Review: On August 5th 2012, ReSurface Inc. came to my home while I was at work and seal-coated my driveway without being contracted or authorized to do so. I did not contact this firm to request services. In fact my driveway was completely replaced two years ago and was in excellent condition with out need of any attention. The services provided were not only NOT CONTRACTED, but in fact were not performed properly as I now have a large crack in the center of the bottom of the driveway. The firm left a bill for these unrequested services in my storm door in the amount of $76.00. As soon as I arrived home on August 5th I immediately called the firm and left a message stating that the services were not contracted, that I was unwilling to pay for them and requested a return call. I have not received any further correspondence from this firm.Desired Settlement: I am requesting that I not be held liable for the amount this firm is billing. I am also requesting that the new crack be corrected at the firm's expense.

This homeowner did schedule an appointment with Resurface. We have her name, address, phone number and her quoted price. We would not have all of this info if she did not call in and schedule an appointment. We will be sending this to our collection company if it is not paid. As to the crack in the driveway, this is not part of our standard seal coating service and will not be filled at our expense.

I am rejecting this response because:

I did not contract this business. Two years ago I requested a price quote from the firm that I did NOT accept. I did not call this firm on any occasion to request resealling. Merely having my name and address but no request for work does not constitute a contract for work!

Review: I, [redacted] called resurface, inc. to get estimates for a driveway located at [redacted]. [redacted], Va. I needed it repaired and sealed when I first received the complaint in June 2012. I received an email from [redacted] with Resurface, Inc. with 3 estimates on June 11, 2012. I emailed him back that I would call him to meet at that property as soon as the homeowner **. [redacted] contacted with a time and date. In mid July 2012, [redacted], [redacted], and I looked over and discussed the repairs and results of **. [redacted]’s driveway. I agreed to pay from the hump down to the apron and to seal the driveway to make it the same black color. The homeowner **. [redacted] also complained to me about a crack about 5”above the top part of where the repair would begin on the driveway he said was causing water to come out of it after storms. [redacted] with resurface, inc. said he could patch that crack and suggested using something called Gator Patch. He told me he would not charge me more for putting it down. So we ALL shook hands agreed and I gave [redacted] a check for $1600.I later emailed him the [redacted]s email addresses so he could contact them when he would be fixing the driveway.

I thought all would be taken care but I received an email from the [redacted]s on Sept. 11, 2012 saying that they had not heard from [redacted] since the new asphalt was placed at the lower part of the driveway to repair the hump down to the apron. They asked me to call him to find out when he planned on putting down the gator patch on the crack and the seal to the entire drive way. He had told them to wait 30 or so days for the new asphalt to cure and that time had passed. So I called [redacted] Sept. 12, 2012 to follow up with the driveway he said his secretary had them on a list and there was some sort of confusion. On Sept. 13, 2012 I called [redacted] to meet me out at the home of the [redacted]s to go over & confirm that he would be putting gator patch on the crack and resealing the driveway. On Sept.14, 2012 **. [redacted] emailed [redacted] and cc’d me that the crew he sent to do the Gator Patch and seal had done a terrible job. He attached pictures of the driveway showing how the gator patch bled thru the seal and looked shiny. **. [redacted]s said “it looked like a huge skid mark from the middle of the driveway up to his garage. He said the crew placed the Gator patch in a big area that was not even discussed it would be put in. in the email he asked [redacted]. with Resurface inc. to come to his home and see how horrible his driveway turned out. After reading the email I called [redacted] and let him know that his suggestion as a “professional asphalt guy” to place gator patch to the crack and seal it would fix the appearance and durability to the driveway had been a total fail. I told him that if I knew it would have turned out so bad I would have never agreed to do it. I also asked him what he intended to do to fix it. He then confessed to me that **. [redacted]’s driveway was the first time he ever used Gator Patch and did not know it would bleed thru the seal. He said he would take care of the driveway by doing a reseal and that it would take care of the dark shinier gator patches on the driveway to make it blend in.

On Sept. 26, 2012, the homeowner, **. [redacted] emailed [redacted] once again and cc’d me. **. [redacted] asked [redacted] to give him the contact information of the owner of Resurface Inc. because he was upset that the reseal had not been done and informed me that the office of Resurface Inc. had called him and said they would re-seal the driveway but any more repairs would need to be billed again. **. [redacted] complained the driveway looked like a child had fixed it. He also attached pictures. **. [redacted] emailed to inform me that [redacted] had called him to let him know that he was sending someone to take a look at the driveway the next day, Sept. 27, 2012.

On Oct. 3, 2012, **. [redacted] emailed [redacted] & cc’d me asking him when resurface inc. would come out to do the reseal. **. [redacted] complained as well as me that this had dragged on long enough for a simple reseal. So after this email I called [redacted] with Resurface and asked for the date the driveway issue would be taken care of. He claimed that he had other big jobs keeping him from doing the driveway seal. But his secretary had them on the list.

On Oct. 25, 2012, **. [redacted] emailed me to ask if I had been in contact with [redacted] with resurface inc. because they had not heard anything about the reseal of their driveway. I called [redacted] and received no answer so I called the office and the secretary said that they would contact the [redacted]s when they were going out to do that last seal. I then relayed that information to the [redacted]s via email and that was it. I didn’t hear from them when it was all said and done. Until this year June 12, 2013 **. [redacted] wrote me an email saying how he was meaning to call me some time back but couldn’t because of constant flights back and forth to New York due to a family death he hadn’t had time to. He said that his driveway has melting and where the gator patched was smeared down the driveway it had turned gooey and gummy and water was coming out of the crack again and mixed with the gator patch left a white residue on the driveway. He texted me 2 days later while I was out of the state on July 14,2013 pictures of the gator patch coming off with the asphalt where his truck was parked and stuck on his tires. **. [redacted] said it was so hot that week that the gator patch looked like gum. He said you couldn’t walk where it was spread on the driveway because the shoes would stick to it. So he moved his vehicle out of the way and didn’t walk on the middle section up to his garage. I told **. [redacted] that as soon as I returned to VA I would contact [redacted] to see what was going on with the patch and driveway. On July 22,2013 I texted [redacted] informing him of what was happening to the driveway and asked him to call me so we could meet and look at it. He did not call me so I called the office the next day and asked the secretary to speak to him. She put me on hold and I explained again what was going on and asked if he would come out and see what was happening he proceeded on explaining to me how he need to contact the manufacture of the gator patch because he said it was defected and expressed that if he was me he would just ignore the homeowners already. He told me he would call me back when the manufacturers got back to him. I waited a couple days and called his cell phone on July 26, 2013 twice and couldn’t leave a voicemail because his mailbox was full. I then emailed him letting him know that I needed something to happen because the homeowners were thinking of reporting it to the S.C.C. I asked him for a solution or something to be done by Tuesday July 30, 2013. I commented the situation to a co-worker and friend at [redacted], **. [redacted] about this nightmare. When he asked who I had contracted he said he knew [redacted] and his wife was the owner of Resurface, Inc because they once worked for [redacted]. [redacted] met me up at the [redacted]s house and took a look at the driveway. The gator patch had tire marks and small pieces of the driveway missing where it came up. Where the new asphalt and old driveway meet their was about a half a centimeter crack the bottom right side of the new slab of driveway there was crack the asphalt leading me to believe it was poorly tamped down. Also the asphalt piece Resurface Inc. did was only about an inch thick and had no gravel tamped under it. [redacted] saw what a bad job Resurface Inc, had done he said he would give [redacted] a call for me. On July 31, 2013 [redacted] called [redacted]’s cell phone to try and get in touch with him but got no reply so he left a voicemail. Then **. [redacted] called the Resurface, Inc. office and the secretary told him [redacted] was in a meeting so [redacted] left a message asking [redacted] to call him back. [redacted] never did.

I have called, texted, emailed [redacted] with Resurface, Inc. after many months of dealing with [redacted] I am angry and frustrated with their work and lack of professionalism. I am tired of giving the [redacted]s excuses. Like them I want what was supposed to be a patch, asphalt repair and seal to a driveway has turned into a year of stress to for the [redacted]s and myself.Desired Settlement: I would like Resurface, Inc. to visit the jobsite, inspect the finished product and correct the mistakes made in the work so the property owner can use his driveway again.
