[redacted] and her husband applied for an apartment on February 12, 2015. This is where [redacted] paid her application fee of $35.00. They were approved and we let them have the apartment. [redacted] and [redacted] both work here in my office and have worked with [redacted] on...

SEVERAL occasions, sending pictures, update as we got them, taking several of her phone calls etc. EVEN UP TO TUESDAY THE 14th!!! TENANT did not like the apartment; she felt it was too small (*note this is a BRAND NEW APARTMENT nothing wrong with it, just not tenants taste).  We moved in 11 other married couples that day who LOVE this place.  We told her the sq footage (850) and she knew it prior to paying the deposit. I told tenant and her father that I would be keeping the deposit since we held the apartment for her since Feb. and renting a place AFTER the rush is nearly impossible. I DID NOT hold her to anything else just losing the deposit and she could go on her way. SHE AND HER FATHER WERE HAPPY WITH THAT ON TUESDAY. I even tried to help her find a bigger place.  I sent her to 2 other places that we manage and Andrea even met her there on one of them.Then I realized after she left that she had left the office that day. . . . that she had also already paid for pro-rated rent already with a credit card on Monday at 3:07 pm so that she could pick up keys and start moving in.  She was instructed to leave the signed lease in the drop box at the office, because she was coming in after hours. (she did not do that). After I realized that she had paid the pro-rated rent,  I cut a check BACK to her yesterday for that rent amount of $370.00. (See attached Disposition) Her husband came and picked that about around noon. . I GUESS THAT WAS NOT GOOD ENOUGH!The only thing that we kept was the deposit of $500.00 which in the application it clearly states, any deposit paid will be forfeited to the owner after 7 days.  We got the deposit from her in February. (SEE ATTACHED TERMS OF APPLICATION) Keeping the deposit for the owner is parts of the terms these tenants agreed to when signing the application. Where this tenant decided she just does not want the property and did not sign the lease we provided to them, the owner gets this deposit in lieu of rent money for taking place off the market. (*I HAD SEVERAL APPLICATIONS COME IN ON THIS PROPERTY IN FEBRUARY THAT WE TURNED AWAY AND WE HELD THIS PROPERTY FOR HER)I AM CERTAIN that the evidence I have submitted today is sufficient to show that we have bent over backwards to not hold this tenant liable for anything other than the $500.00deposit.
