The Company received your letter dated May 2, in regard to the above referenced file which was referred to my attention for review and responseMs*** is inquiring about the denial of
her claims for damages at the property insured at *** ***, San Antonio TX *** *** has two policies with Capitol County Mutual Fire Insurance CompanyPolicy number *** insures the contents at the property and Policy number *** insures the dwelling on the propertyThere were two claims filed by *** ***The first claim on Policy number *** (Contents) was filed for damages that occurred from wind and hail on May 23, The Company received the claim and acknowledged it by letter dated May 26, The Claims Department sent letters June 11, July 11, and July 27, requesting a Signed Proof of Loss, Inventory Worksheet, receipts and repair estimatesOn August 11, 2015, a letter was sent to *** *** advising that these items had not been received in order to process the claim and the claim was being closed for this missing informationThe second claim filed on Policy number *** (Dwelling) was for damages occurring on April 25, by wind and hailThe Company acknowledged the claim by letter dated May 1, The claim was assigned to an Independent Adjuster for inspectionOn May 13, 2015, photos and the inspection report were received and reviewed by the Claims DepartmentIn the claim review, it was noted that this was the fourth claim turned in for the roofThe Independent Adjuster's finding on all four claims was that there was no storm-created opening on the roof caused by a covered peril under the policySince there was no storm-created opening, the water damages to the interior ceiling are not coveredStress crack to the ceiling is not a covered perilThe Independent Adjuster also reported that the inspections revealed no storm related damages to the roof or the elevationsThe first claim for roof damages was for a loss that occurred on July 21, This claim reported that water was coming in through the light fixtureThe Independent Adjuster at that time reported that some wind damage above the area was observedAs a result, the Company paid $for repair of that roof areaOn the Independent Adjuster's latest inspection, it was noted that several types of asphalt and other roofing materials had been used on the roof and were improperly installed by the insured or someone hired to make the improper repairsThe Company sent a letter dated May 14, advising the insured that the claim was not payable under the provisions of the policyIf I can be of further assistance, please contact me at *** extension ***
