Response:First, I would like to make the fact very clear, that we are not upset at all this report was filed [redacted] misunderstood, I asked her why she filed the complaint if she knew her vehicle had been repossessed and that the credit report was validI was trying to understand her reasoning, being she agreed she had been repossessedI would not lie for her and remove the repossession if it was valid, and that is what she was asking me to doAs for her credit report not showing her current, it is because she isn't, and hasn't been since September 2015, which is the last months(Which she admits in her complaint.) Before the repossession; We called the residence of [redacted] , the day (07/16/14) we received notice of the vehicle being removed from the Insurance policy, and left a messageThe next day (07/17/14) we called and left a message again and sent out a letterThen on 07/18/we called and left a message at her residenceThen on 07/19/we left a message on residence machine and called Ms ***'s number and left her a message as wellOn 07/26/we called the buyer's number and left a message and also called the co-buyers number again and left another messageOn 07/29/she went up for further action and was repossessedThe vehicle was redeemed on 08/28/There were three payments due at the time of redemption, so she was required to pay at least two payments in order to redeemWe then deferred the other payment as a sign of good faithSo total we made phone calls and sent out a letter in order to fix the Insurance issue before we put her up for further actionIf Ms [redacted] or Ms [redacted] had returned any of our calls, answered our letter, or called us to verify that we had received a new insurance policy for the vehicle, the repossession would have been avoidedWe are unable to waive the repossession fees as we have to pay them to the third party company who does our repossessions

Response:It is the buyer's responsibility to provide Insurance paperwork to us when they switch policiesIn this case when Ms [redacted] switched insurance policies, she nor Ms [redacted] contacted us and informed us of the switchNor did they follow up with their insurance company to make sure we received the paperwork they knew we neededThe vehicle was repossessed for lack of insurance, not lack of paymentBefore her vehicle was repossessed we tried to contact her through th mail and over the phoneThe numbers Ms [redacted] and Ms [redacted] had provided us were disconnected or answered by people unknown to themThe mail came back return to senderWe did try to rectify the situation without future action, but unfortunately we were unable toThe repossession was valid and therefore reported as suchI cannot lie and change it just to satisfy Ms ***Currently the account is payments behind and up for repossession and will be reported on her credit report as suchHer account is noted that when she called us about her credit report, we informed her the quickest way to handle her issue was to file a dispute with Transunion, and we could review itShe cussed the person who she was speaking to and rudely hung upIn no way was the first repossession for non-paymentBut the second repossession will be, as the account is days behind as of January 13, 2016.Sent on: 1/13/10:37:AM

We are a retail lot only. We have been a retail lot since March of 2016. The application link... she speaks of on our website does not work, and I have repeatedly made attempts to have it removed all together, but the company who runs our website is having difficulties doing so for reasons beyond my understanding.Due to circumstances beyond our control, we no longer do deferments. The owner has recently passed away, and probate court required us to stop the COURTESY of deferring payments. We cannot break the law to satisfy Mrs. [redacted] to defer her payments, even if it is for repairs she is demanding we make. We do not have a repair shop to make said repairs, and informed her a such.If Mrs [redacted] is unhappy with her purchase, I will offer her this one time offer of returning the vehicle, and we will charge off the remainder of the loan, calling it even. We will not report it as a charge off to the credit bureau, She will be free to purchase another vehicle from a different car lot, and I wish her luck in finding one that will do deferments.If any further response is required, please feel free to contact me regarding any outstanding issues.Sincerely, [redacted] Office Manager

[I *** *** reject the explanation of Jim Brown of why they say they had reason to repo because they did not call us nor did they send a letter, they could have waited until she came in the office to ask for proof of insurance or they could have called my jobThe car payment was due on the Friday two days before they came and got the carI feel like they should have never put it on are credit reportI tired to talk to them about the repo and they would not listen, They made her pay for a repo fee and two car payment over a mix up over insurance*** was nasty and *** was as wellThey told us both that there was nothing we could do about itThe problem is before she got behind like she is nowmonths before that they have not reported anything of her making her payment on time but now thats she's behind *** has called me today and shes mad because I filed the reportThe thing is they are rude and they don't wanna work with uThey are quick to report a repo but there NOT Reportin that she's paid payment on timeLook at are credit report it's still showing a repossession and that the account is not active and the account has been active all this time but where is it showing that jim brown has reported thatIt don't show it because they don't report to the credit bureau every 30days like they say because if they didIt would showBefore September *** was making her payments on time until the last two monthsThank *** ***]

As *** *** stated the vehicle drove ok off the lot, and after a week she noticed a new issueWe offered to help her find a shop that would look at the truck and give her a fair price on any repairsUnfortunately we do not have a repair shop, so we can not offer to do any repairsThis was
explained to her when she signed the "As Is" form at the time of purchaseShe continued to drive the vehicle, by her own admission, for two weeks without repairsThis caused the issue to worsen to the point that while she was continuing to drive it, on the highway, it got bad enough that it caused a major issueWe cannot be held responsible for the consequences to these actionsSent on: 3/27/4:14:PM

Response: The vehicle in question is a used vehicleIt is sold "As-Is" and a warranty is offered for purchase at the ***e of saleWe cannot be responsible for damages or needed repairs for a vehicle after purchaseWe have no control over how the vehicle is handled, maintained or drivenWe do not
have a repair shop, so no matter the issue, we are unable to repair itIf the radiator was damaged and the vehicle was still being driven for a "few months" until it was repaired, this was the cause of the blown head gaskets*** recommended a good shop for Ms *** to have the repairs done, and not get ripped offThis is why she was forwarded to him when she calledWe will take the car back, sell it at auction and Ms *** can pay the deficiencyOr she may continue to make her payments and keep the vehicle and have it repaired

As they have stated, they were mailing letters to the address that they had and I was NOT living there and they knew that, if they've stopped by thereThey never CALLED me to tell me my car was going to auction, so how was I to know when last I had heard, I could get my car back once the new job started?

vehicle, and not fall behind on her payments. She was never offered credit, and as she stated in her complaint, we did exactly what we told her we would do; we deferred them and put them at the end of her loan. Being as she paid out this vehicle and BOUGHT ANOTHER, we are surprised to receive this complaint. Both vehicle accounts are addressed in this complaint, the Honda that is paid out and the latest vehicle that is presently past due.Secondly, while 1 highly doubt [redacted] is the “rudest person on earth”, she does tend to be very blunt and straight forward, even while being called the terrible and extremely rude names that Mrs [redacted] called her. [redacted] spent at least 20 minutes on the phone with Mrs [redacted] trying to explain the issues with her account, and was mistreated over the phone for most of that time, being cussed and bullied.The bad check she addresses in her complaint was brought to someone who told us that he was a coworker of hers, and was dropping off the payment for her because he lives close to us. When we tried to reach her about the bad check, all the numbers we had to reach her we out of order, and no messages we left with her references were returned. Then we received the Insurance cancellation. Mrs [redacted] claims to have switched Insurance Companies, but we were never informed and when she called, she told us where she had her new policy. While still on the phone with her, we called to verify her Insurance and they had no record. We still have no proof of Insurance for her at this date.Her payments are consistently late. 5 of the 6 payments that have been made on the new account have been paid after the due date. 37/74 payments on the Honda were late. The latest vehicle was repossessed at the beginning of the loan for a late payment (6 days late/first payment default). She was charged the repossession fees that we incurred by using a reputable, licensed and insured repossession company. She was charged 350.00 (the same repo cost everyone pays) and the other 150 she paid went to the PAST DUE payment.We tried repeatedly to contact Mrs [redacted] We called her boyfriend and left messages. Her cell was disconnected. We called and left several messages at her place of employment. We left messages with her husband. We even sent a letter! We did try to let her know there were issues with her account, but were unable to reach her using any of the info she put on her application just weeks before.As for any repairs her used, AS-Is vehicle may need, she signed multiple forms stating that she wasaware that she was buying a used vehicle that may have wear. She also turned done the opportunity of purchasing a cars warranty and did not have the vehicle inspected by her mechanic before purchasing.She has signed a legal contract and must fulfill her obligation of paying for the vehicle in full. No refunds will be issued, but she may turn the vehicle in voluntarily and we will auction it. The balance due after the auction (if any) will have to be paid in full or we will seek a legal judgment against Mrs [redacted] for it.if there is an issue with her credit report, she must contact [redacted] and file a dispute.If any further response is required, please feel free to contact me regarding any outstanding issues.

This is 2nd attempt to send this response. In 10 1/2 months, I have invested over 5000.00 in this vehicle. 11 payments of 260.00 each is 2860.00 I put 700.00 down, and my maintenance and repairs are over 1500.00 including the last bill of 833.00 for a fuel pump (including towing and diagnostics).  I only put 1300 miles on this vehicle. I have attached copies of their web site which clearly shows deception. They claim they tried and tried for months to take the buy here pay here status off. Miraculously, within 3 hours of my phone conversation, it was removed. Look closely at times I have highlighted. My 2nd phone call came in on May 31st at 1:22 pm. At 4:20 pm, it was removed. I could have done that in an hour if they asked me to. One of my degrees is in computer programming. I have proof if you'd like to see. I bet they spent much more than 1 of my payments on that.  Their proposed resolution is for me to give them my car, and loan will be forgiven. The only party who will benefit from that is them.
