Regarding the concrete patio our company replaced in November 201 5, I did stop by to look at your patio cracking concerns after receiving your letter. I observed two hairline cracks in the patio. Unfortunately even after compacting the rock underneath, adding rebar dowels and putting in control joints to help mitigate cracking, concrete cracking is not completely controllable, and yours has cracked. Cracking in broomed concrete is more noticeable than when the concrete finish is exposed, but your concrete is sound and not in need of replacement.Our warranty, as noted in the warranty section of the attached contract, is as follows:Reese Concrete Construction LLC provides a one year warranty from the date of this contract. If a warranty issue should arise, the HOMEOWNER must notify the contractor of the claim in writing, sent by certified mail, within the warranty period. Any subsequent claim is expressly limited to claims(s) made in writing and sent to the contractor during the warranty period,otherwise it is WAIVED. Any action arising from the contractor's performance of this agreement including the warranty must be referred to mediation or arbitration within four (4) months of the expiration of the warranty period. This warranty is nontransferable. Any warranty work performed does not extend the length of the warranty Any work done or re-done by any person or company other than the contractor, within the scope of this contract, will void this warranty and the contractor will be relieved of its obligations under the warranty. Warranty does not include repair of cracking less than 114" wide, as cracking in concrete should be expected. If homeowner provides installation of sub grade materials, Reese Concrete Construction does not warranty any cracking or separation in concrete.Our one year warranty covers cracking over 1/4" wide. This allowance is standard to be considered potentially defective. If your hairline crack exceeds 1/4" during the warranty period please contact us and we will re-evaluate our course of action. Unprepared they started the pour lateThey left my yarda disaster, concrete pills and chucksMy landscaping ruinedThey left my doors openAfter the job wasDone they did not say thank you or good bye they just leftAnd they left with my personal tools and Ihave not seen them since."Primary issue based on what discussions we have had since completing project on Decat ***'s property:We received a phone call Sunday 12/17/at 9:PM from *** *** regarding possible stolentools from his propertyHe initially left a voicemail but upon a second call at 9:pm Wade R***answered the phone when listening to the voicemailWe heard what had happened and recommendedhe call the police to file a police report and have them investigate the mannerWe told him we wouldhelp in any way possibleWe spoke on the phone for approxminutes.Please see multiple correspondence via email which has been the only method of communication fromthat point forward.We have had correspondence with him regarding this matter and have helped in all ways possible.However, we do not believe any of our employees stole property from himWe refer this to the policefor their investigation.Issues the customer states that we do not believe are issues based on correspondence:"They left my yard a disaster, concrete pills and chucksMy landscaping ruinedThey left my doorsopen."On 12/18/at 6:am *** emailed ** *** stating he had spoken with the policeand asked for additional information from us to provide to policeAt the end of the email he states "onanother note, I think that you guys did very good work." He also noted in our phone call the night beforethat he was pleased with our workHe did not start believing until later that we did an unprofessionaljob.At no point in our correspondence did he ever mention destruction of his landscapingHe did mentionthat we left a chunk of concrete, a blue bucket of wet concrete and doors open however he was at theproperty when our employee leftHe has never asked us to remove the concrete chunk and said the dayof the pour the excess was fine and he would rake the rock from concrete slurry out."After weeks and weeks of reschedule and being unrepliable They finally showed upUnprepared theystarted the pour Late."Wade R*** met with *** on 11/30/as he was looking to have us give him a bid for an interiorconcrete slabHe mentioned he had another contractor that had not shown up to perform the work andreally needed to have the work performed immediately as he needed to get his project completed as hewas expecting a baby and was going to have surgery doneWe agreed upon a price, that we wouldcomplete the work in the next two weeks depending on weather, and to contact us the followingMonday to let us know he was ready for us to perform the workThe next week *** calledIt was niceweather and this is an indoor project so we said it would have to be the following week and to give us acall backThe next week we discussed completing the work on Friday 12/15/I let him know wewould be there between and 7:to start setting up and concrete would be scheduled for 8:00.On the day of the pour Wade R*** and employees arrived at the time discussed beforehandAt 7:35after not seeing that the pump truck which was subcontracted out, Wade called the pump company.They said their driver was on their wayWade mentioned this to ***At 7:the pump had still notarrived so Wade called them again and while on the phone the concrete truck arrived earlyAftergetting off the phone the concrete pump arrived at 7:55.There was a minor delay with the pump as it kept plugging up, this was solved in minutesAfterwardsthere were no problems and we poured out and finished concrete."After the job was Done they did not say thank you or good bye they just left."Prior to receiving payment and after completing the concrete pour *** mentioned to Wade that hewanted to have him do more work in the future and they went over a patio and driveway addition.Upon receiving payment from ***, Wade R*** said thank you and informed him that he needed to goto another jobsite and of the employees left at that time*** was informed that another employeewould stay to finish the concrete and would be leaving between 1:and pm that dayWhen theemployee was finishing he moved his truck to a closer location (where the pump truck and concretetruck were at during the pour) and loaded his tools upHe did not notice *** anywhere around andneeded to go to a doctor's appointment for his newborn son, so he left after being finished.Conclusion:The primary issue stems from the homeowner believing we stole tools from his propertyHe says henoticed this days after we had completed the work however he would have had to close up his shop, ifhe did, after we left the propertyAs you will see in our email correspondence there were no otherissues as he now mentions and we have tried to help him in anyway possible to resolve his issueWe donot see any reason to refund him the cost of the job and we do not have any of his tools.Sincerely,Wade R*** **Attachment redacted by Revdex.com Staff**
