Complaint: [redacted] I am rejecting this response because: Without question [redacted] seems willing to explain away any complaint lodged against him or his companyIn his response, he assumed that the additional lumber billed for the house was used for additional roof rafters and knee wallsThat assumption is an excuse to explain away the over billingI physically counted each board used in the framing of my home with photographs and construction plans to verify my board countI informed [redacted] of this during an onsite visit 2/16/I also challenged him to make his own board countHe said he offended by my allegations, so I asked him to show me the lumber and prove his integrity He did not accept my offer and has been unwilling or unable to accept responsibility for his actionsAs an additional example, in a letter dated 12/16/he indicated that he wanted a third party to inspect the basement floor for evaluation of the defectI responded in a letter dated 1/4/17, that I would welcome a third party evaluation and would point out areas of concernNo one chosen by Rehkemper has contacted me to evaluate the floor In fact, I've not received any communications for Rehkemper Construction since our February 16, meeting Other claims he has made in his response are simply wrongHe claims that materials purchased were made at his price and not retailI have receipts from suppliers where I made direct purchases and the pricing is identical to Rehkemper's billing minus the 10% mark upAs with my examples, I have evidence to support my complaintIt is apparent that [redacted] is unwilling to resolve any of the issues I haveI've been trying to resolve these issues since their final billing in October of After reading his response, [redacted] has absolutely no credibility with me and I believe that he will not honor any agreement that he makesTherefore, in a good faith effort to resolve my complaint; I'm prepared to submit all of my evidence and supporting documentation to a third party for the purpose of a binding settlementSincerely, [redacted]

*** *** *** *** *** *** *** ***, I looked the drawings over and found at least two itemsThe back porch that connects to the garage is hipped and it needs to be a regular half gable extended to a full gable where the buildings connectThe connection will be to a standard 16' gable truss with overhangsThe second item is, the floor trusses around the entry and stairwell on the first and second floorThere is no support wall to hang the trusses onThese need to be a free span of 14'. Also, I may be able to close the opening width between the kitchen and dinning roomAll the trusses at this point are on hangers and I'm wondering if it will be acceptable to support these with a wallI'll try and call you tomorrow, some***e after when I get home. Thanks***On 3/21/12:PM, Rehkemper Construction wrote:***,This is what they sent over, please review and let me know if it looks right to you. Thanks,***

***I reviewed the truss drawings this morning and the only concern I have is the extended roof line and overhang on the back porchThe South side of the hip is at 3:12 and the East side is 2.92:12. My questions are how will this custom slope and extended length impact the front and rear overhangs on the breezeway trusses. The kitchen window on the north side is located in relationship to the breezeway overhang and kitchen/bath wall. When designing the house, I dimensioned it to use as many standardized components as possible to simplify the build and reduce the costWith that in mind, how will these specialty trusses impact the costOther than these issues everything looks good to meWe can discuss this Tomorrow when your here. Thanks***

[redacted]I noticed this last night when I was finalizing my plan for what goes in the trusses. One of the carpenter's installed a sill board with only one anchor bolt and toe nailed it into the next board.  I would have never noticed if it hadn't warped 3/8".  I'm enclosing a picture. Also, there is lumber here, under your trailer, to make the repair. Thanks[redacted]
[redacted]
[redacted],Here are pictures of some of the problems I found with the floor framing. One is a picture of two mis-placed trusses, another shows the offset area on the front porch and the way they boxed framed it without the additional 12X, another has an additional stud inserted into the basement wall ??? and the final one is a picture of open ends on the box joists. Not all the box joist are open ended just 3 or 4 I'd like them to insert additional 2X6's to properly strengthen the corners. Thanks[redacted]
[redacted]
[redacted]I wanted to touch base and coordinate the completion of our project. Thursday the building inspector did the rough framing inspection and ok'd it. Friday, I mailed you a check for $26,998 to cover all billed materials, trusses, rentals, additional labor for the roof felt and an additional $10,000 payment on the house shell. This should leave around 17K on the balance of our contract. I looked over the whole job site yesterday and here's what I have remaining to do, however; the carpenters my have some items they're in the middle of that I might have missed.1) 1 1/2" feather strip between the first and second floors.  It includes the entire North wall and the Southeast corner of the back porch.2) The Stairwell needs to be feathered out between the basement and the first floor.  This was part of that misaligned basement beam. Everything else fitted together pretty good, however; this slipped through.3) Finish wrapping the house with Tyvek and water n ice. They run out of Tyvek Thursday so I picked up another roll.4) The basement window on the South wall. We need a new window for final installation. Adam roughed the used one like we talked about.5) Install all the hurricane straps on the roof trusses. I have all the straps and nails here.6) Replace a broken stud in the living room wall adjacent to the stairwell. The inspector didn't see it, however; the bottom is broken through from nails splitting the stud.7) Form and pour the porches, Two sets of steps and concrete pad.8) Wedge blocks for the second story pony wall. I asked the guys to place these on some of the walls.9) Window and Door header nailer's.10) Final grade and back fill. I completed more that half the final grade and tried to finish things with the skid loader but it just doesn't want to dig without the bucket teeth. If you'll bring out the other machine or the teeth for this bucket, I'll finish the back fill work and final grade. Also, If you can show me what you want dug out for the porch pad and I'll take care of it.11) Basement Floor sealer and clean up. Are you going to put a finish coat sealer on the basement floor? After our discussion in July, that was my understanding. When you where here the other day did you look at the mud and construction debris in the basement?12) The last item is the porch completion and extension to the existing house. I've installed all the porch columns and I'm ready for you to form, pour and finish the porches. The plan is to install all the first floor doors after the porches are completed. Additionally, I want to clarify the porch extension before the work is started. When we talked the other day, you said that it's not part of the bid work and I asked you to check your E-Mails for clarification. I will forward you copies of the e-mails so we're reviewing the same documents. To me the the final revised bid I received dated April 29 is after our discussions and e-mails. Look everything over so we can reach an agreement and finish our project. Thanks[redacted]

Complaint: [redacted]
I am rejecting this response because:
Without question [redacted] seems willing to explain away any complaint lodged against him or his company. In his response, he assumed that the additional lumber billed for the house was used for additional roof rafters...

and knee walls. That assumption is an excuse to explain away the over billing. I physically counted each board used in the framing of my home with photographs and construction plans to verify my board count. I informed [redacted] of this during an onsite visit 2/16/17. I also challenged him to make his own board count. He said he offended by my allegations, so I asked him to show me the lumber and prove his integrity.  He did not accept my offer and has been unwilling or unable to accept responsibility for his actions. As an additional example, in a letter dated 12/16/17 he indicated that he wanted a third party to inspect the basement floor for evaluation of the defect. I responded in a letter dated 1/4/17, that I would welcome a third party evaluation and would point out areas of concern. No one chosen by Rehkemper has contacted me to evaluate the floor.  In fact, I've not received any communications for Rehkemper Construction since our February 16, 2017 meeting.  Other claims he has made in his response are simply wrong. He claims that materials purchased were made at his price and not retail. I have receipts from suppliers where I made direct purchases and the pricing is identical to Rehkemper's billing minus the 10% mark up. As with my examples, I have evidence to support my complaint. It is apparent that [redacted] is unwilling to resolve any of the issues I have. I've been trying to resolve these issues since their final billing in October of 2016.  After reading his response,  [redacted] has absolutely no credibility with me and I believe that he will not honor any agreement that he makes. Therefore, in a good faith effort to resolve my complaint; I'm prepared to submit all of my evidence and supporting documentation to a third party for the purpose of a binding settlement. Sincerely,
[redacted]

Let me know if you have questions .I am meeting with my truss rep this week to hammer out the final knee wall height on the second floor and also fine tuning the floor trusses. I will then have them re-quote for me and I will pass it on to you to see how it compares to your original quote and whether I can save you something. I guess the next thing is the stake-off. 12/01/17 The mediator left a VM message for the CONS asking him to summarize the amount of money he is seeking.12/1/17 The mediator received a VM message from the CONS.  The CONS is seeking:1.  $5,282.00 for basement floor repairs.  (See proposal from [redacted].)2.  $5,500.00 for work left unfinished.3.) $   722.00 refund for materials billed but not used.4.) $2,899.00 refund for the 10% mark up on materials.5.)  $1,500.00 for work that the CONS did that the BUS was supposed to do.12/08/17 The mediator left a VM for CONS stating that I have relayed his demands to the BUS.12/08/17
(The mediator spoke to the CONS.) With regard to the basement floor
repairs, [redacted] did not send a third party to inspect the floor, but he did
come to my home in February of 2017.  [redacted] agreed to do certain repairs
that were to be done in the spring or early summer.  I summarized our
agreement in an email.  [redacted] did not follow through on his promise to do
this work, so I feel that I am entitled to $5,282.00, the amount of the
third-party estimate that I received. Regarding my demand for $5,500.00
for unfinished work, this is work that was in the contract that wasn't
done i.e. the breezeway, porch columns, etc.  I have an additional
demand for $1,500.00, which is for work that was not specifically
included in the contract, but I felt should have been done as a matter
of standard practice.  This is work that I had to finish.  With regard
to the $2,899.10 that I'm requesting, this is for the 10% mark up on
materials that I did not agree to pay.  My last request is for $722.00,
this is for material that I was billed for, even though the material was
not used on my job.12/21/17 The mediator left a VM message for the CONS letting the CONS know that I am having discussions with the BUS, but that the BUS has not yet reviewed all of the documents that the CONS sent to the Revdex.com on November 7, 2017.01/11/18 The mediator spoke to the CONS and let him know that I still have not heard back from the BUS.01/11/18 The mediator spoke to the CONS a second time to let him know that the BUS did not respond to my calls today.01/25/18 (The mediator spoke to the CONS).  I reject the BUS' offer of $795.15.  I will pursue the matter in small claims court unless I hear back from the Revdex.com about other possible ways to resolve this.

As per are discussion this morning, here's a recap of my understanding of the items we discussed.Basement floor leveling: You want to perform the repair with your own crew. It will consist of leveling the floor on the north and east side of the basement as needed. I requested information on the leveling material to be used and a plan for how the work will be completed. You indicated that there may be a selection of products available and would supply information on those products. We both agreed that this is a project that will have to wait for warm weather or when the house has climate control. Late spring early summer [redacted]e frame.Construction material and Quantities: We discussed billing for (83) 2x6x16 boards that I was unable to verify being used. I thought the quantity was excessive and you said you'd check your invoices to try explain the quantity billed. Additionally, the quantity of 2x4x16 boards seems to be excessive. I received billing for 76 boards and can not find them in the house. We also discussed some returned items that I inventoried and received partial credit.Material mark ups: I discussed the 10% mark up applied to the materials on the job. We talked about the roofing plywood quote from RP lumber and then the additional mark up. You asked me to include this point as a reminder.Work I performed that was part of the Contract: install porch post, backfill basement perimeter to semi final grade, job site cleanup, finish back porch (we're in disagreement over the Breezeway work). This consists of the balance of the porch on the North side of the Balcony. The Carpenter's stopped after setting the trusses. Basement window header fabricate and install. Additionally, I agreed to install all the pocket door frames. I initially asked for a credit for the work that I performed or agreed to do.Final Billing: As we discussed today, I made payments totaling $98920.62. I reconciled the contract work and material invoices I received and was unable to verify this total. I had $65821.95 performed under contract and $33098.67 for materials and rental. I'd like to have these totals verified and explained. I have a sizeable discrepancy and simply don't know what or if something is missing.I appreciate that you came out today and started a discussion to resolve some of the issues and concerns that I have.[redacted]

12/08/17 (The mediator spoke to [redacted] and relayed the CONS' demands, which include $5,282.00 for a basement floor repair, $5,500.00 for work left unfinished, $722.00 for materials billed but not used, $$2,899.00 for the 10% material mark up, and $1,500.00 for work that the CONS was forced to do that the BUS was paid for.) [redacted] stated that [redacted] will be out of the office for a few days, but that she would relay the message and have [redacted] call us. 12/14/17 The mediator spoke to [redacted].  [redacted] provided [redacted]'s cell number.  The mediator reached [redacted] on his cell phone and we arranged a conference call for Friday, December 15,  2017 at 2:00 PM.12/15/17 The mediator spoke to [redacted].  The only thing on the CONS' list of demands that I feel may be valid at this time is some minor repairs that may be needed on the basement floor.  In my opinion the puddling that I mentioned last February can be resolved by adding some concrete and feathering it away from the furnace area.  The 3rd party estimate that the CONS has submitted is bloated.  I had intended to address the basement issue last summer, but I got busy and didn't take care of it.  With regard to all of the other demands, I would like some time to look through all of the documentation that the CONS has provided.  Please call me next Thursday and I will be better prepared to respond to the rest of Mr. [redacted]'s concerns.12/21/17 The mediator spoke to [redacted].  I did not receive a phone call or email from the Revdex.com last week so I have not had an opportunity to review the latest documents that the consumer sent to the Revdex.com.  Please call me the first week in January and we will work through the issues then. 01/04/18 The mediator spoke to [redacted].  Please call again next Thursday.01/11/18 The mediator left two VMs for [redacted] on his cell phone and two messages on the office line.01/19/18 (The mediator spoke to [redacted].) I am thinking about making a settlement offer and will get back to the Revdex.com next week.01/25/18 The mediator left a message for [redacted] on his cell.  The mediator also left a message with [redacted] in [redacted]'s office.01/25/18 (The mediator spoke to [redacted].)  [redacted] asked me to call you.  We don't think we owe the CONS anything and we think we will prevail in small claims court if the CONS decides to pursue the dispute that way.  We are, however, willing to offer to pay 5% of the $15,000.00 that the CONS is seeking, or $795.15.

[redacted]
[redacted]
[redacted] First of all, this is me speaking not [redacted].  I don’t think [redacted] has had a chance to look at your email.   I’m really sorry that you are unhappy with Rehkemper Construction Co.   Obviously it doesn’t matter to you, but I’m going to vent anyway.  I know I’m probably speaking out of place and may get my [redacted] for it, but I will always defend [redacted] and Rehkemper Const. Co.  It is very frustrating to watch [redacted] go above and beyond for customers when it is only appreciated 50% of the time.    Your contracted work ran 20% over what [redacted] quoted.   If you doubt it, I can show you my time and material worksheet  on the home shell and foundation projects.   We are not trying to collect any of this overage from you.  Therefore, no matter what your “verbal agreement” about 1/3 was with [redacted], you did put me in a pinch by not receiving payment on labor since August.  If [redacted] agreed to those terms, I’m sure he felt the project was going to run much smoother than it did.  I processed many a weekly paychecks for work completed on your project since your partial August payment with no income from your job to offset the payout.  The contracted  job is complete, I don’t understand why you feel you can negotiate payment on it.   I’ve learned a lesson, I will see that terms on all contracts written, from this date forward, will have our normal  terms  of “pay requests as needed” written on them. Concerning some of the work you are wanting us to credit  from the contracted amount.   I don’t see where clean up or disposal was written as included on the contracts.  We also left a skid loader there for your use, waiving the normal rental fee we get for our equipment.  I thought we were trying to work with you but apparently you don’t see it this way.  [redacted]   [redacted]   [redacted]   [redacted]
