Dear Sir or Madam,
We understand that our former tenant, [redacted], has filed a complaint against our company, Restoration Realty LLC. We have provided the following documents in support of our case:
a. The letter we sent to the tenants explaining our decision...

to withhold $300 security.
b. Pictures of the unclean state of the unit post move-out.
c. A statement from one of the current tenants In the unit explaining it was not clean upon his move-in and required professional cleaning at cost to our company.
d. An invoice for the cost of clean up.
e. A copy of their lease with the appropriate portions highlighted

Not only is it common sense for any tenant, but it is clearly stated in the lease that the unit must be left in a clean condition. Our tenant is falsely claiming that un-removable dirt and grime was in the unit prior to their own move-in. Not only is it false, but we have no documentation from the former tenants that they were unhappy with the state of their apartment, and it is our belief that they have no proof to substantiate their claims. We have since discovered that the couch we thought they left behind is actually owned by the tenants above them. The couch appeared at the same time as their move-out and was mistakenly thought to be theirs. We will be refunding $100 dollars of the withheld security, since the couch did not belong to them. We do not plan to refund any more than that. We would appreciate if you could please resolve and remove this complaint. We have been in business since 1986 and have almost never had reason to withhold any amount of security from our tenants. We deserve to remain in good standing with the Revdex.com. If you need anything else from us please let us know.

Thank you,

Review: I recently rented and apartment ([redacted]) from Restoration Realty LLC. Myself and my two roommates moved out on August 16th 2014 and have recently received our security deposit refund. Upon receiving the refund we were notified of a $300 charge for cleaning($200) and couch removal($100). This charge is fraudulent. We were blamed for black mold located on the caulking in the tub, which was present upon our initial move in. We were told there were a number of issues involving cleaning that resulted in a professional team being brought in, for which we were charged. We were given no checklist, no sign off sheet and no direction as to what needed to be cleaned but still we cleaned thoroughly and they still blamed us for the fact that the apartment is just old and needs to be updated. The linoleum in the kitchen was discolored due to the fact that it was so old which made it look as if it was constantly dirty, no matter how many times we scrubbed the floor. The apartment needs to be updated and they are exploiting us and taking our money and claiming the apartment is "unclean", instead of making the necessary updates where they are needed. They also charged us for the removal of a couch which wasn't even our couch. We left nothing in the apartment and there are several witnesses that can attest to this as well as the cleanliness of the apartment.Desired Settlement: We would like to have the $300 charge returned to us as it should not have been charged to us in the first place.

Dear Sir or Madam,

a. The letter we sent to the tenants explaining our decision to withhold $300 security.

b. Pictures of the unclean state of the unit post move-out.

c. A statement from one of the current tenants In the unit explaining it was not clean upon his move-in and required professional cleaning at cost to our company.

d. An invoice for the cost of clean up.

I have reviewed the response made by the business in reference to complaint [redacted].

While the outcome is only slightly ideal, I am very happy we are receiving our $100 back for the couch that did not belong to us. Had the rental company simply asked us in the first place, that portion of this mess could have been avoided altogether.

As for the cleaning fees, as [redacted] said, we do not have any proof and that is unfortunately on us. We were too naive and trusting which has lead to us being taken advantage of. I wish, wholeheartedly, that we'd taken photos upon move in, but the reality is that we did not and now we are paying the price. At least we were able to take away a very important lesson, do not ever move into an apartment without thoroughly checking and documenting every square inch of it.
