The contract with this customer is to build a home with interior stairwell on the home model that he had chosenIt took special engineering from the plant building the home to design this feature which they didThe contract required the customer to be 100% responsible for the basement, design of basement, engineering of the basement and all labor and materialsAlso he was to provide a suitable site with easy access to the siteDue to the weather and construction delays it was late spring of before he had the basement dug and pouredDuring this time he stated that he would not be able to pay cash for the home and would need to get a loan for the differenceWe assisted him with this and sent his credit application into the lenderHis loan was approved but he did not complete the loan conditions to get this loan closedOn June he Renewed his contract with Redwood Homes stating again that he would pay cash for the balance dueWe completed the necessary paperwork with this customer and ordered the homeHis home is being built according to the special requirements that this customer had.Sent on: 9/12/12:53:PM

Customer began loan process in late with lender he chose and it took several months for that approval process for the customer to meet all of the lenders conditionsThose conditions to close the loan are set by the lender and customer is required to meet all of them in order to close their loan The water leak was dealt with under the manufacturer's warranty and repaired All of the insulation under the floor was completely replaced by insulation company that specializes with insulation The house was inspected by the bank's inspector, all trim and finish was completed to their satisfaction [redacted] Heating & Cooling adjusted the air conditioning unitAll of the required equipment for the new air conditioner was there Customer received new exterior doors that were installed and finished On any construction site with newly excavated dirt and wet ground there will be a messWe were not contracted to do landscaping and there was no unusual yard damage The wooden louvered blind that was broken was turned into it's manufacturer and was to be replaced by them As to the missing security lights the home was built and approved under the HUD Code and had the required light fixtures On a recent request from the customer concerning water leaking we responded and inspected the roof area in question and discovered that his gutters were full of debris causing them to overflowWe advised him that he would need to keep all guttering and downspouts free of leaves and debris Regards, [redacted] ***

YesHowever I did not choose/ or decide that I wanted different housesI would have been more than happy with the one we originally applied forHowever if he did not except payments to complete the down payment then he should have said so instead reassuring me and my Fiancé that our name on it would hold it for usAs for the claim that we decided to get rid of the home that was already ready in exchange for aBigger home is LudacrisWe were told by him *** *** ***That he sold that house snd we would have to order another oneHowever when we were searching other mobile home places they told us that they put a hold on the orders for Mobile homes after a certain time so that they can sell off what's on their lotAnd j just out of curiosity why is neither house on their lot now.I did not do the things he says I haveBut I have already talked to a lawyer and it seems apparent that that's the only way I'll ever see my money again and that's the route I am forced to take.

This issue arose when the State of Indiana changed the process and paper work required in which we were able to title a homeWhat has been asked for on this deal and all others coming from Kentucky is that a Manufactured Home Dealer can no longer title it as an Indiana tile but would be
required to title it as a Kentucky Home and remit Kentucky Sales Tax on the Home which is what is required of Auto Dealers to do on an automobileHowever Indiana Sales tax is much less than Kentucky on a manufactured home which we objected to with the State of Indiana because we were not willing to ask our customer to have to pay a higher out of state sales taxOur customers should be able to title the Home in the State in which it is going and pay the lower sales tax for that state. The state of Kentucky has one of the highest sales taxes on a manufactured homeWe had tried several times to get this titled at the State level and continued to get the same response. It has been our contention that the Home should be titled in the state that it is going in and should not have to pay a neighboring states sales tax when it is much higher than IndianaYes the paper work changed in order to get this accomplished and we were finally successful in making our case to get it resolved at the Local level not the State level so that the title could be IssuedAs to the Factory Warranty work the Manufactuer of this home would not respond to any of the customers concerns with the home or supply any of the parts or materialsRedwood Homes supplied any and all labor and materials necessary and multiple trips to the customers home to take care of the warranty issues without any reimbursement or assistance from the manufactuer of the home Sincerely, *** *** Redwood Homes of Madison, LLC

During this time he stated that he would not be able to pay cash for the home and would need to get a loan for the difference. We assisted him with this and sent his credit application into the lender. His loan was approved but he did not complete the loan conditions to get this loan closed. On June 25 2015 he Renewed his contract with Redwood Homes stating again that he would pay cash for the balance due. We completed the necessary paperwork with this customer and ordered the home. [redacted]              Response:On April 13,2016 Ms Stallard made application for a loan on a home we had in stock. That loan request was approved. Ms Stallard did not meet all loan conditions until August 15,2016. At that time she stated that she was not happy with the exterior color of the home we had held for her. She asked to Special order one with the exterior color that she wanted. It was agreed with her to sell the original home to someone else. The Special Order was placed with the Manufacturer and was built for her. On November 5, 2016 Ms Stallard came in requesting to purchase a bigger home as she had changed jobs. That loan was denied by the lender. When Ms Stallard asked for her money back we explained that we had the Special Ordered Home and when it sold she would be refunded her money.
