I have reviewed the response made by the business in reference to complaint ID ***, and have determined that this does not resolve my complaint.
This company has no record of any the statements it attributes to the homeowners Please find rebuttals below Builder comments are within quote marks and in RED By indicating the current defects listed below, this list is not exhaustive and by no means is a waiver of our remedy for any future defects that may be discovered in the course of time permitted by ** State regulations and statutes."The homeowner first stated that it was windows but after having *** out to the home said it was now all 14" This is not true and *** *** has not been to this home We never said "4" That is from the *** rep documentation quoting Distinguished Design's rep We told the builder "all" We have been in touch with *** *** and they are moving forward, but this should have been handled by the builder since they started it Failure to follow up appears to be a problem with this company Regardless, even if we ever did give the lower number (which we did not and emphatically deny), the work has not been completed The number is irrelevant since the problem still exists."The creaky floors have been addressed." No, they have not You will find no record of any agreement that this has been "addressed" Even if this company thinks it has addressed the issues, the work they've done to attempt repair has failed and has actually caused more problemsSince repair work was initiated, we have discovered even more defective areas of the floor system."Our warranty tech came to the home to install the proper screws to remedy the noise He also glued and screwed a support beam to the joist to help support." The repair failed to remedy the problem and, as mentioned above, it has caused more problemsJust because one attempts to address an issue does not mean that the issue has been resolved. "All joists and bracing are done to code and passed all required inspections, the bounce being experienced when jumping is due to being a crawl space home." We do not need to jump to cause the floors to pop and move walking under conditions reproduces the movement and some areas of the floor have begun to sag This is poor workmanship and a latent defect "The home has moved over the past year with the extreme weather we have experienced going from degrees in the winter to degrees this summer." This is called a "latent defect" that has developed over time due to poor workmanshipDoes the builder mean to imply that there are no houses around us existing in the same conditions that are free of this defect?"All pickets that were split were replaced and the homeowner said he was happy with the results." This is simply untrue There is no record that we ever said that we were "happy with the results" and that "all pickets" were replacedThe builder did about 50% of the work, then failed to complete the job Some of the work also caused other problems There has been absolutely NO follow up. "The splits in the deck are due to lack of maintenance, the deck has not been cleaned or sealed at all in the time the homeowners have owned it." We have been waiting for the builder to finish work on this porch before sealing and they have failed to complete the porch Why would we seal a defective structure, especially when we have requested repair? Here again, as in other "repairs", the builder has caused more problems The implied warranty in ** does not restrict warranty repairs to a "one time fix" attempt Repairs should be completed Period."Decking made of pressure treated wood is going to weather with elements regardless over time the only solution to avoiding this is to have the deck redone made of a composite material." To be clear, are you saying that the solution to our problem with the porch is to have it redone with composite material?"This was a spec home that the homeowners purchased and was built to standards in the neighborhood." This has nothing to do with the poor workmanship of the builder The builder is only shifting blame to neighborhood standards."The vinyl cannot be tightened down any further." At least one other contractor disagrees with this statement and it is misleading It hasn't been "tightened down" at all."Siding was installed according to manufacturers and state codes..." It it is of no significance that the installation met codeAs mentioned, other contractors have indicated that there is a remedy and they have also pointed out poor workmanship."We did address the sinkhole but we cannot warranty grass and landscaping." To be clear, we have not ever asked for any warranty of grass and landscaping We're not sure where this comes fromWe do have an erosion issue due to improper grading and erosion is covered under the implied warranty We would be glad to meet with the excavator, the builder, and with any county officials all together to discuss how following code is responsible for the erosion.Our stance is that the builder needs to follow through on any and all repairs initiated to completion and satisfactory resolution of the problems Since the builder initiated repairs, they must have agreed at that time that there were repairs to be madeThere has been no in-person follow up together with the homeowners and any company representative to determine completeness of the items listedPlease finish the job or provide us with the means to have it completed.One more point is that, if the builder will not follow through, then the "one year new home warranty" stated in sales terms and advertising was misleading and the home was misrepresented in the sale from the very beginning

We met with the homeowners on a couple occasions regarding the drafty windows and although we did not see for ourselves the draft the windows were creating, ***, the window manufacturer was contacted and working direct with the homeowners The homeowner first stated that it was windows

All pickets that were split were replaced and the homeowner said he was happy with the results The splits in the deck are due to lack of maintenance, the deck has not been cleaned or sealed at all in the time the homeowners have owned it Decking made of pressure treated wood is going to weather with elements regardless over time the only solution to avoiding this is to have the deck redone made of a composite material This was a spec home that the homeowners purchased and was built to standards in the neighborhood The unusually load noise being experienced with the siding is due primarily to location The home is located at the top of a large hill off of a major interstate with no barriers and there is a 120' Duke Energy right of way going thru the subdivision; not allowing trees, all these elements create a lot of wind The vinyl cannot be tightened down any further Siding was installed according to manufacturers and state codes it has to be installed with some play to allow for expansion and contraction.In *** we have to do grading according to the states regulations DHEC requires a signoff on the grading before the home gets a certificate of occupancy and final walkover signoff We did address the sinkhole but we cannot warranty grass and landscaping

We met with the homeowners today, 7/24/15, this is an overview of our meeting:Windows - Homeowners are in contact with [redacted]'s widow tech to schedule an inspection.Flooring - All flooring squeaks were addressed today. We have one item to be scheduled with the flooring company.Siding - The homeowner tried to duplicate the noise created by heavy winds, while using a leaf-blower. At this time no noise was noticed. We have told the homeowner to please video or record if happens again and we will address.Deck - The deck was built and meet all applicable codes. The deck requires yearly cleaning and a sealant applied which has not been done per the Homeowner. After the meeting today it came to our attention that the homeowner would rather have a deck made of a different material. Grading - The homeowners are going to contact Henderson County and set up a meeting to address the erosion in the yard. Once this meeting has occurred we will decide how to resolve.We will update the Revdex.com once we meet on the remaining items.
