I am rejecting this response because: As you can see, I have attached pictures of the above mentioned driveway and tree That is the current state of the drive way with chunks of concrete and washout remaining Perin was to come out with in days to remove the extra concrete and I have heard no word of when that might happen Along with the before and after of the tree and what was left over The association clearly lied by saying the tree was cheaper to remove than to prune Also, I have spoken with my neighbors, and they too, wanted just a pruning As far as the Dutch Elm Disease, the contractor never mentioned the tree had an early stage of it in fact, they indicated it was a perfectly healthy tree Also, no report has been shown to prove there is any such instance of the disease as far as working by the directions of the board, I have requested meeting minutes for the last months with no luck I requested this originally on August 29, 2016, again on august 30, September 7, September 8, and September after I was told they will send the minutes after I pay for them based on a fee they will determine at a later time I have yet to receive any further indication of what the fee will be (not sure if they can even charge me for public minutes), or when the minutes will be available

The Board of Directors of Reserves of Aurora Condominium has turned this matter over to their attorney

I am rejecting this response because:  As you can see, I have attached pictures of the above mentioned driveway and tree.  That is the current state of the drive way with chunks of concrete and washout remaining.  Perin was to come out with in 10 days to remove the extra concrete and I have heard no word of when that might happen.   Along with the before and after of the tree and what was left over.  The association clearly lied by saying the tree was cheaper to remove than to prune.  Also, I have spoken with my neighbors, and they too, wanted just a pruning.  As far as the Dutch Elm Disease, the contractor never mentioned the tree had an early stage of it.  in fact, they indicated it was a perfectly healthy tree.  Also, no report has been shown to prove there is any such instance of the disease.   as far as working by the directions of the board, I have requested meeting minutes for the last 36 months with no luck.  I requested this originally on August 29, 2016, again on august 30, September 7, September 8, and September 13 after I was told they will send the minutes after I pay for them based on a fee they will determine at a later time.  I have yet to receive any further indication of what the fee will be (not sure if they can even charge me for public minutes), or when the minutes will be available.

First, You need to be aware that Reserve Realty Management is a professional management company hired by Reserves of Aurora Condominium Association. As such we implement the decisions of the Board of Directors. The following is the account of the property manager: [redacted], tree removal at [redacted]...

[redacted], On April 27, 2016 our office received a report from the owner of [redacted] saying that the tree behind their unit was very close and they were concerned it would fall. We emailed the association landscaper (Impact Landscaping) and asked them to look at it. The report back from the landscaper said that they didn't find a tree that was leaning but several had dead tops that needed work. We asked [redacted] (the company currently doing work for the Reserves of Aurora Condominium Association) to give the Board a quote for pruning the Elm tree behind [redacted]. They gave the Board a proposal of $260.00 for this work. This was sent to the Board to review at their July 19, 2016 Board of Directors meeting. At that meeting the Board asked us to get a quote for removing the tree as it was reported to be in the early stages of Dutch Elm Disease. We received a proposal from [redacted] to remove the tree for $485.00 and this was given to the Board of Directors at their August 16, 2016 meeting where they approved having the tree removed. All contracts are entered between the Association and the contractor. Reserve Realty Management does not enter into any contract with venders and/or contractors. The Board of Directors hires the contractors. As part of the 2015 spring walk around for the Reserves of Aurora the Board looked at the driveway at [redacted]. It was noted that there was a 2 1/2 inch crack and the corner point by the street was broken. The Board asked the property manager to get a quote to repair this along with other concrete repairs noted on  the walk around of the Association. At the July 21, 2015 meeting of the Board of Directors of the Reserves of Aurora a proposal for these repairs from Greene Concrete was approved by the Board of Directors. This included the work at [redacted]. On August 7, 2015 Mr. [redacted] called saying the job was not acceptable and was sending pictures. The Board also looked at the driveway and didn't like the material that Greene Concrete had used. The Board asked the property manager to get a quote for replacing part of the concrete on Mr. [redacted]'s driveway. A bid from Asphalt Services was received for this and other concrete projects in the Association. This bid was approved by the Board in September 2015. For unforeseen reasons Asphalt Services failed to do any concrete work and the Board canceled the contract and asked for bids in the early spring of 2016. At the April 19, 2016 board of Directors meeting the Board approved a proposal from Perrin Asphalt & Concrete which included  the work at [redacted]. In July of 2016 Perrin did the work. It rained the day the concrete was poured so they had to return and replace it, which they did. The unit owner was unhappy with the work. Perrin felt they had completed the job. The property manager set up a meeting with the owner, all Board members and Perrin Asphalt on July 14, 2016. The Board listened to the owners complaints and he was told at the meeting that they felt the job was satisfactory. The only thing the Board asked Perrin to do was to grind down a rough area on the street where the driveway and street meet. This was caused by the rain that fell during the first attempt to repair the driveway. Perrin Asphalt has not done this to date.

The consumer is an owner in a condo association governed by a board of directors. Reserve Realty Management is tasked with...

implementing the Board's directives.
The owner called this office when the gutters were not cleaned as scheduled on the 10th due to heavy rains that would have made it dangerous for the contractor. The community association manager for that property was not in the office when she called. She declined to speak with the assistant and requested to speak with me. I was on the phone at that time and she chose not to wait or to use voice mail.
The gutters were cleaned and the 12th and 13th. In point of fact, when she called the office the contractor was on site.
Contractors do not always arrive as scheduled due to a variety of reasons and the owner, in this case, harbored unreasonable expectations of service.
Initial Consumer Rebuttal /* (3000, 7, 2015/11/24) */
(The consumer indicated he/she DID NOT accept the response from the business.)
When the phone was answered at Reserve Realty management I knew I shouldn't have placed the call. The person answered in an extremely nasty tone of voice. When the person I asked for wasn't available I asked for the owner. She wasn't available. I knew from past experiences with this company that my call was useless. I pay a monthly fee for a service I can't use. I was never given the option of speaking with the assistant or leaving a voice mail. I do expect an apology.
Final Business Response /* (4000, 12, 2015/12/07) */
[redacted],
I regret any misunderstanding. You may always use the voice mail option whenever you call. Community Association Managers are expected to be both in the office and in the field. That has nothing to do with our staffing. We endeavor to maintain all our properties well. Weather does enter into scheduling. I am sorry if we did not meet your expectations.
Final Consumer Response /* (2000, 14, 2015/12/16) */
(The consumer indicated he/she ACCEPTED the response from the business.)
