Review: Mold was found in the house and was not noted in the inspection.

[redacted] at REST EZ was hired to do our home inspection by our realtor [redacted] at [redacted]. We moved in the home and found mold behind the dishwasher, under the sink and in the cabinet to the right of the sink. We also found that the kitchen and hall bathroom sinks were leaking. These problems were not noted on [redacted]'s report. We were told by the realtor, the title company and mortgage company to call [redacted], that he is responsible because he completed the home inspection. We called [redacted], he was very sarcastic and rude on the phone and said his inspection is a visible inspection and he can't help if things are in the way when he is inspecting. I explained to him that the cabinet with the mold didn't have a shelf and was full of spider webbs and spiders as if it wasn't used. My husband has pictures of all of the damage that [redacted] missed. [redacted] did come out to re-inspect on Friday, September 22, 2012, he wasn't rude when he came out to the house. After his reinspection [redacted] admitted he missed the damage and that "He would take care of it" and that he would be calling us. He also explained to my husband and mother why the sinks were leaking. We didn't ask for him to repair the sinks. We asked for the molded wall to be repaired. He left a voicemail on Tuesday, September 25, 2012 and said he and the termite guy talked and he was standing by his report and was not going to fix the wall like he said on Friday. Desired Settlement: I would like my wall repaired.

Business' Initial Response

I was contacted by Mr./Mrs. [redacted] about the suspected mold issues under the kitchen sink and cabinets. They also stated that the sinks in bathroom and kitchen were actively leaking at the time of the inspection. I told them that we do not do mold inspections, it is stated in our contract that we are not mold inspectors. Mr./Mrs. [redacted] stated they refused to sign the contract. I also told them that there were no leaks at the time of the inspection, the pest/termite report also notes no active leaking at the time of their inspection. The pest report confirms damage and suggested further evaluation.

My report states that there is damage to and moisture stains under the kitchen and bathroom sink. If the [redacted]'s were concerned with the damage they should have gotten further evaluations of their concerns.

Mr./Mrs. [redacted] started some repair work on the property and when they removed the dishwasher, they discovered more damage,. That is when they chose to call me and accuse me os missing these items. I didn't miss anything I reported on exactly what I saw. Moisture damage and staining, I can't see what is behind the dishwasher. Never did I admit that I missed these items and would have them repaired. Nor was I being rude to the [redacted]'s, I am a professional and understand people are not always easy to deal with.

Mr./Mrs. [redacted] chose not to be at the home inspection, again had they read the contract it does state that they are to call for consulation of the findings, especially if they had any concerns.

When the [redacted]'s called me, I did go to the home to re-ispect their findings and made the decision that nothing had changed from my inspection. I am standing by the inspection report that was done on August 10,2012. I do not feel responsible for the sititation that the [redacted]'s are in. Had they done their due diligence this may have had a different result.

[redacted] was told on the phone that it was mold that we found. [redacted] never said that he didn't do mold inspections and if that was his case why did he come to re-inspect? When he came out and re-inspected he said to my husband and my mother "I [redacted]'t know how I missed that." "I will take care of it." "Let me talk to my people and I'll call you."

I didn't refuse to sign the contract. I wasn't at the inspection. Our realtor [redacted] said he never attended the inspections and we didn't need to be at the inspection either. That is why we did not attend. We trusted [redacted] to do his job. [redacted] states in his response - (it does state that they are to call for consultation of the findings, especially if they had any concerns.) We did that. That is why [redacted] came out to re-inspect.

The "repair work" that [redacted] mentions was a new dishwasher being installed. Yes I did note in my complaint that when the dishwasher was removed that is when we seen the first sign of damage. We understand that [redacted] cannot see behind a dishwasher. We do not understand how he could not see in an empty cabinet with a missing shelf, spiders and spider webs and mold. We had not had a chance to put our kitchen items in the cabinets as we were still moving in everything else. When we started to put our kitchen items away that is when we found that the cabinet to the right of the sink had a missing shelf, spiders, cobwebs, and mold on the wall. Clearly this cabinet had not been used in a long time. So if [redacted] did his inspection he would have seen that. This is when we called our realtor [redacted] at the Mortgage Company and [redacted] at the Title Company. They all stated that [redacted] should have found this damage and we should contact him. That he is responsible. So we did not "choose" to call [redacted]. We were instructed by everyone else involved to call him. We didn't accuse [redacted] either. We didn't know what we were supposed to do. That is why we contacted our realtor, mortgage and title. They all said [redacted] is responsible. So let's keep the facts straight [redacted]. You were rude on the phone but not in person. If [redacted] is a professional as he claims to be he wouldn't be lying about what he promised at the re-inspection. We are easy to deal with. [redacted] made it difficult with his sarcastic attitude.

The termite inspection doesn't have anything to do with [redacted]'s inspection. These are two different inspections. [redacted] should have done HIS inspection correctly.

I feel [redacted] should pay to repair the damage that he admitted he missed.

I did come back out to your house because that's what I do. I will check to see what the clients complain is about and if it is something I missed. I did not tell any one I missed anything. When I say you should call to consult about the report, it means to contact me within a few days of the inspection, not 2 months later.

Your Realtor, Mortgage lender and title company are not in the position to tell you it's our fault and we are responsible. Especially since they do not know all the circumstances of the problem. They would tell you if you have a problem contact the home inspector.

When you call my office you were not very cordial, and accused me of missing something and I was responsible. I was attached and may have been short with you.

Here are the facts as to how I see them.

I didn't lie to you. The pest report is a separate report, by a different company, but they go hand and hand with each other. Both are designed to give buyers information about the condition of the property. I can't stress enough that buyers should go over the report with us after they receive it.

What did you and your agent discuss about the report? Did you go over it with him and voice any concerns you had? Reports are done so you can make a informed judgment of the condition of the property. But you have to read the report and ask questions.

Your pest report states there are stains and damage under the sink and there was fungus, it was not called mold. They recommended further inspection. Our reports states there is stains and water damage under the sink. Both reports state the same thing. Why didn't you call one of us at that time?

I am truly sorry you are not happy with your home or with us.

I am going to stand by my inspection.
