This letter is in response to complaint number [redacted] , regarding RedPeak/One City BlockApartments.Our position is Redpeak/One City Block is not responsible for the events leading up to the lossof complainant’s vehicleWhile we recognize the impact this had had on the complainant, thisincident is not the fault of management.One City Block accepts packages on behalf of residents, but waives liability for those packages.We consider this a service, and clearly outline in our community policies, which each newresident signs off on, that we are not liable for packages delivered to the community.When the management office receives a package, the resident is given notice as a courtesy sothey are aware, and as packages quickly accumulate and pile up, they must be removed assoon as notice is received.In this situation, we were not dealing with a package; rather a certified letterCertified letters arenot held by the office staffThey are placed directly into the resident’s mailbox by arepresentative of the US Postal Service, in this case, the mailmanOne City Block does notmonitor resident mailboxes - this responsibility falls on the resident.In this case, One City Block received a certified letter for the complainant, who was a resident atthe community, and the mailman put it directly in the complainant’s mailboxWhether or not thecertified letter was of an important matter is not something we should or could determine for theresident, as doing so would be an invasion of privacy.The complainants’ car was towed because it was parked in a future resident parking space forat least a weekThis parking is reserved for potential residents who are visiting the community,and it is limitedThere was no parking permit on the vehicle, nor was it registered withmanagement, so One City Block had no way of knowing who the vehicle belonged to.Management at the community did place notice on the vehicle that it would be towed, but thevehicle was not moved.Since management had no way of knowing who the vehicle belonged to, and since it wasparked in a future resident parking spot, the vehicle was towed.The complainant’s car was sold at auction because there was no response to the certified letter.Had the complainant had a friend check his mail during his time away, he would have receivedsuch noticeHad he registered his car with the office, it could have been identifiedRedPeakcannot check resident mailboxes or otherwise get involved with certified mail as tampering withanother’s mail is considered a federal offense.We hope this provides some understanding regarding our actions
