The gate opener has been sent in for repairs and returned to me for installI had installation scheduled for the morning of July 25th however my client requested that the install date be moved to Monday Aug1st as he will be out of town on business this weekResolution should be complete on the
1st pending no further complication

This Project by no means went smoothly and there were many complications at no fault of the homeownersI have been in complete communication with the homeowners and as of our last meeting the were very pleased with the deck and overall outcome
We used every material specified in the agreement and approved by the homeowner as well as followed the installation plans that were submitted and approved by the cityTo date I have not received any complaints or concerns from the home owner regarding detailed concerns with the installationThey have received a copy of a PIF invoice as discussedWe also have a detailed year warranty and I'm happy to address any concerns regarding the installationA certified check of $(over the origrefund amount) has been mailed as well as a detailed breakdown and apology from Myself *** ***)I have made every effort to rectify what was a difficult project for the homeownersAt Our last meeting I heard from them regarding the deck was nothing short of praise on the outcome of the difficult situationWe had unforeseen payment delays from a commercial client and that is what caused the cash flow issues- this was communicated to the home ownerThe framing inspector requested additional caissons and that is why it did not pass framing inspection- this should have been noted by the inspector upon release of the permit and it was ninstalled the framing to detail with the approved plansThe issue with the final inspection had to do with the homeowners initial concept to not install railing on the stairsNeither inspection fail had to do with craftsmanship issues in the least and were both easily resolvedI would be happy to meet with *** *** to address any legitimate installation concerns at this point however a $refund will not be issuedI truly feel badly for the circumstances surrounding this project and I want the homeowner happy however the request for a $refund is unfoundedI'm happy to meet and address any issues as it pertains to the installation

** *** is an excellent communicator and orator, unfortunately we have only experienced this in defense of himself or his workWe are seeing another shining example in his initial reply to our complaintRather than pick apart that reply and further fill this issue with emotion, I choose to deal in factsNo, we have not yet received the certified $refundAnd yes we have received personal apologies, but have received so many that they no longer mean anything, as they are not met with any actionsAnd finally we cannot allow ** *** to fix any more quality or craftsmanship issues, whether under the guidance of a third party professional or notIn closing, we find it telling that ** *** has chosen to defend the pinpoint details of the issues related to the installation of the deck, but has no response to the main complaint of a low quality deckTo offer some clarity as well as documented facts, I have attached the email chain that has the most communication between ** ***, myself and my wifeOur initial request of a $refund remains unchangedWe intend to pursue this matter until an acceptable refund is issued

As stated multiple times it is my complete intent to resolve the issues for the clientThe only complaint that has been presented is "poor quality"I have offered to rectify the issues regarding the complaint, even in the presence of their third party and been rejected in doing soAll materials used were agreed on by the client and all installation practices were inspected and approved by city inspectorsJust as you can not go to a doctor and tell them you don't feel good and expect them to make you betterWithout knowing the details of the issue I can not resolve itI find it in poor taste to make character attacks when I am doing all I can to resolve the issuesComing up with a refund amount of $would no substantiation is causing the standstillAs I have stated I'm happy to address the concerns however without being allowed any understanding of the complaint I can't fix someone else's interpretation of a "poor deck"I must reiterate that all agreed materials and installation practices were approved not only by the homeowners but the city inspectors as wellAs for the refund I'm happy to provide a copy of the dated certified reciept from the refund that was issued

Much like the time when Mr *** could not afford to buy the materials to finish our deck, we see that it is again our turn to take the reigns and make progress
If Mr *** can provide real, dated proof that the refund was issued to us, we are willing to allow Shaw Landscaping's foreman, but not *** himself, to fix the quality control issues outlined belowAs a note, we have not yet received any refund whatsoever
North and south downspouts are crooked due to the decking
Hidden decking fasteners are to be used on every joist, not just the loose spots
The steel railing is to be removed, cleaned of rust, then painted and reinstalledNo missing or stripped screws in any of the hardware
The top right of the stairs side fascia board is loose and out of alignment
The gas line addition is not properly supported by the decking screwsHangers or strapping must be used
These repairs must be completed within consecutive days, and before the end of November If Mr *** chooses not to do the repairs, or feels that they are not needed, a new refund amount of $can be issued instead
The wavy deck surface, unlevel top railing, uneven cuts around the perimeter and uneven decking spacing will be forgiven, as these repairs would require that the deck essentially be rebuilt
