer is No! Check their website and you will see that she always includes a photo of the Authors of the books that they promote!

However, I did receive a Gelett Burgess Award as one of the Authors on this book. So, I feel that this photo and description is misleading and misrepresents me as one of the Authors of the Unstoppable Eagles book.
