The nature of this case is slanderous It is 100% illogical that we would forge someone's signature for a program designed for healthy exercise and weight loss This clients statement underscores weeks of discussions that attempted to undermine the integrity of our life changing coaching program The client signed up to lose 40lbs or more in our program and attempted to quit after losing 20lbs The client didn't want to be accountable for the commitment she made, because she had a cruise she was going on and refused to take ownership To avoid embarrassment I was instantly accused of forging the clients signature on an application she filled out to be accepted into this program While there is additional information to share, we are not inclined to respond further It is outrageous and illogical Why would we commit ourselves to giving away another weeks of our program for someone who has 50lbs to lose (and wrote by her own words she needed our help because she struggled with this Re: Return of $407.00 deposit to [redacted]

To whom it may concern:

[redacted] has retained me to obtain the return of her $407.00 deposit under the 6 Week Transformation Agreement with Results the Training Gym. As you know, on June 30, 2014, Ms. [redacted] signed the 6 Week Transformation Agreement with Results the Training Gym. Pursuant to the terms of the agreement, Ms. [redacted] paid her $407.00 deposit. A copy of the agreement is attached as Exhibit A, and a copy of the acceptance of the agreement by Results the Training Gym is attached as Exhibit B.

Under the agreement, Results the Training Gym agreed that Ms. [redacted]'s deposit "will be returned at the end of 6 weeks after a successful body transformation (as described on #2) with the option of continuing another 6 weeks and another 6 weeks of weight loss if deemed optional." Paragraph 2 of the agreement provides that "[a] successful body transformation entails no less than 20 lbs. of with loss on our official scale."

Ms. [redacted] completed her end of the bargain under the agreement. She accepted the weight loss challenge for 6 weeks, she made her $407.00 deposit, and she agreed to do promotional daily updates on [redacted]. Under the agreement, Results the Training Gym agreed that if at the end of the 6 weeks Ms. [redacted] weighed at least 20 pounds less that she would receive a refund of her $407.00 deposit. Ms. [redacted] completed the program. On September 1, 2014 Ms. [redacted] at her final weigh-in weighed 21 pounds less. She also turned in evidence of her [redacted] check-ins that showed she had good attendance at the gym five days every week during the 6 week program. She also posted before and after pictures of herself on [redacted] and a good referral on [redacted].

After Ms. [redacted] completed what was requested of her under the contract, she called Results the Training Gym on September 2, 2014 to obtain a refund of her deposit. During the September 2 telephone call, Ms. [redacted] was told to send all her information to the gym and they would call her within a week for a second weigh-in appointment. Ms. [redacted] responded that she did not agree to a second weigh-in requirement under her contract. She demanded a copy of her contract to prove that she did not agree to a second weigh-in.

On Sept. 5, 2014, [redacted] of Results the Training Gym was upset with Ms. [redacted] for demanding a copy of her contract. He also stated that under the June 30, 2014 contract, Ms. [redacted] had signed up for another round and that he would not return her deposit until she completed a second 6 week program. Mr. [redacted] agreed to send Ms. [redacted] a copy of her agreement.

Upon receiving a copy of her agreement, Ms. [redacted] immediately noticed that there was a second undated addendum to the original contract. The undated addendum is attached as Exhibit C. The undated addendum was not signed by Ms. [redacted]. The signature on the undated addendum does not match Ms. [redacted]'s signature. The undated addendum also states that the start date of the second 6 week program is on September 8, a date on which Ms. [redacted] was not available for at least several weeks. It is curious that the June 30, 2014 contract is only two pages, and there is no mention of the undated addendum. Obviously, the undated addendum is a fraud.

As you know, Ms. [redacted] has attempted to meet with Mr. [redacted] to obtain the refund of her deposit. However, Mr. [redacted] had refused to meet with Ms. [redacted].Desired Settlement: Again, this is a demand letter for Results the Training Gym to return Ms. [redacted]'s $407.00 deposit. If Results the Training Gym does not return Ms. [redacted]'s deposit by October 24, 2014, we will proceed with a formal action in which we will request actual punitive damages, attorney's fees and costs, including the payment of a handwriting expert to prove that the undated addendum is not signed with Ms. [redacted]'s signature.

We hope that legal action is not necessary for Ms. [redacted] to obtain her refund which Results the Training Gym agreed to return to her if she lost at least 20 pounds under the 6 Week Transformation Agreement.
