I am writing to ask that you assist me with a dispute with my previous landlord. I rented an apartment with the Reflections of West Creek, (a [redacted]) from April 2011 to July 2013. During this time I had a small dog (service animal) which lived with me. Prior to that time I rented an apartment with this same company with my husband and a different small dog (service animal) from July 2008 until April 2011. Therefore I have had a five year rental history with this company and have paid my rent and water bill on time.

I moved out of the [redacted] on July 28, 2013(at the end of the lease) and initially received a Move-out Statement which indicated that I owed $[redacted] (which includes $** damage to the microwave) and the balance for pet urine damage to the carpet. Shortly thereafter I received another statement which indicated that I now owe $[redacted] which includes an additional $[redacted] for padding for the carpet.

I was told that the amount of $[redacted] was due by the end of today (08/28/13)or the file would be turned over to a collection agency. I have exchanged several emails with the property manager and indicated that I disputed this statement amount because the urine damage did not affect the entire carpet in that apartment and I should not be responsible for replacing the carpet in the entire apartment, given the age of the apartment and carpet. I also indicated that I want to resolve this issue as soon as possible and am working with my insurance company (renter’s insurance) to assist with the damage.

I indicated that I did not have $[redacted] to spare as a result of recent moving expenses and proposed to pay half of the amount of the damage with a payment arrangement made. I was told this arrangement was not possible and the file would be turned over to a collection agency by [redacted] today.

Again I am asking for your assistance in this matter, given the age of the apartment and that this apartment had several tenants before me as well as my being a loyal tenant for five years.

I am currently working with my insurance company to see if they can assist in this matter as I was covered throughout the leasing period. While I understand that you are charging actual costs of the carpet replacement, I do not believe I should be responsible for the entire amount, given the age of the apartment and the carpet. Therefore I am respectfully asking for a reasonable accommodation in this matter and propose the following:

1.That I be responsible for half ($[redacted]) of the amount of the estimated carpet damage $[redacted].

2.Set up monthly payment arrangements until the $[redacted] is paid in full.

Again as a loyal tenant over the years I have always had the highest regards for your company and want to resolve this matter as soon as possible.

I am proposing that I pay $[redacted] (half of the total amount of damages) in a payment arrangement and that my credit reporting is not affected during this dispute and no credit reporting should occur during this dispute time.

Response:

Revdex.com spoke with the corporate office regarding this case. After residence move out of their apartment the complex may do a routine carpet test to be certain the carpet is free of anything that may cause health or safety issues for future residence living in the apartment. The company received the results from the test and confirmed the carpet was saturated with urine. The complex had to remove the old carpet and install new carpet. At this time, the complex is unable to reduce the fees for the consumeR and the consumer is respondisble for paying the fees in full.
