Please allow this letter to serve as my response to the complaint I recently received numbered ***. On May 20, 2017, I sold a working line German Shepheard Dog to the customer. I have included a copy of the sales contract to aid in your review of this complaint and my
response. For the reasons below, I disagree with the complaint. First, I never guaranteed the customer a full refund if the customer surrendered the dog simply because “he no longer wanted her.” The sale contract, signed by both me and the customer, does not anywhere provide for a full refund in the event the customer no longer wanted the dog. In fact, under paragraph “4” in the included sales contract are various stipulations that pertain to the possession and re-possession of the dog. Again, nowhere in the contract does it state what the customer is claiming. Since I am very passionate about the dogs that I breed (and working line dogs in general) I always offer to take any of the dogs I breed at any time during their lifetime, including this one, if the customer either could not keep her or no longer wanted her. I did not promise a full refund. I only agreed to take back the dog to prevent the dog from ending up in a shelter or in situations where the dog would be abused or would not be loved and/or cared for properly. At no point, did I ever promise a full refund. Moreover, when the customer first approached me to buy a puppy he ensured me that his brother and father would all help in raising the puppy, and that they were committed to raising a German Shepherd Dog. Every time the customer called with questions about training, I promptly took the time to explain and teach the customer, often at great length. As a responsible breeder, I offered my knowledge and advice, for free, whenever the customer needed it. I even coordinated for a colleague of mine to drive to the customer’s home and give a free private training session. Unfortunately, after attempting to assist the customer, I was contacted by the customer’s brother stating they no longer wanted the dog, and even further, the customer’s father stated that he did not feel the customer (his son) was properly caring for the dog and that he“wanted to teach him a lesson by giving her back.” The customer clearly relayed this to me in a letter acknowledging the lesson his father wanted him to learn. The customer’s father called me on July 19th, 2017, stating that the customer no longer wanted the dog and they were bringing her back now. When I asked if this could be done the following morning, the customer’s father refused. The customer personally surrendered the dog to me at about 10:00pm on July 19th. Secondly, I was contacted numerous times by the customer’s father after the dog was surrendered to me, where he proceeded to yell at me and call me demeaning names. After surrendering the dog, the customer’s father demanded $800, to which in good faith and an attempt to resolve the issues I obliged on the condition that they signed a dog bill of sale relinquishing any further claim to the dog. After sending the dog bill of sale and attempting to resolve the matter, the customer did not sign the dog bill of sale and send back to me. Lastly, I take this complaint seriously and believe it is factual incorrect. I would respectfully request that this complaint be removed. I take great pride in breeding German Shepheard Dogs that go on to serve in our military, police forces, and compete internationally. I am not in a position to offer any type of settlement. The included sales contract does not provide for a full refund and I never once promised such a refund
