I make a claim to my insurance company about water damage. I contract Restoration 1 for repairs. Restoration one performed all the repairs include repair master bathroom shower. To do this repairs they remove the entire bathroom tile, Shower pan and also remove the toilet. A few month later I notice a water spot in my sealing. I contract a company to perfume a water leak detection and is leaking from the same area was repair for restoration 1. I contact restoration 1 and they say they will not be responsible for the damage. My complain is Restoration 1 remove the toilet and the toilet is leaking and They remove the shower and the shower is leaking.

Desired Outcome

Repair Restoration 1 They have to be responsible for the damages caused. They were the ones who originally made the incomplete repairs. It is not fair to me as a person that this company abuses me in that way.

Mr. contacted us on 10/8/18 because of a leaking fiberglass shower pan from upstairs master bath shower. Repairs were made and the damages were paid by his insurance company.

6 months later on 4/29/19 Mr. contacted us stating he noticed a water mark on his ceiling and thought it was related to the repairs from the 10/8/18 loss. The owner himself, David A., and a tech inspected the home immediately. The following is the scope of work conducted:

-Emergency Service Call - supervisor and technician
-Move contents in living room for access to area
-Put down about 100 sf of floor protection
-Drill inspection holes and use camera scope to see if we could determine source before opening the ceiling
-Cut out about a 4 s.f. opening in the ceiling
-Inspected the underside of upstairs flooring
-Found wet location at the front left corner of shower pan
-Had homeowner run the shower to see if the water dripped through

***When Mr. and Restoration 1 conducted a water test by running the shower for several minutes the homeowner had to run and get a plunger to unclog a significant clog in the shower.
-Dried shower tile grout and applied additional silicon caulk
-Replaced shower door sweep with new
-Set drying equipment

It is our position that the installation of the shower pan, concrete backer board, tile and door have been done correctly and this leak is not caused by defective materials or incorrect installation. We believe the pan overflowed or water splashed under the shower door. Despite the cause of water damage, it was NOT related to work we did.

If the homeowner has a continued leak while using the shower we recommend the carrier have a leak detection service attempt to determine the source. We instructed Mr. to call his insurance company. After he spoke with the adjuster, Mr. told us the adjuster would reopen the claim and the damages would be paid.

TO DATE WE HAVE AN OUTSTANDING INVOICE OF $867.47.

On 7/19/19 Mr. emailed a copy of a leak detection report he had done on 7/11/19. The report states:
"Identified Causes & Summary
If applicable, the following items were identified as to the origination of water and/or
damage to the residence:
Complete electronic leak detection was performed on all pressurized plumbing. No active
pressurized plumbing leaks are present at this time. Electronic listening equipment did not
register any audible leak sounds that would indicate the presence of a pressurized plumbing
leak. All water facilities in the master bathroom including the sink drain arm, toilet wax ring,
tub fixtures, tub drain, shower mixer valve and shower drain fittings were tested and/or
inspected. A leak was found at the master bathroom toilet wax ring. Water from this issue is
responsible for a portion of the water damage on the downstairs kitchen/family room ceiling.
The second area of damage appears to be the result of water leaking around the glass shower
enclosure and in the master bathroom shower."

The toilet was installed in September 2018 and only showed signs of leaking in July 2019. It was not leaking at all or at least there were no visible stains on the ceiling below the toilet when we came to the house
in April 2019.

As for the shower leak, the shower pan was replaced with a new fiberglass pan. The new tile around
the shower was installed over cement board with proper seam tape and sealer mastic. The leak
report does not state the pan or pan drain is leaking, it says the water is leaking around the glass shower door. We installed the same shower door enclosure that was on the original shower. It was installed per the manufacturer's instructions with the frame sealed with a silicon caulk from inside the shower. The bottom of the shower door has a new silicon sweep. When we were in the home to help locate the source of the water, it was obvious the water was coming from under the door
because of where the subfloor was wet. The homeowner had to unclog a significant clog from the shower on the day we were there.

It is Restoration 1 of Tampa Bay's position that our work was done completely and accurately and we do not owe Mr. anything further. In fact, we are still out of pocket for the services we did on 4/29/19 that is ultimately his responsibility to pay for, since we have had no response from his carrier.

My concern is they have to be responsible for the damages. they remove the toilet out for repairs and now the toilet is leaking. Also they know the frame of the shower was damage and they installed anyway. Now is leaking from both areas
