The plaintiff has provided an inaccurate account of the issueThe plaintiff came into our Spa on 12/29/at 3:24pm and
purchased a $Gift Certificate (not $as stated, copy of Visa transaction attached)The plaintiff also scheduled two appointments for her friend to redeem the Gift Certificate(minute Hot Stone Massage and Minute AgeSmart Facial)to take place on 1/4/She seemed very unsure of her friends availability for 1/4/14, and my employee made a point to inform the plaintiff of our 24hr cancellation policy, which he also documented in the appointment notesSo, the plaintiff reserved hours of services on 12/29/to take place on 1/4/(plaintiff held appointment for days), and blocked the rest of the general public from reserving any appointments during that time slotOur employees only get paid when they provide a service, which is why we have a 24hr cancellation policy and is clearly stated on our website (copy is provided below)The plaintiff's friend called just hours before the appointments were to start (after holding the appointment slots for days) and cancelled the appointmentsThis caused a financial loss to the business and to the employees that were to provide the servicesOur cancellation policy clearly states that if you do not arrive for your appointment or cancel the same day, your credit card, gift certificate or package credit will be chargedMost Spa's require you to provide a credit card JUST TO MAKE AN APPOINTMENT (industry practice), for this very reasonSo, the plaintiff stated that she did not provide hr notice and therefore a refund will not be issued

Your appointment is reserving time on their calendar and it is preventing another client from doing the sameAll that we ask is that you extend the courtesy to notify us in a timely manner (hours) should something change and you are unable to keep your appointmentIf you cancel the same day or fail to show up for your appointment, you will be required to pre-pay for any future appointments, including your missed appointmentIf you have an outstanding gift certificate/package credit, it will be redeemed for your missed appointment
