Complaint[redacted] contracted to repair an oven at my place of business, "[redacted] located in Durham, NC. Mr. [redacted] wrote on a sheet of paper the parts' names and prices for what he said was needed to repair a faulty oven on my premises. The two items' costs were specified as 364.10 and 77.43, coming to a total of 441.53. He then added tax of 34.27 and freight of 12.30, bringing the total to 488.10.Mr [redacted] then told me that he needed this amount of 488.10 upfront, to order the parts before he could do any work. I wrote him a check drawn on my business account at [redacted] for that exact amount. This took place on Friday, 10/18/13.Bank records indicate that Mr. [redacted] deposited this check that very day in his [redacted] account.The following week, beginning on Monday, 10/21/13, I began calling Mr. [redacted] He had promised that the parts he had supposedly immediately ordered would be delivered to my restaurant by Monday, or Tuesday at the latest. The parts have NEVER to this day, made an appearance. Mr. [redacted] never returned my numerous phone calls or messages.On Thursday, 10/24/13, Mr. [redacted] came to the restaurant and told me that the parts had been delivered to "his place." He then took a another look at my oven and said that the wrong parts had been sent. He said he would refund my money and bring it by on Friday, 10/25/13.He has never done so, and has never returned any subsequent calls I have made to him.Desired SettlementMr. [redacted] has not done any work for me, much less repaired my oven or even shown me any parts! He simply took my money. I would like the 488.10 returned to me as soon as possible. In the event he does not do so SOON, I will be forced to sue him and his business in Small Claims Court. The owner of this Company [redacted], Took my prepayment of $800. and then never came back. He was supposed to repair and replace my air conditioner. On 7/31/12 I meet with the owner of Restaurant Serivices about replacing my air conditioner for my home. He took the old air conditioner and said he would return with the new one. He asked for a $800. deposit and wrote me a reciept. He never returned. After calling and even visiting his residence to find out what happened, he never answered.
