Please forward this response concerning the subject Revdex.com Complaint as the legal leasing agent for this property is KMARKS REAL ESTATE INC DBA as Kelly Marks Rentals. The lease and all documents associated with the rental of the property that [redacted] executed list only "Kelly Marks Rentals" as the leasing agent and in no way associates or implicates RE/MAX of Greensboro.
As for the complaint, Mr [redacted] did not send written notice to terminate with the date he planned to move which is required by the executed Residential Rental Contract. He had stated on a previous occasion many months prior that he was not sure when he was going to be moving but that it might be in the next few months. On a previous time, he also stated that he might be moving within a certain time period and did not. I found out about his move when I reached out to him to see what his plans were for a move out and he responded that it was going to be within a couple of weeks. Once again, I received no written communication or 30 day written notice as required by the contract. The contract also states that the tenant must return the keys to the home upon lease termination and moving from the home. I have an envelope dated April 20, 2016 with the keys for the home in them. Since we did not receive the keys as stipulated in the lease, I authorized the locks to be changed for the new tenant. This was also a violation of the lease and could have charged him for this expense but did not do so. The lease states that the tenant is to remove all of their personal property upon moving from the home. The tenant failed to do so by leaving personal items in the master bedroom closet. Once again, I could have charged him for this removal and did not do so. The tenant had a dog that damaged the interior living room window molding and also extensively scratched the siding by the back door that needed attention. I charged him a very reasonable amount for this expense and could have charged much more. Mr [redacted] also failed to maintain the yard as required in the lease and therefore had to hire a company to clean the yard and prune bushes. Also required in the lease but not performed on a regular basis was cleaning the gutters which can be verified by the owner as he went by and took notice of the situation. The owner contends that the gutters backed up over the front soffit and damaged the soffit such that the wood is going to need to be replaced and painted. The tenant denies this fact but I too verified the lack of timely gutter cleaning and notified him accordingly. The lease also states that the tenant is required to provide a forwarding address upon moving out. Mr [redacted] stated that he was moving to Charlotte and at no time up until April 21, 2016 when I received the envelope with the keys in it did I have any address reference at all. Even so, the return address for the envelope was a local address (perhaps his girlfriend) and not one that I would have sent a correspondence to without authorization.
Finally, I can firmly and unequivocally state that I was never belligerent to Mr [redacted] and have no recollection of such even though he had the electricity disconnected before his lease term was up which is also a violation of the lease. The disconnection of utilities prior to the expiration of the lease term represents abandonment of the property.
In summation, Mr. [redacted] received the partial return of his security with only a minor deduction that could have resulted in several hundred more dollars deducted.
