Complaint: [redacted] I am rejecting this response because: I don't believe there was ever a (hard copy) contract given to me Please have them provide the physical copy which I signed and then I'll review itIt was never explained to me that there was a an 'auto renew' feature of the membership I would never have agreed to such a one sided arrangement as that.If they don't cease the collection activity they will face a legal claim A disputed claim should not be turned over to collection That is a predatory consumer violation and I seek the Revdex.com to help defend me on that.It was never explained to me, that when I was pressured into signing up for 'personal training,' that it was a separate entity of the gym They roped me into it at the gym with an employee of the gym, Lisa J [redacted] hard selling much larger packages I only signed up for the minimum (sessions) to get her off my back I am a yrold middle aged man with a desk job and a family I did not attend the gym more than 4-times in the entire period I never used the gym during the period in question (no service rendered).It is a reasonable solution to accept the money paid for an unused service of personal training, especially considering that I did not use the services (barely at all) and not at all during the period in question.The aggressive tactics of this predatory gym will be exposed if I have to take them to court Regards, [redacted]

I am rejecting this response because:

I did not attend the gym more than 4-6 times in the entire period.  I never used the gym during the period in question (no service rendered).It is a reasonable solution to accept the money paid for an unused service of personal training, especially considering that I did not use the services (barely at all) and not at all during the period in question.The aggressive tactics of this predatory gym will be exposed if I have to take them to court.

I have been in contact with [redacted] a few times regarding his cancellation.  [redacted] states that his memebership auto renewed "without his knowledge".  I have a copy of his contract that clearly states the policy of our auto renewal program. When I pointed this out to [redacted],...

he stated to me that he was "confused" and didnt know what he was signing. I explained the legal binding aspects of signing a contract, that he didn't want hear about.  [redacted] states that he called  in May 2015 to cancel and was told it was taken care of. When I asked [redacted] who he spoke to, he could not provide a name. I again explained the policy to [redacted], that we do not and never have taken a cancellation request over the phone. It states in his contract that you must provided a written certified letter to Retro Fitness for cancelation. Mr. A'hearn states that he doesn't even use the gym and that is why we should cancel his membership.  We dont offer a pro rate based on lack of use.  [redacted] states that he has unused personal training, and that he would like that to be transfered towards his membership dues. Personal traning and membership are two entirely different contracts at the gym and are seperate.  We do not trade one of for the other.  [redacted] did finally hand deliver a cancellation letter on 8-14-15 as well as mailing a certified letter on 8-27-15.  Stated in his contract there is a 21 day cancellation notice and before he can cancel he must be in good standing on his back billing. I told [redacted] that he is three months behind as well as oweing his annual fee for a total of $105.90.  That is with me offering to waive all late fees on his memebership. His balance is $163.40 with late fees. [redacted] is refusing to pay his back dues, which led to him being sent to collection. Once the collection agency takes over, they are the ones that are trying to contact [redacted] about his balance owed. The last conversation I had with [redacted] was him telling me that there are other remedies for this issue and that I had better rethink my position. When I asked him what he meant by that, he stated that I would find out.  As as far as being irate and threantening, that was all [redacted]'s actions.  I have tried to work with [redacted] to the best of my ability, and becasue [redacted] is not hearing what he wants to hear, his way, prompted him to write this complaint against Retro Fitness.  My offer stands with [redacted], of paying his past due amount of $105.90 to close his account and have him removed from collections.  I please ask that you remove any negativity against this business, as we are not in fault.  I will be forwarding you a copy of [redacted] contract.  If you need anything else from me, please don't hesitate to contact me.
