From: Lee J [redacted] < [redacted] @reliancefunding.com>Date: Fri, Sep 30, at 11:AMSubject: RE: My apologies for the late response but I have been out of town on and off the last weeks dealing with a family emergencyThis morning, I did have an opportunity to finally sit down and have discussions with key people in the organization who are informed on the details of the subject matter regarding [redacted] ***’s complaint (ID #: [redacted] ) The notes in our system show the following- On January 14th 2016, our sales representative spoke to [redacted] *** He advised us that his son, ***, was the customer and to call back- We did take him off of our mailing list on 2/29/and never mailed him again after that request was made- He was also taken off the calling list The last call made to him before being removed was on 3/2/at 3:04pm He did not answer that call This is a simple case where the actual customer ( [redacted] ***) lived with his father, [redacted] , for some time and then moved and [redacted] was still receiving calls and mail However, that was rectified and corrected on the dates noted above The confusion arose because [redacted] and his son were mixed up in our system Nevertheless, the do not mail and call requests were processed at the beginning of the year I hope this satisfies the complaint inquiry and results in a positive disposition Please let me know if you have any additional questionsIn connection with the original complaint filed by [redacted] on 2/8/2016, please note that we had not received that complaint We were in transition and short staffed and this must have unfortunately fallen through the cracksAlso, I would like the opportunity to meet and introduce myself and our organization as we are interested in becoming members in good standing with the Revdex.com Please let me know if you have time available in the next few weeks and I will come down to your offices so that we may have an opportunity to meet in person Thank you for your kind assistance in resolving this matterSincerely, Lee J [redacted]

I am rejecting this response because: this is not a matter of whether the person qualified or notIt is a matter of Access funding offering a free gift., which is not free The mail received does not comply with FTC rule, codified at C.F.Rpt251.
They have clearly tried to hide the fact that the "Free Gift" has requirements,
The external mailing information identifies an individual, not the company, and the only location in the advertising material that discloses any qualification is light grey/silver, non reflective small print on an orange background on the back of the "Cash Card"(c) Disclosure of conditions
When making “Free” or similar offers all the terms, conditions and
obligations upon which receipt and retention of the “Free” item are
contingent should be set forth clearly and conspicuously at the outset
of the offer so as to leave no reasonable probability that the terms of
the offer might be misunderstoodStated differently, all of the terms,
conditions and obligations should appear in close conjunction with the
offer of “Free” merchandise or serviceFor example, disclosure of the
terms of the offer set forth in a footnote of an advertisement to which
reference is made by an asterisk or other symbol placed next to the
offer, is not regarded as making disclosure at the outsetHowever, mere
notice of the existence of a “Free” offer on the main display panel of a
label or package is not precluded provided that (1) the notice does not
constitute an offer or identify the item being offered “Free”, (2) the
notice informs the customer of the location, elsewhere on the package or
label, where the disclosures required by this section may be found, (3)
no purchase or other such material affirmative act is required in order
to discover the terms and conditions of the offer, and (4) the notice
and the offer are not otherwise deceptiveSee the attached images, they clearly give no indication that any kind of qualification actually exists, except to call in to activate the card

In order to activate the $payment verification checks, the customer needs to be receiving qualified, assignable payments from an insurance company. *** *** was not able to provide us with any documentation from the insurance company, but he verbally told us that he is scheduled to receive
a small lump sum in roughly years. The representative told *** *** that his payment was too small and too far out in the future in order to make an offer. If there is no offer to be made, we cannot activate the $check. *** *** has been removed from the mailing list and we will not be contacting him in the future

Access Funding sends marketing material to qualified prospects and potentially qualified prospects. According to the notes in our system we learned that ***'s wife, *** ***, had already sold all of her structured settlement payments to *** *** Corporation. If *** was
qualified, Access Funding would have happily honored the $signing bonusNow that we know she does not qualify for our service, we will remove her from the mailing list

 I stand with the evidence presented. This matter has been turned over to the Arizona State Attorney Generals Office, and the Office of the Postmaster General. This company can argue with them.

Access Funding generally requires annuitants to provide written confirmation that they are receiving a qualified structured settlement.  Since 8/4, when [redacted] originally contacted Access Funding, we have confirmed that she is receiving payments through other methods.  A new $50...

check is on the way.

“In the event that a customer asks to be removed from our calling list, we immediately comply and [redacted] the record as “Do Not Call” in our database.  Our records show that [redacted] was called on 2/27/14 and she asked to not be contacted again.  [redacted] has not been contacted since her request and will not be contacted again.”
