Dear Mr. O[redacted] and Mr. G[redacted],

I am writing to respectfully request a full reimbursement of monies paid Renaissance Properties LLC in the amount of $2,925.00 for the lease of Subject Unit. This is my second request as the response (Reference 1) from Renaissance Properties to my first request for reimbursement (Reference 2) was not fully approved.

Background: The subject unit was not habitable upon my arrival due to the overwhelming and pervasive smell of tobacco smoke. As the unit was not provided in an acceptable condition in accordance with the signed lease agreement (Reference 3), I am requesting a full refund. In Paragraph 10, Sub-paragraph F of referenced lease, it states in part … “Smoking subject to $250 cleaning fee.” This paragraph implies that if a Tenant chooses to smoke; the Landlord, upon the Tenant’s departure, will use the $250 cleaning fee to bring the unit back to an acceptable standard. This was not the case upon my arrival.

Renaissance Properties response via Henry F[redacted]’s (Leasing Agent) email (Reference 1), denying a full refund is not warranted in my estimation. The email response in part states that my reimbursement request;

“… was not deemed to warrant a full refund by our corporate office as the very slight odor in the apartment was fully resolved about 45 minutes after you left by our cleaners.”

With all due respect, the odor was not “very slight.” I understand that is a matter of opinion, however to best describe the order, it was as if the individual using the tobacco products was exiting the unit as we were entering. The odor was that prominent.

Rationale: Regardless of the differing opinions, Renaissance Properties freely admitted the unit was not to standard as they had to send in “cleaners” to rectify the situation. This constitutes a clear breach of the signed lease as the Landlord did not provide the property in habitable condition from the outset and would warrant full reimbursement.

On a personal note: It is not my intention to use a health condition as an appeal to seek full reimbursement, as I believe the inability of the Landlord to honor the lease should suffice. But I offer the following to further explain why the unit was deemed unsatisfactory for use.

Currently my husband, son and I reside on [redacted] / [redacted] / [redacted] Military Installation in New Jersey. We signed a lease with Renaissance Properties to secure a unit close to the [redacted] Hospital of [redacted] (CHOP) as our 2-year old son was about to undergo his 3rd open heart surgery. After a full day of “pre-op” we arrived at the subject unit and found it in the condition as described above. As our son’s health can be described as “critical” and of great importance to us, subjecting him to even one evening in the unit was not practical by any definition.

Additionally, my husband is currently an Active Duty Armed Service Member who is scheduled for an extended deployment this fall. His absence is not only an emotional challenge, but a financial challenge as well. Withholding full reimbursement for a unit we never used would only add to these challenges.

Bottom-line: Request [redacted] reverses the decision by Renaissance Properties LLC to deny a full refund and reimburse monies in the amount of $2,925.00 for this transaction. I appreciate your prompt attention to this matter and look forward to your response. Please feel free to contact me if you have any questions or concerns regarding the content of this letter.Desired Settlement: I would like a full refund because I did not get a service (a clean, smoke-free apartment) that I paid for.
