Review: I found out about the weight loss program using 'HCG' advertised by the company in April, 2014. Had the initial consultation with a person named [redacted] who claimed to have a graduate degree in health care from a reputed university in Southern California. She told me that with the 'HCG Diet' that the company promotes and advertises, I can lose about a pound a day. Since I had only 15 pounds to loose, [redacted] suggested I buy their 21 days program for $415 (with $100 off, bringing the cost down to $315). During the consultation, I mentioned to [redacted] two important things: 1) I am trying to lose weight for a big event in May 2) I've hypothyroidism, which makes it really hard for me to lose weight (to which [redacted]'s response was that the diet is in fact very good for people with my condition as it boosts the metabolism and helps with losing weight, very difficult otherwise). After doing all the paperwork at the center and she handed me out some information that included the directions and the foods to be eaten while on the program. I followed it exactly as instructed. Along with that she gave a vial of clear liquid with no labels (except for just the name of the center and phone no.) I had to inject this liquid in my thigh everyday at a specified time. On 6th day of my diet I txted [redacted] that I had not lost any weight and was getting frustrated. She didn't respond. By 9th day I had lost only 1/2 lb which could be due to dehydration, I texted her again, stating that I'm extremely frustrated and will be taking some action, if dont hear back this time. Still no response, at which point, I started to realize that I was ripped off. This place has cheated me of my money and have promised me to help lose weight which I never did. I'm extremely upset and decided to take some action, before more people fall into their trap. I'm going to follow up with whoever I can to get my money back and also to alert others to not fall for such gimmicks. This company seems fraud and seem to be running a scam.Desired Settlement: This company seems fraud and is running a scam. They need to refund my money if they cant deliver their promise. Keeping aside the mental and physical stress this program has caused me, they fully refund of my money that I spent, which is $315.

Response:

To whom it may concern: There are more than a few inaccuracies in Mrs. [redacted]'s claim. We have attached documentation to clear some of this up. Attached you will find a photograph of [redacted]' diploma from the University of California at Davis, a transcript of text messages between Mrs. [redacted] and the business phone, and the protocol which was discussed during her initial consultation. This consultation occurred at the Renew Me Medical Group offices located at 1411 Secret Ravine Parkway in Roseville California on April 18th 2014. The consultation lasted approximately 90 minutes. Mrs. [redacted]'s claims are unfounded and inaccurate. Also included is a copy of one of the forms signed by Mrs. [redacted] during her initial consult which states "I also agree that I will read the ReNewMe Protocol script. The whole protocol was explained to me, and I understand that if I do not follow the instructions - specifically the low calorie diet that my weight loss goal may not be met, and there are no refunds." No guarantees were made to Mrs. [redacted] regarding specific amounts of weight loss. It is our desire that you carefully review the material presented against the claims made by Mrs. [redacted] as there are many discrepancies between her claim to the Revdex.com and her text messages to the business phone. Mrs. [redacted] was not compliant on the diet as prescribed and did not achieve the results she desired from the program. We feel that she should take responsibility for her own actions rather than place blame and make false statements against a business damaging a reputation in bad faith.

I am rejecting this response because of the following reasons:

I have highlighted [redacted]'s comments in 'Green' and my response is in 'Grey'

This was a very carefully crafted response to the claim and I’m sure [redacted] has gone through this situation several times and that’s why she knows how and what to respond with. She has tactfully included the information in her response hiding what would have made her case weaker. There is an entire thread of conversation that took place on the day for which she has included just the very first text. I’m hereby including the rest of the conversation we had about my having doubts about the foods to be eaten and at the end it is clearly stated that I’m agreeing to whatever she is suggesting. The follow up text shows my disappointment despite following the exact diet just as suggested by her. The point is this regimen has no scientific basis and I had mentioned to [redacted] several times that my weight loss is not going to result from reducing the calories (something which I have been doing for several years with no result). Also I had told her that I don’t eat any junk food, avoid sweets, don’t drink sodas/ juices etc. Besides that I have a thyroid condition which makes my metabolism extremely slow. I doubt [redacted] will ever share those papers where I had all this mentioned.

Also included is a copy of one of the forms signed by Mrs. [redacted] during her initial consult which states "I also agree that I will read the ReNewMe Protocol script.

I agree that the consultation did take place on April 18th 2014, in which an overview of the program was given with bunch of paper given to me to take home and read. We had no discussion about the foods (specific type of and servings) that I was allowed to take in a day while following the regimen. [redacted] just told me to go through the information. Therefore in the snapshot of the text she has included here. I’m trying to clear my doubts. She on the other hand completely shunned me off after that initial conversation, and did not respond to any of my texts, messages or calls after that. She probably in her mind knew that the diet will not work and since she had gotten the entire payment in full, did not have anything to worry about at that point.

The whole protocol was explained to me, and I understand that if I do not follow the instructions - specifically the low calorie diet that my weight loss goal may not be met, and there are no refunds."

This is the line that just got me. I’m shocked as she is clearly ‘Lying’ here. She did claim that she will help me lose 15 lbs of weight in 21 days. My question is if she did not promise me anything then what did I pay her $315 for? I mean she is running a weight loss clinic and I approached her for my weight problem and she promised to provide her services for which I paid her the amount she asked. And now she is claiming that she never claimed/promised anything. She calls for a fraud case as she took the money and in return didn't provide any/full services or support of any kind (which sadly and clearly is the case here).

It is our desire that you carefully review the material presented against the claims made by Mrs. [redacted] as there are many discrepancies between her claim to the Revdex.com and her text messages to the business phone.

Please find attached the rest of the text conversation included here and …..

Mrs. [redacted] was not compliant on the diet as prescribed and did not achieve the results she desired from the program.

This is inaccurate. Please find attached the receipts of the grocery stores (Safeway and Costco) that clearly indicate, I did try my best by buying the types of food recommended and followed the instructions just as suggested to me. I had also mentioned to [redacted] that I had an event to attend to on May 3rd, for which I was desperately trying to lose weight, to which her response was, “I’ll help you lose 10 lbs (out of the 15 lbs. promised) by May 3rd. The rest of the regimen I can follow once I’m back after attending the event.” (FYI: The rest of the 8 days of the clear liquid was never delivered to me). So this clearly shows my motivation towards losing weight, as I approached her and paid her in full for the services and followed the diet exactly as stated in the paper work provided to me, as I had paid a substantial amount for it. I would be a fool to not follow the regimen, which would actually help me achieve my goal. But [redacted] on the other hand tried to cheat me by bogus advertising ( a snapshot of the ad run by her included here) and falsely claiming to make me lose weight with their clear liquid (which she claimed to have contained HCG—a hormone that makes people lose weight). All this while she knew nothing was going to happen in terms of my losing weight.

We feel that she should take responsibility for her own actions rather than place blame and make false statements against a business damaging a reputation in bad faith.

I’m not trying to damage anyone’s reputation here. I've no intention of doing it and have never done it to anyone. I’m just claiming that I didn't receive the services as promised to me, for which I paid in full, which to me is wrong and fraudulent. I should get my money back and do hope to stop people from continuing such fraudulent activities.

Besides this the paper work she has included (with my initials) is dated April 11, 2014, which was actually the day I had met her casually to learn more about the program, get pricing information etc. The paper was just handed to me when I walked into her office. I signed because she asked me to. To me this paperwork has no value since nothing was committed and no contract was signed on that day. She should at least verify the documents she is including in her response, which again shows her recklessness in handing any task.
