Remodel Works has for 30 years always strived to make sure that every customer’s experience with their remodel project was above their expectations. We have learned over the years that there are responsibilities on every project, some are Remodel Works and some are our...

customers.
During that time we have developed a packet of paperwork that makes it very clear as to the responsibilities of each party. We break out each and every area that could have any potential issues and clearly state what those issues may be and how the customer should be aware of those issues and any steps they may take to avoid any miscommunications between themselves and Remodel Works.
Not wanting to get into the “he said, she said” of the disagreement between Ms. [redacted] and Remodel Works, it comes down to the paperwork that Ms. [redacted] signed and agreed to and the responsibilities of both Parties involved.
Because of our long history in selling cabinets like the ones Ms. [redacted] purchased Remodel Works has developed a form titled “Wood Cabinet Disclaimer”. Below you will see the text that clearly states the issues and the resolutions to those issues that may be taken care of prior to the purchase of any cabinets from Remodel Works. I am including the exact copy below so that you can read the exact verbiage that Ms. [redacted] signed and agreed to upon executing her contract with Remodel Works.

THE FOLLOWING WOOD, STAINING, GLAZING AND PAINTED VARNISH ATTRIBUTES ARE NOT REASON FOR WOOD CABINET REPLACEMENT:
CHARACTERISTICS OF WOOD
No matter which species of wood you choose please keep in mind that no two pieces are exactly alike. The natural process of wood growth produces variations in grain and color throughout the cabinetry. Also, as wood ages, it will darken in color when exposed to different types of light. Color differences or change in wood can also be caused by exposure to harsh chemicals, extreme heat or moisture. For this reason there may be a noticeable color difference between newly installed cabinetry and showroom samples. Wood can also exhibit defining characteristics such as mineral deposits, streaks, knots, sap runs, pin holes and wormholes. These markings make the wood unique and contribute to its natural beauty. In limited instances, under certain angles, more rustic woods such as “Rustic Alder” can allow light to be visible through knots. These same wood features can also impact hardware placement.
STAINING
Staining will exaggerate the difference between wood graining and other marks in the wood. This will enhance the grain and will cause color variation in the stain. Stain is absorbed differently depending on the wood grain and this will cause color variations; some areas will be darker than others. These differences will occur on the same door or panel as well as an entire room. Darker stains will draw more attention to this variation.
GLAZED FINISHES
Glaze is a finish coat hand applied over stains or toners. It gives depth and a low “sheen” appearance to cabinets. Glazing will range from a consistent, even appearance to varied coverage depending on the complexity of the door’s design, as glaze may collect more in corners and grooves. Keep in mind that each door or drawer will appear different from one another thus affecting the consistency of the entire room.
PAINTED (Tinted) VARNISH CABINETS
Painted varnish is an opaque finish that gives wood a solid painted look. This finish style is susceptible to wear and tear from normal residential use and intensifies nicks, chips, dents and rub-through especially on sharp corners and edges. As the wood expands and contracts hairline cracks will appear at the joints of cabinets. The tinted varnish will also crack. But these cracks will not affect the strength and integrity of the joints and will not be considered a reason for product replacement.
HUMIDITY
As the humidity in air changes, wood will expand and contract. This process will cause cracking at the joints of cabinetry but will not affect the strength and integrity of the joints and will not be a reason for product replacement. Larger (30” plus) doors can bow slightly due to humidity. This “bowing” cannot be prevented.
SAMPLE DOORS
Because of age and light exposure, our display samples stains do not always match the current stain from the factory.  They could be slightly lighter or darker.  To guarantee the closest stain match, we offer a service of ordering a Sample Door from the Factory for your approval.  This process can delay the job start as much a three weeks.  There will be a nominal charge for this service
NOTE: If you desire total uniformity and perfect grain pattern, we recommend not purchasing wood cabinetry. Also, should you not desire any of the above described variations which are inherent with these products we recommend that you use a laminate or “foil” style door.
 
You can see that the first line on the disclaimer form, that we have in Ms. [redacted]’s file and signed by her, it clearly states in all capitals and bold type that, “THE FOLLOWING WOOD, STAINING, GLAZING AND PAINTED VARNISH ATTRIBUTES ARE NOT REASON FOR WOOD CABINET REPLACEMENT:”
You can also see that in the second to last paragraph that we encourage customers to order a sample door to make sure that the stain or color that they choose is exactly what they have seen in the showroom. “Because of age and light exposure, our display samples stains do not always match the current stain from the factory.  They could be slightly lighter or darker.  To guarantee the closest stain match, we offer a service of ordering a Sample Door from the Factory for your approval.  This process can delay the job start as much a three weeks.  There will be a nominal charge for this service.”
Remodel Works wants to make every customer happy but there comes a point when based on all the documents that a client signs with us during the purchase that we must take accountability for all the items in all those documents that are our responsibility and the client must take accountability for all the items that they agree to in those documents as well. That is the exact reason we have so many customers in the past thirty years that have had so few issues with our agreements.
Remodel Works delivered the cabinets, as well as all the other materials included in her project, as scheduled, we were on the site as scheduled to begin the installation and it was not until that time that Ms. [redacted] raised her objections about the exact color of the cabinets. We did offer Ms. [redacted] a couple of an alternative which we were willing to share in the cost but ultimately she refused those offers and that is where we are today.
With over 30 years of experience and over 8,000 satisfied customers we are sure that the process we undertake with all of our customers gives both Remodel Works and the Client the opportunity to have an experience second to none. We have many times over the years “taken responsibility” for mistakes that have been made on our part. However, when orders are placed and paperwork is signed and all the disclaimers are there we have to stand our ground and demand that clients also take full responsibility for the actions that they take in this process.
We have taken appropriate steps with Ms. [redacted]’s project and that this time we are willing to allow the proper channels decide the fate of this disagreement.
