complaintShe made a similar complaint to her credit card companywhich was resolved in my favorI currently do not have the sum in dispute, which is slightly less that $because Square, Inc., charged me a processing feeMs*** retained me on June 16, 2016, to do postjudgment collections on a judgment against her ex-husband for attorney's feesA copy of the engagement agreement is attachedlc is a lawyerWe discussed garnishing his bank account at Frost National Bank in San Antonio(I do not believe we got to the point of executing on any propertybecause Ms*** was unable to describe any non-exempt property which may be subject to execution.) To that end she executed an Affidavit for Writ of Garnishment after Judgment, a copy of which is also enclosedShe claimed he had money there because an affiliated company did its banking thereI doubted that he had a large sum there because of the extent of his attorney's fees in the underlying family law litigationWe also discussed doing a post-judgment deposition, and I recommended that I call his current counselMs*** *** of I ligdon, Hardy and Zuflacht, Incof San AntonioA postjudgment deposition notice is a contact with her client and I felt I had an ethical duty to call her before serving the notice on Ms***'s ex-husbandMs*** vetoed thatWe also discussed a turnover order to obtain his stock in a company, but I thought there may be problems with getting the stock because it may have transfer restrictionsI am unable to address the anonymous source regarding my reputationI would point out that her family lawyer referred her to meFurtherI have consulted my ethics attorney and he has advise me not to return the entire amount to her as I earned what little she paid meShe became dissatisfied with the progress of her case and terminated my employment in mid-July of this yearAs required, I sent her a statement for my time and a trust account refund check for unearned attorney's fees, $a copy of which is also enclosedShe was not satisfied with that result and filed a complaint with her credit card companywhich required SquareIncto withdraw the disputed $from my business operating accountWhen that happened, I had around $at risk, so I stopped payment on the refund check pending resolution of this disputeMs*** apparently tried to cash the $check and learned that had stopped payment in itSquare, Incinforms me that it must hold the funds until October 4, 2016, when Ms***'s appeal rights expireI would also point out that I had numerous telephone calls for which I did not charge Ms***If you have any questions concerning this legal matter, please call me at *** ***

Mr*** is untruthful as to why he was fired
He was paid to collect a judgment I received but was prevented legally from doing so while my ex-husband was appealing the judgmentMr*** knew that as I told him during our first visit and subsequently per the Court Docket (ExA)The deposition, the writ of execution, turnover order, etcwere all inappropriate and if successful, could have put me in legal trouble if my ex-husband would happen to win
Mr*** also padded his invoice to meThe same day he was fired he charged me for a Writ of Garnishment that was never completed (ExG), he charged me for a deposition that was emailed to me on June 16, (ExB) during my free consultation and as I show was never filled out with ANY pertinent information
My credit card company did NOT find in his favor, only that he respondedPlease see ExK where in the 2nd sentence states ""the dispute below was approved for further review by your customer's bank as of 08/04/16"Mr*** misled me to believe I had until Oct 4th to respond, but that was for his CC provider, Square
Mr*** represents that I tried to cash the check AND get the $1,retainer back but as ExI shows, I did not try to cash the check until 8/26/16, more than month after I fired Mr***It is to be noted that Mr*** Never attempted to call me to resolve this dispute and hung up on me several times when I tried to resolve this amicably
ExJ shows Mr*** telling my credit card company that he owes me no money when in fact I am the one who has lost money in our transaction ($1,retainer AND $check)
In sum, Mr*** was terminated for misrepresenting WHAT he could do (again he was legally barred from collecting during an appeal), he did absolutely NOTHING in the one month he was hired, and the phone calls he didn't charge me for all account for my attempt to resolve this disputeIt is illegal to charge for services you cannot performIt is illegal to pad your bill with services you did not perform, and nothing short of a full refund would be equitable
