[redacted] This letter is in regards to the second letter that I received from you, on March 02, 2018 regarding the following consumer complaint:Complaint Id: [redacted] I wish to bring closure to the matter regarding the plaintiff.Below are the conditions to my proposed settlement:1. I agree to refund the plaintiff the remainder of the balance requested by the plaintiff, in the said amount of seven hundred and fifty dollars. This will satisfy the first aspect of the plaintiffs request, [complete refund of the initial purchase price], as the initial seven hundred and fifty dollars has already been returned to the plaintiff on December 27th, 2017 via PayPal.2. I agree to the plaintiff acquiring, and maintaining full custody of said Goldendoodle, "Griffin". Beth contacted us letting us know the litter was borngirls and boysWe were 1st pick on the boy listI communicated with her on what we were looking for and she said the (green) boy puppy would be best for us so we chose him through pictures.December 8th - we met with Beth R*** of RG Doodles at an agreed location to get our new puppy (Griffin - Mini Goldendoodle)She handed my daughter the puppy and we gave her $1,cash as well as an extra $for gas since she drove to meet usShe preferred cash since she said PayPal charges her fees.We only received shot records on the dog and no other health clearance or evaluation.PA STATE LAW(1) A seller shall provide a purchaser of a dog with a health record for a dog at the time of saleIn addition, the seller shall provide to the purchaser a health certificate issued by a veterinarian within twenty-one days prior to the date of sale for the dog or a guarantee of good health issued and signed by the seller.(i) A health certificate issued by a veterinarian shall certify the dog sold by the seller to be apparently free of any contagious or infectious illness and apparently free from any defect which is congenital or hereditary and diagnosable with reasonable accuracy and does not appear to be clinically ill from parasitic infestation at the time of the physical examinationThe health certificate shall include the name, address and signature of the veterinarian and the date the dog was examined.(ii) A guarantee of good health issued by the seller, and dated and signed by the seller and the purchaser on the date of the sale, warranting that the dog being sold is apparently free of and does not exhibit any signs of any contagious or infectious disease, is apparently free from and does not exhibit any signs of any defect which is congenital or hereditary; and does not exhibit any signs of being clinically ill or exhibit any signs of a parasitic infestation on the date of the sale.December 11, - 1st appointment and evaluation by Dr*** at *** ***She said he was in good health however noted his back legs and paws were significantly smaller and his paws were malformed because the pads were not separated and he does not have nails on back pawsDr*** had never seen this problem so recommended I go for an evaluation with a veterinary orthopedic specialistAfter this appointment I texted with Beth and informed her of the problem and said that my vet recommended further evaluationShe admitted that she was very concerned with his size compared to the rest of the litter and said she addressed it with her vet and there was not a problemI asked her for a health clearance report and she said she did not have oneI was only provided with a shot record report(REPORT ATTACHED)December 14, -We came to an agreement that she would refund 50% of my money ($750) and future medical bills related to his identified physical problem up to the price I paid of $1,The $was refunded due to the fact that my puppy clearly was not the same as the others in the litter per his size and smaller back legs/pawsI found this to be a fair agreement so she said she would mail a check out the next day which was Friday, December 15, 2017.December 22, -I texted Beth again and told her had yet to receive her check a week after her agreement to mail itShe did not know why and asked me to give it more time.December 26, -I still had not received a check and after communicating with her she said it must be lost in the mail and she would resend a checkAt that time I asked her to send it through PayPal and agreed to destroy her check if I received it but I never received anything.December 27, -I received her PayPal transaction that night of $refundI texted her and thanked her and she again said she would cover his future medical costs if there was a problem with him, (TEXT MESSAGE ATTACHED)January 3, - After speaking to my vet during a shot appointment about Griffin's occasional habit of crying and lifting his back legs after running or playing, she again recommended that I see a specialist so I scheduled the appointment.January 16th, - At my scheduled appointment with specialist Dr *at L*** *** *** he evaluated Griffin and found the back legs and paws to measure smaller as well as the formation of the paw pads which includes no nail formationHe recommended further x-ray evaluation of the back legs, paws, and spine to have a full understandingHe was concerned that Griffin had an arch in his spine but it could be because of the difference between the front and back legsAt this time I decided to hold off on x-ray and see how he continued to developDrDwanted to further evaluate and watch Griffin as he grew so we scheduled a follow up appointment on 2/13/(REPORT AND INVOICE ATTACHED)January ,-I emailed the report and Invoice for $to Beth but heard nothing back.January 19, -I texted Beth to ask if she received my email of the report and invoiceAt this time Beth responded with she will not be refunding any more moneyI reminded her of her agreement and said this was not a routine vet bill and that it was an evaluation of the puppy's physical problemWe have not communicated since this point and I had to block her messagesThis is when I decided to file the report and get help with my situation.February 8, - On 2/6/Griffin on different occasions would cry after moving around and lift his left legThis was not unusual since he has been doing this since I got him however this time he continued to limp on his back left leg and would not bare weight on it.I took him back to Dr*** and she wanted to have x-rays at that point but we both agreed to allow the specialist to evaluate him at my scheduled appointment on 2/13/18.February 13, 2018- Dr*once again evaluated Griffin and found that he was definitely having a problem with his left legHe explained he now needed to x-ray his hind legs and hips to see what is going onThe x-ray found Griffin to have abfemur bones and tibia bones where they attach to his kneeThey also saw inflammation in which a medication was prescribedDr** did not charge me for his time because of the current situation with the breeder(REPORT AND INVOICES ATTACHED)Current Situation - Griffin has had some improvement on the anti-inflammatory medications but is still lifting the left leg to reduce weightHe is on limited activity per the doctor request of no stairs, jumping, runningFuture costs and development are currently unknown.Dr* would like me to follow up with his colleagues at University of PAI have not scheduled this appointment due to costThis would evaluate and prove the genetic aspect/birth defect.RG Doodles Health Guarantee on website - This letter is in regards to the following consumer complaint: ID#:[redacted]On December 08, 2017, the complainant purchased a puppy, of said type, Miniature Goldendoodle, from me for the said price of fifteen hundred dollars cash.Prior to the actual purchase date, via communications with the...

complainant, text messages as well as videos of her soon to be puppy, were sent to the complainant for her visual approval.For the next four days of ownership with the dog, the complainant was in communication with me via text message, exemplifying her love, satisfaction, and enjoyment over her new puppy, to one extent, sending a video of the puppy in bed with her family.On the fourth day of ownership, A Monday December 11, 2017, the complainant took her puppy to Dr. [redacted]., in [redacted], for a general examination.Dr. [redacted] found, "Griffin", (said purchased Goldendoodle), to be, "...bright alert and responsive and had good overall body condition". Dr. [redacted] goes on to say, "...both of his rear legs were found to be significantly smaller in stature than his forelimbs and he has two digits that are fused together on the right rear foot". This, "webbing" is technically known as, "Syndactyly".After her visit with Dr. [redacted], the complainant contacted me with her veterinarian's findings. The complainant now had a different persona regarding the puppy, and our transaction. The complainant now felt victimized in our dealings, and demanded some type of retribution.My first response to the complainant, was a full apology for any inconvenience regarding this matter, and an offer of a full replacement of her purchase price, in addition to me making the drive to her place of residence to retrieve the puppy, free of charge. A 686 mile, round trip journey for me.The complainant was extremely adamant in her position that returning the dog, ...was not an option.At this point, discussions of appeasement began with the complainant, in an attempt to remedy the situation.Her suggestion, to me, was that she would accept a repayment of fifty percent of the original purchase price, in appeasement for this incident, which goes against my contract, but in wishing to keep good faith in the dealings,! agreed, and refunded the complainant seven hundred and fifty dollars, via PayPal.On Sunday, January 21, 2018, the complainant once again took her puppy for another veterinarian examination, to, [redacted], and demanded that I pay the veterinarian cost once again.The initial findings of the complainant's second veterinarian visit on Sunday, January 21, 2018, which I have been furnished a copy of, show that the only notable issues are that of a slight "webbing", or "Syndactyly” of the dog's rear paws. In addition, in comparison to the front legs, a slightly shorter length was noticed in the rear legs, which is noted in the findings to be of no form of lameness, as stated in this excerpt from the veterinarian's findings:"Briefly watching Griffin at proceed at a brisk walk outdoors from some distance I did not notice any lameness. He walked with perhaps an arched back but if I passed him on the street I am not sure my attention would have been drawn to this observation here at the clinic. [redacted]”Mycontract states that I will reimburse any purchaser, up to the cost of the initial price of the puppy, if a licensed veterinarian finds it medically necessary, for the animal to require any type of surgery that would affect the animal, to where the animal would die at a young age, or, not be normal in any sense of the word regarding health and well being.This brings us current.The complainant refused my offer for a full refund of original purchase price, and retrieval of the animal from her place of residence. The complainant also, through refusing to accept "return of the animal" as an option, is for face value, holding me at bay, for whatever actions she deems fit, even after accepting her request to pay her fifty percent of the original purchase price, as an appeasement of the initial incident.After reviewing the complainant's, "Customer's Statement of the Problem" regarding this issue, the complainant paints an extremely disparaging picture of me, which I find unfounded, and offensive, I have gone above and beyond all measures to correct this situation, regarding her acceptance, I too have a copy of the entire text conversation with the complainant, and perhaps someone needs to review exactly who is empathetic in this transaction, and who is not.The entire Text Message conversation with the complainant, encompassing all text agreements and transactions stated in this document, as well as a Defamation of Character statement, geared toward me by the complainant in text, is available upon request if needed, as are any reprints of actual veterinarian statements.In conclusion, I offer the following, to the complainant, as settlement of this incident:I offer the complainant the remaining balance of seven hundred and fifty dollars, to fulfill/honor my agreement of a full purchase price refund, plus, I offer reimbursement of any veterinarian visit, incurred by the complainant, (regarding "Griffin", said purchased Goldendoodle), to date, as of today, February 07, 2018. And in agreement of this offering, the complainant must agree to the return of "Griffin", said purchased Goldendoodle, to me.The return of unsatisfactory merchandise is standard logistical business practice.Thank you [redacted], Beth ** R[redacted]
