Review: I was asked by Reliable Clinical Experts to provide consultive work. We agreed on my fee. I reviewed the materials he sent me and spoke on the phone several times to discuss the case. I spent an hour working for him on 1/**/15 and another hour on 2/*/15. I submitted my charges on 2/*/15 by email. He acknowledged receiving it and told me he would pay it. A few weeks later I asked him for the payment as he had called about another case and he told me he would pay at the end of the month. He asked me to further review the initial case. I resubmitted my charges on 3/**/15. I was told the payment was forth coming. I spent three more hours on 3/**/15 and 3/**/15 reviewing the case further and providing further consultation. No payment ever arrived. I resubmitted my charges on 4/*/15 and 4/**/15. I called and texted several times but no further communication.Desired Settlement: I would like to be paid for my services which is a total of $1,250.

[redacted] complained to you that he was not paid for his work. This is true. He was not paid because he misrepresented himself to us. He wanted to work as an expert witness. An expert witness needs to be able to testify in court as to his opinions or his opinions are useless to us. During the course of his work with us, he sent us an email that his wife did not want him to testify in cases. He said he was therefore not goilng to testify. Because of this he was not paid. The reason I'm not being paid after spending several hours reviewing the patient's charts is because I didn't agree with Dr. Milton S[redacted] and therefore I did not agree to be a witness in court. My wife's opinion had nothing to do with it. Who would have spent several hours reviewing records to get paid only in the event that the opinion would suit the person needing the consultation. I don't believe any consultant would agree to those terms. I have contacted The [redacted] who hired Dr Milton S[redacted] and they informed me that they no longer do business with Dr S[redacted] and indicated it was because of issues like this. He is dishonest in his dealing with those he consults. They told me they pay Dr S[redacted] to get doctors to review the records and give an opinion about the merits of the case and be witness in court if the case has merits. [redacted] indicated to me that it is their policy to pay consultants for work done regardless of which way the opinion goes. To say that the consultant only gets paid if he agrees to be a witness would set up an unethical bias, but Dr Milton S[redacted] appears to operate just fine under these circumstances. All I know is that I agreed to review medical records for a fee. I did the work and gave my honest opinion. I was told repeatedly I would get paid, but no payment ever arrived. [redacted]

My response remains the same. The doctor refused to meet his responsibility as an expert witness.I will send you his email in which he stated that because of his wife he would not testify as an expert.However, I believe I need his consent to do so. The doctor also advertises with SEAK and other such organizations. With his consent, I will share this email with these organizations and get there opinion as well. Thank you,Dr. S[redacted]

I agree to be a witness if Dr Milton S[redacted] will pay the money he owes me for my work done. Also, per usual routine, he will agree to pay me for my expenses and travel to NY and for the trial work. However, he needs to know that my opinion stands and it is that there is no reason to sue the doctor he wants to sue. In other words, I would be testifying for, not against, the doctor he wants to sue. This isn't about being an expert. It's about me being paid for work I did in reviewing the material he sent me. And also me not agreeing with what he wanted me to say in court. As far as my wife, yes it is true she didn't want me to go to NY to testify but I would have if in my honest opinion there was a case. But there was not. This is all very transparent. I didn't agree with Dr Milton S[redacted] and he is refusing to pay me for my services because of it.I would have been a witness, but I wouldn't say what he wanted me to say. He didn't want me as a witness, as I would have supported the doctor he so badly wants to sue.
