I am rejecting this response because:I gave my information to your sales representative and was willing to pay for an initial fee for a possible early bird deal. I did not give consent or sign anything giving permission to charge my credit card further. The gym did not open in June 2015 as promised and I've never attended the gym. I've attached the e-mail I received on 5/2 and the terms, conditions, and notes would not even open and I've underlined where it says I would have 0 days to cancel so your response is false. I've notified my attorney of this situation.

[redacted] signed up with Retro Fitness of Hoboken on 5/2/15 at exactly 3:00 pm.  At that point we emailed him a copy of the contract and he had 3 operating days to cancel which is clearly reflected in section 15 of the attached agreement with absolutely no penalty.  We also billed him...

$42.79 on 5/2/15 on [redacted] ending in [redacted] for the membership enrollment fees which was a heavily discounted from the original price.  Once he pays his outstanding debts he is welcome back to the gym.

1)  This was not everything that was sent to the member.  Anything we send to our members is time and date stamped in our billing software. We have proof that we sent him his contract. 2)  There was no promise of an opening date because we in our construction phase.  This is one of the reasons the member received a discount on joining the gym.  It clearly says TBS (To Be Determined) on what he sent over. 3)  On what he sent over it also clearly says member signed up for a 24-month agreement 4)  Member also paid a processing fee of $42.79 for the ability to join the gym.
