Review: REMAX ADVANCED REALTORS IS HOLDING A SECURITY DEPOSIT FOR A RENTAL UNIT AT 275 OAK DRIVE CORAOPOLIS PA 15108 IN THE AMT OF $850.00 + $100.00 WATER SECURITY. THEY ARE WITHHOLDING THE SECURITY DEPOSIT, ACCORDING TO MARK HANDLOVITCH BROKER/OWNER, DUE TO THE FACT THAT WE HAVE NOT TURNED IN A COPY OF THE WATER METER READING.UPON RENTING THE UNIT AT ABOVE ADDRESS THE LANDLORD, ARP ENTERPRISES INC, TOLD US THAT THE WATER BILL WILL REMAIN IN THEIR NAME AND WE WOULD GET A COPY TO PAY. THIS BILL COMES QUARTERLY WITH THE SEWER AND GARBAGE AS WELL.WHEN WE WERE TERMINATING OUR OCCUPANCY THERE WE WERE TOLD BY REMAX, CURRENT OWNER/AND/OR/MGR THAT WE NEEDED TO CALL THE WATER AUTH. IN DOING WE WERE TOLD BY THE WATER AUTH THAT WE CAN NOT D0 THAT, THAT REMAX HAD TO DO IT. THAT WAS TOLD TO ROB AT EXT 225 IN A VM.I CALLED THE WATER COMP TODAY TO ASK FOR THE FINAL METER READING, SPOKE TO JOANN AT MOON TWP WATER AUTHORITY AND SHE TOLD ME THAT SHE CANNOT GIVE ME THAT INFORMATION AND VERIFIED THAT MARK ALREADY HAD THE INFORMATION.THEN WHY ARE WE BEING HELD UP WITH GETTING A SECURITY DEP RETURNED. MARK VERFIED THAT WE LEFT THE UNIT IN GOOD CONDITION.WE RECEIVED A LETTER AFTER GIVING NOTICE THAT WE OWED $150 IN LATE FEES AND THAT WE DID NOT GIVE AMPLE NOTICE.MARK REFUSED TO SPEAK TO ME ABOUT THESE ISSUES.Desired Settlement: RETURN OF FULL SECURITY DEPOSIT $950.00

We have spoken to [redacted] and would like to address the complaint as follows: We received a letter from [redacted]’s Daughter, [redacted] with reference of terminating their lease on August 8th with their rent payment for August. Please see the attached 2 pages from the lease included to show the tenants responsibility to pay water and sewage, failure to do so puts tenant (s) in a material breach of contract should tenant fail to provide a final paid water invoice.. The water invoice original is sent to the owners BUT a copy is also sent to the tenant for payment directly by the tenant. The tenant failed to order final water reading for the period ending when the lease contract expired on August 31st, 2013 with the owner. Since the tenant failed to communicate, this information the owner had to order the reading which they are awaiting at this time. We spoke to [redacted] on 9-24-2013 at length prior to her submitting this complaint to the Revdex.com. We discussed with [redacted] that we cannot return any . security deposit until we have a copy of the paid final water invoice. We also discussed with [redacted] about the two outstanding late, payments due and added the late fee for two prior months and for the August rent, which we received as noted above on August 8th, (please see attached). The aforementioned items were addressed in a letter and sent to [redacted] on September 13, 2013, as required by law. As noted above we are required to have the proper documentation of the paid water invoice, if the paid water invoice is not submitted we will deduct it from the security deposit along with the unpaid late fees. At which time we will return the balance of the security deposit as required by law. I would also like to advise you that the tenant did not give us a forwarding address to submit the balance due as stated in her letter dated August 1, 2013. We would also like to mention that when we spoke to Ms. [redacted] twice on 9-24-2013 she was very belligerent and wouldn’t allow a two way conversation in which we could properly explain the matter and the timeline for return of the security deposit balance. Ms. [redacted]’s final threat was that she was seeking legal counsel stating that her daughter works for attorneys and she will be suing our firm. As stated in this letter we will properly settle this matter based on the lease contract and PA State law governing the transaction.
