Contact Name and Title: [redacted] , REALTOR Contact Phone: XXX XXX XXXX Contact Email: [redacted] @sbcglobal.net To whom it may concern: Mr.& Mrs [redacted] entered into a buyers agency contract with RE/MAX Premiere Realty on 7/25/with the intentions of obtaining a lease purchase homeTheir contract was with RE/MAX Premiere Realty not Murphy Home Solutions and they paid $to RE/MAX Premiere Realty not myself or Murphy Home SolutionsThere is not a business Murphy Home Solutions, that is simply the name of my lease purchase programAttached is a copy of the contract with RE/MAX It became apparent during my time of working with the [redacted] that they were not ready to purchase a homeAlso I was not enjoying working with them as they were very negativeI relayed my thoughts to the clients and sent them a form to terminate the buyers agency agreementPlease note, I did not force them to cancel their contract I simply suggested that they terminate the contract and maybe take a first time home buyers class and also give them time to save money for a down payment / security depositWe had made several offers and in a couple of the offers the seller asked for a larger deposit which the clients said they did not haveI though I was being very nice to offer them because as of the date that I sent them the termination agreement we had already spent more than the $dollars that was collected from the [redacted] originallyWe had spent $on their file so far and informed client of this when we sent the termination agreement( see 2nd attachment ) The termination agreement specifically said " in an effort to promote good relations"we were willing to refund $dollarsSo even though we had spent $dollars we were willing to refund $dollars The client called the broker/owner and said they did not want to terminate the contract and so I called Mr [redacted] and let him know we would be glad to work with them until the end of the contract His wife called back a couple of days later and stated she wanted the whole $refunded, which I explained to her was not going to happen, why would we do thatWe had done nothing wrong? I let the clients know that there next step, if they were to continue to work with us was to come into the office to make their next offerWe did not hear back from themThey did not seem very happy with what I explained to them We continued to fulfill our responsibilities as described in the buyers agency agreement, by continuing to send them available homes that met their needs as set by the [redacted] The ***'s continued to access their search portal, and last accessed on 9/12/The portal is electronically recorded and we have a record of every time that they have accessed the search portalAt any time the ***'s could have come into the office to make a offer on a home Please note that the Termination Agreement said " If you agree please sign below..." so we were not forcing the client to end the contract with us, it was simply what I felt was the best option for themWe continued our responsibilities, as electronically recorded, until their contract expired, which was 9/25/The buyers agency/lease purchase contract is attached as well as the attempted termination agreement Respectfully, [redacted] , REALTOR

To whom it may concern:Mr*** *** hired RE/MAX Premiere Realty on 9/30/to find a lease purchase home We subsequently set up an electronic home search and took Mr*** out to view homes several times Our records indicate that we took him out on 10/1/2016, 10/7/and
11/16/ We also helped him make several offers on home during this time, all of which were emailed to the listing side so we have electronic proof offers were made in a timely manner Mr*** needs to understand that we, as his Buyer's Agent, unfortunately have no control on how long the seller/listing side takes to respond to the offers and or if the seller responds to the contract Mr*** paid $to hire our brokerage, he did not pay a "deposit " Mr*** was professionally represented during his time frame within all the laws of real estate This is not a free program, it costs us money to send agents to show the homes, it costs money to type and prepare offers, we had his credit evaluated with a lender All of these services costs money.Attached to this response is a copy of the Buyers Agency contract. We wish Mr*** the best of luck, but there will be no refund at all whatsoever.Respectfully, *** ***REALTOR

contract was with RE/MAX Premiere Realty not Murphy Home Solutions and they paid $250 to RE/MAX Premiere Realty not myself or Murphy Home Solutions. There is not a business Murphy Home Solutions, that is simply the name of my lease purchase program. Attached is a copy of the contract with RE/MAX.
It became apparent during my time of working with the [redacted] that they were not ready to purchase a home. Also I was not enjoying working with them as they were very negative. I relayed my thoughts to the clients and sent them a form to terminate the buyers agency agreement. Please note, I did not force them to cancel their contract I simply suggested that they terminate the contract and maybe take a first time home buyers class and also give them time to save money for a down payment / security deposit. We had made several offers and in a couple of the offers the seller asked for a larger deposit which the clients said they did not have. I though I was being very nice to offer them because as of the date that I sent them the termination agreement we had already spent more than the $250 dollars that was collected from the [redacted] originally. We had spent $310 on their file so far and informed client of this when we sent the termination agreement. ( see 2nd attachment ) The termination agreement specifically said " in an effort to promote good relations".... we were willing to refund $45 dollars. So even though we had spent $310 dollars we were willing to refund $45 dollars.
The client called the broker/owner and said they did not want to terminate the contract and so I called Mr. [redacted] and let him know we would be glad to work with them until the end of the contract.
His wife called back a couple of days later and stated she wanted the whole $250 refunded, which I explained to her was not going to happen, why would we do that. We had done nothing wrong? I let the clients know that there next step, if they were to continue to work with us was to come into the office to make their next offer. We did not hear back from them. They did not seem very happy with what I explained to them.
