I was sold a vehicle through rem auto sales I have had multiple issues with the vehicle they fraudulently sold vehicle for someone else won't tell me Bought vehicle in feb. 2015 had problems right away they said they didn't sell me the vehicle but the sales rep sold it for someone else but used REMs purchase agreement fraudulently they fired him for doing this to multiple people I brought the vehicle back in March 2015 they refused to fix problem but said they would find the guy that sold it to me I have gone back a few time and spike with a [redacted] he said takle us to court you have no case because the vehicle was sold with over 125,000 miles so you have nothing to fight but they have me a phone number of the guy [redacted] who actually owned the vehicle he said he would try to help but now refuses to answer my phone calls.Desired SettlementThe transmission is not working would like fixed the power steering is not working and leaking would like fixed front brake lines leaking would like fixed exhaust catalytic converters clogged would like replaced heat doesn't work would like fixed rear leaf spring was welded instead of replaced would like fixedBusiness Response We, at Rem Auto Sales prior to [redacted]coming to the office of our business stating that he had bought a vehicle here with which he was now experiencing mechanical problems were totally unaware of any complaints having been lodged against our business by him with the Revdex.com. Dear Sir/ Madam,I purchased a Honda Civic Sedan, Vin # [redacted], from REM Auto Incon and financed through [redacted], At the time of purchase , I was handed over a copy of the documents that were signed on the date of purchase.Having sensed that the dealership might have forged the purchase and sales agreement, I called [redacted] on and requested a copy of the Purchase & Sales Agreement and the ContractI received the copies and on matching them with the ones I had, I found that the purchase and sales agreement had been forged after getting it signed by me.I am enclosing herewith the photo copy of the purchase and sale agreement handed over to me at the time of purchase, which is self explanatory.It is a serious breach of contract on the part of the dealership or the bank, whoever changed or forged the document and I would like to further state that under these circumstances, I will be unable to make any further payments on the account unless the matter is resolved amicably within (seven) days from the date of receipt of this letterFailure to do so, this matter will be forwarded to my attorney for appropriate actionYou both will be responsible for all my losses, consequential losses and all legal costs pertaining to this matter.At a glance, I would like to mention the following things have been forged:1, Odometer reading is wrongThe purchase price, trade in allowances, sales tax amount all are wrong3, P & S does not reflect the correct amount to be financedCertain items have been added to the contract which are not part of the p & sThe pay off amount for trade in charged from me is far more than what has been paid to the banker.It is very astonishing to me how could the Bank approve and pay the money to the dealership even after noticing discrepancy involved in the sale of the afore-mentioned Honda Civic which was purchased by [redacted], her sales representative was actually [redacted] who is no longer in our employ[redacted] did her paperwork and delivered the vehicle to herUnfortuneately his sloppiness is partly responsible for creating this situation as he neglected to write in the selling price of $17,at the top of the Purchase and Sales Agreement and inserted the mileage incorrectly at 492miles less than the correct mileage [redacted] however was well aware of the agreed upon and advertised selling price of said vehicle and correct mileage as she test drove the vehicle prior to the purchaseShe was financed through [redacted] in Fitchburg, Massand read and signed all the pertinent contracts and documents regarding this purchaseThis transaction took place on 7/28/which was a Sunday so that we were unable to call [redacted] for an accurate pay off until the next business dayThe pay off was quoted as at this time I allowed her an additional $for her tradeHer inequity to be rolled into her loan and added to the purchase price was the difference between her pay off and the value of her trade which now was 2369.32., she also requested having her sales tax and transfer fee in the amount of rolled into the loan.Her loan amount then became as follows:Selling Price of Honda Civic = 17,9991)0Inequity from Trade = 2,369.32Sales Tax( on $7999.00) 499.94Transfer fee of plates= 100.00Worker's CU Membership fee = $25,00Gap insurance Policy = $349.00Total Amt to be Financed = $21,342.26.Amt Financed by [redacted] = $20,Difference Absorbed by Rem = $ 543.26.We have all the documentation to substantiate these figures as shown above and even though we could have requested the shortage from our customer we elected not to do so for the sake of customer satisfaction which is our nopriority and also because we were partly at fault for the miscommunication in the original Bill of Sale.[redacted] has owned and driven this vehicle for over a year now and has obviously been very pleased with her purchase as she has put over 30,miles on the vehicle during this time period which is twice the mileage normally driven in this length of timeWe were totally astonished to receive the correspondence which we received from her containing several accusations directed at our dealership which as you can see are completely unfoundedThere was never any intention to defraud [redacted] as you can see from all the facts as they have been presented to your officeShe has also been unwilling to state what her he/she DID NOT accept the response from the business.)I have gone through the response and in reply have to mention as under:So they do admit that the odometer reading was wrongly mentioned in the P & S No matter who did that, ultimately REM AUO SALES INC is responsible for the sameThe original P&S was intentionally left empty as regards to the sales price of the car and in the absence of the sales price being mentioned we have to calculate the sales price based on the Trade Difference figure mentioned on line of the P&S agreement that I signed originallyThe trade difference which is the total of (Sale price of the new car - trade in value or in other words line - line 3) therefore as the trade difference is clearly mentioned as $the selling price of the new car was ($+ $the appraised trade value of the trade in)=$16900.00, which they have now manipulated to $The actual calculation WHICH RESEMBLES TO THE ORIGINAL P&S IS AS FOLLOWS:Sales price of new car $16900.00Less Trade in $ (as per line 3)Trade Difference $ ( as per line 4)Sales Tax at 6.25% $ ( as per line 5)Title preparation $ (as per line 6)Document preparation $ (as per line 7)Pay off on trade in $(actual that they paid)Total (line4,5,6,and payoff) $ 20, which they rounded off to $20,540.00)The dealership manipulated the numbers as per there preference (after the contract being signed) and they changed the selling price of the vehicle from $to $The question here is:aHow can a dealership change figures on a contract without the consent of the buyer, does it not mean a fraud?bHow did they change the selling price of the car from $to $ ? Is that not a fraud?cDealership is the company who owned the vehicle, how could they not know what the actual odometer reading wasThe change of odometer means a fraud.So finally can the dealership justify why and how they changed the figures in a signed contract without the consent and knowledge of the buyer.Final Business Response Hello [redacted] I am Getting back to you regarding [redacted].Regarding [redacted] s Response to our request that you try and get what she is looking for.Our perception was that there was a discreptancy of $on the selling price and an indifference on the payoff amount on her trade in.[redacted] Talked to [redacted] over the past week and we thought were going to settle on an exact amount close to these numbers.[redacted] even offered to buy [redacted]es Honda back for what it was sold for and give her her lexus back because we still have it.Only charging her the Cents per mile that she has driven it for according to average depreciation.Her response was she loved her car and that she might be interestred in having us refinance the honda we sold her.Sunday 09/15/I [redacted] was working Noon to Four PM I was visited by [redacted] on her way back from Church she wanted to look at sum of our vehicles.I explained to her that I had two customers on test drives and that if she needed to get keys to something that I would be available.I was in my office selling one of those customers when she came back to my office and saw that I was busy and she left.Today [redacted] Text her and asked her if she had reached a descision and she informed him that she wanted a Mercedes or BMW from us.She then requested 3X the difference figure.Could you please intervien in this situation.It appears One way One day and then it changes.Thank you [redacted]
