I have reviewed the response made by the business in reference to complaint ID [redacted], and have determined that this proposed action would not resolve my complaint.  For your reference, details of the offer I reviewed appear below.

All lies. I told him there was $650.00 in damages. He said the scratch looked like it was old damage and he wouldn't pay for it. The car is a NEW car, it was only 2 days old with less than 200 miles on it.

On Tuesday August 12th2014 at approx. 7pm during a very heavy rain storm [redacted] requested a tow service from [redacted] Insurance roadside service company and its associates who contacted us and requested to have [redacted] 2014 [redacted] be transported to [redacted]...

dealership in [redacted]. Upon our arrival, our driver staged his tow truck directly in front of [redacted] vehicle. While proceeding to lower the rollback bed and hook the vehicle correctly, our driver failed to pull the slack on the winch cable before he winched the car onto the bed. The hook stuck under the vehicle's front valence which caused it to be pulled form its clips and penetrated the slim plastic trim of the vehicle's valence. At that time our employee released the tension and pulled the hook from [redacted] plastic valence and pulled the slack and reloaded the vehicle correctly and transported it to the dealership as originally requested. As a courtesy to our customers we let [redacted] take refuge inside our truck from the rain and he was not in direct view of the loading operation.

On Thursday August 14th I visited [redacted] to perform a visual inspection of the damage that [redacted] was claiming and without a doubt an error from our driver did cause damage to the valence. The car still being dirty from the rain storm it was very easy to follow the chain marks and where the hook penetrated the thin plastic valence as it was literally whipped clean as it rubbed the dirt from the rain away. The scrape [redacted] is claiming that we also caused was still dirty from the dried dirty rain water and away from the angle of the chains tension which it showed us that even that it was close to the damage we caused, this scrape was prior damaged.

The next day Friday August 15th I called [redacted] twice, once around 12:30ish then later that evening around 6pm, both times I left him a voice mail with my contact information including my hours of operation which are daily from 6am to 10pm and since I'm the  that answers the phone there was no chance he would not reach me. I call him again on Saturday afternoon, Sunday afternoon and once on Monday early evening and was unsuccessful to reach him.

About 20 minutes later that Monday [redacted] finally returned my call and my first words to him were "we apologies for the damaged we caused and that we wanted to rectify it by fixing the damaged Valence" At that time [redacted] told me he had already taken his car late Friday to a body shop and said to me "they have been working on it all weekend and had to pull the nose to match the paint" and I needed to repay him approx. $2100 for the repairs he was having done. I asked him why he didn't return my call and he replied that it was too late. I asked him why are they pulling the nose when the paint codes are printed in his car and he got upset and said to call the shop and hang up the phone.

As you can see he did not give us the chance to do anything and chose to pursue us thru other means including thru the Revdex.com. 

As of Friday September 5th 2014 [redacted] had entered into a settlement with [redacted] Roadside Service on behalf of our company and has signed a Hold Harmless Release which with in the terms of this binding contract it voids any claims against us and any other future claims in direct regards of this incident.

We also recently have learned that [redacted] has also collected from his insurance The [redacted] and now he trying to collect even more thru the Revdex.com.

We highly recommend that [redacted] take a second look at what he has done as he has opened him self to some very serious legal issues by collecting twice on this claim and disregarding the terms of the HHR he signed.

  We want to assure you that everything on our statement is absolutely 100% accurate. We keep notes and have proof on all of the facts on our statement. To be more specific we have a copy of the check given to you by [redacted] on our behalf, a letter from your insurance company stating you have been compensated for your loss which in fact you had to enter that claim as an auto accident which is a false statement.

Our company phone records show the outbound calls made to your number. These calls reflect that we have done everything in our power to rectify the situation in the right. The calls also reflect that you neglected to answer any of our calls.

We ask at this time that you withdraw your complaint from the Revdex.com. Inform your insurance company that your statement was incorrect and that you prevent any further slandering of our company by giving false statements and incorrect information. Also let it be known that we are prepared to physically show you and anyone interested in this matter that the damaged area “scrape” as you refer to being was caused by us, is outside of the way of the chains' angle. There is absolutely no way a smooth chain link could cause that particular damage. Common sense, without all the knowledge of mechanics or towing experience, could clearly see it does not touch or fit the damage area.

Your collection from both insurance companies is illegal and immoral as an outstanding law abiding citizen.
