Cost of Service:
I had originally discussed the cost of preparing the very simplistic *** and *** returns with your firm and had been advised that the cost would be roughly *** The cost was reflective of the fact that I had compiled all information for both the *** and *** returns and had them organized and separated into their respective filing groups. Unfortunately, when I went to pick up the returns in June 2019 I was advised the cost was *** As I had already paid the $150 deposit simply walking away without the returns was not a prudent option so I was forced to pay the $435 cost. I had brought this issue up to your firm already and was simply advised these were standard costs and nothing would be done.

Quality of Service:
All tax information had been dropped off and initial deposit paid on April 16, 2019, and as previously indicated all supporting documentation for both returns including the *** Trust filing including ***, etc. were provided in their appropriate *** vs *** filing packages. At this time there was no comment or indication that returns would not be completed in time to submit by the normal April 30 tax deadline.

Near the end of April I was contacted by A1 accounting asking if both tax returns could be completed post April 30. I inquired as to the impacts of this and if that would incur late filing penalties, to which I was advised by A1 Accounting that I would have until the end of June to file both returns without penalty from the CRA.

In late May I was advised that both tax returns were ready for me to pickup and file. After reviewing the returns I noted that the signatory was incorrect and advised staff. I was then asked to sort through the paperwork originally supplied by me to A1 to show the document that listed me as executor and explain how that document demonstrated that I was the executor. At that time I was asked to leave and come back later on so the correction could be made.

After receiving a call June 4th, 2019 to advise the correction had been made, I came into the office to pick up both returns. At this time I noted the amount on the *** return had changed and inquired why the change in tax owning had been made, I was advised there had been a mistake previously made that had now been corrected.

I have since received the NOA from the CRA and they noted some issues with the *** return, which would have resulted in a credit owed to the Estate of *** While a credit position is better then owning additional funds, it is concerning that the amount filed in the *** return was incorrect.

False Information:
As noted above I had been advised by A1 Accounting that I would have until the end of June to file both returns without penalty from the CRA. I believe this was reinforced by the firms actions of calling to ask to delay completion of both returns, incorrectly completing returns initially resulting in delays, and only providing finalized returns on June 4th, 2019.

As a result of receiving the returns in early June (to which I promptly mailed both returns to the CRA), the *** credit previously noted of $625 was adjusted down to *** as a result of *** in Penalties and *** in interest charged as a result of late filing. To date I have not received the *** NOA and as such am unaware as to what if any penalties will be assessed on that return.

I am not trying to be unreasonable, or have unrealistic expectations to the service I received, however between the incorrect pricing information I received for the completion of the two returns and the incorrect information on the date the two returns would need to be filed to avoid any CRA late filing penalties, I have issue not feeling the firm carries some responsibility in the additional costs incurred by the Estate.

Client has been in touch with our office and we would like to review the Notice of Assessment he has received from CRA (for both returns) in order to determine the results. Once we have reviewed these, we will confirm the actual amount of penalties that have been incurred. In regards to the *** Trust return, due date for this had already passed when client brought the information to our office and engaged our services.

In regards to the pricing, our fee for preparing *** Trust returns has never been less than $***. This is the starting price for these returns and when you add this to the price of a basic return at $*** - the minimum fees before GST would be in the $*** range.

We apologize for the frustration is experiencing, and we are willing to look at compensation in regards to the late filing of the *** return once we receive the requested copy of the Notice of Assessment (all pages). Thanks

Per the request of the A1 Accounting I was waiting on the CRA for the second NOA. this NOA is for the *** that had been filed. I received this document on September 26. As such I will now provide both NOA's to A1 Accounting for their review.

I would like this case re-opened to ensure proper response from A1 Accounting on all matter addressed in the original case.

We have reviewed the *** Notice of assessment you have provided. The Notice of assessment agrees with the tax return prepared in terms of taxes payable. Due to the time delay in the processing of the *** tax return we will send you an cheque for 50% of the penalties for late filing. Due to the nature of estate and final returns we want to allow for ample time to prepare and get approval from CRA. Since we have no control from CRA on the timelines to get authorization - we received these files from you on April 18, 2019 - and submitted request for authorization immediately - but since this is only 2 weeks from deadline- we need the taxfiler to act in a timely manner as well especially since the tax return was for a death that had occurred almost 1 year ago when you brought in the file.

In regards to the *** file estate return which you brought on April 18, 2019- the filing deadline for this return was March 31, 2019 . Therefore it was already late.

Please confirm the address where you would like us to mail the cheque.

I had originally raised three concerns,1. The incorrect information provided initially on the costs to complete the two returns, 2. The inaccurate information that I was required to point out on the completed returns, 3. The delay in receiving both the *** and *** returns resulting in late filing penalties and interest. As not all these items have been addressed, and the items that have been addressed I do not feel reflect the level of responsibility the firm should be taking, I am not supportive of the firms proposed remediation of the issues.

I see no where in your response an address to the charges for completing the two returns, and while I understand the *** was already late, the extension by your firm by over a month past April 30 contributed additional amounts to the late penalty fees.

In an effort to achieve closure on this issue I believe a fair agreement would have me forgo any compensation for the late filing penalties associated with the *** and I will agree to drop any dispute associated with the tax preparation fees. However as there was never any concern expressed by your office at the time I dropped off the tax return information, and your office called me to ask for an extension at which time your firm stated I would not incur any penalties as a result; I strongly feel that your firm should cover all penalties and interest charges associated with the *** return.

To summarize, I believe a satisfactory resolution would be for your firm to issue a cheque in the amount of $*** to cover all late filing penalties and interest for the *** tax return.
