In Re: Complaint # [redacted] I apologize for not responding to your first email, my business email for the past ¼ years is [redacted] On January ***, David RMaltz & Co., Incacted as intermediary to effect the sale of a consignment vehicle to [redacted] ** [redacted] Our protocol is to take possession of the title upon consignment and this protocol was followedUnbeknownst to us, the owner had applied for a duplicate title but had given us the first title issued (which is null and void once a duplicate title is issued) When [redacted] informed us that Motor Vehicle rejected his paperwork, we tried to reach the previous owner but were unsuccessful because he was out of the country and did not return until February **, Upon his return, he could not find the title in question and had to request a second duplicate title from NY Motor Vehicles During this time, our office did call [redacted] several times to keep him informed as to the steps we were taking On February **, 2017, we called [redacted] to tell him we had the new title He has come to our office to pickup and sign the new title

This saddens me as how the New York State Taxation and Finance will do this to desperate buyer as me And I say desperate buyer because when you go to an Auction to purchase a vehicle you are in the last stages of getting a decent car for a good price
If I had the means, I would have gone to a Car Dealer with a good reputation So shame on you the Auction house and shame on your vendor It's all about you taking my hard working money And please don't be insulting to the fact that you run your vehicles because that's not what I saw when I was there You should request for more information on these vehicles that you auction and take some responsibility, instead of thinking of the fees you charge and standing by your "As Is" term I am a good damn taxer payer Keep my money!!! I have learned a very good lesson on this!!!

We regret that [redacted] had a disappointing experience with the car he purchased at auction. -We do not own the cars we sell, are not dealers and do not have a history for each car we sell. As such, we can only sell “as-is” and cannot offer warranties, this is why we clearly announce that all...

vehicles are sold in as-is condition and provide ample time to inspect the vehicles before buying. -Please know, prior to the start of each auction, we announce these terms and each buyer also signs the terms and conditions of sale. (Please advise how we may send you a copy of this document) -At times we do label a windshield if we are aware of a safety concern, such as very bad brakes. Again, this is only if we are aware and as a courtesy. -Potential buyers may inspect the cars for 1.5 hours prior to each sale. The vehicles are then driven through our building and they remain running until they reach the auction podium where they are auctioned off, they are then parked in the lot. -The car [redacted] purchased was sold on behalf of New York State Department of Taxation and Finance (“NYS”). NYS sells everything as-is and does not offer returns or refunds. -The automobile is more than ten years old- with 145,000 miles on it- and it was seized for non-payment of financial obligations. -Again, we do regret this situation but this vehicle was purchased at an as-is auction.
