Revdex.com:
I have reviewed the response made by the business in reference to complaint ID# 11896151, and have determined that my complaint has NOT been resolved because:
I
appreciate that the business, RG Tiles
has finally responded. They said they want to be advised on how to
proceed to reach a settlement that is amicable to both parties. I am
ready to amicably have a cash settlement with them. They need to contact
me at Shahram Mahini 347-515-so we can agree on a sum. That sum will include the cost of the
misplaced materials as well as the cost of the inadequate work
However, I want it to be noted that although they
are correct in saying the job was done under direct supervision of parties that
used RG services, as a subcontractor, it is RG Tiles that botched the job,
initially by not installing properly and subsequently, by further damaging the
floors in an effort to restore them. And
to repeat they have lost my materials, admitted as such and refused
to refund me or to make me otherwise whole
Further although true that other bathrooms at the
address were built buy them, they were NOT to the same specifications and
complaints were indeed made, regarding that bathroom. I have attached an engineer's report
indicating that the work of RG Tiles caused the issues as I felt they were not
going to claim responsibility
Sincerely,
Shahram Mahini

Revdex.com:
I have reviewed the response made by the business in reference to complaint ID#? ***, and have determined that my complaint has NOT been resolved because:
- I will provide? extensive photos separately as evidence of how the floors looked after the initial installation, and of what the floors looked like after the two botched attempts.? This is extensive so I will send it to the Revdex.com by email? as the file size will be large.? - I am not ignoring the conclusion of the engineering report that? I commissioned himself.? What RG has a very difficult time understanding is that the design was fine, but that they did not install the floors properly.? They committed a lazy shortcuts by? cantilevering the slab on top of the drain, and in order to do so filled the drain cavity with foam which caused the leaks to occur and to destroy the stain.? I have photographic evidence of their malfeasance there as well.? The engineering report was done when the slab was in place, and we only discovered the botched cantilevering and foam when we thought that the drain was inadequate, removed the slab and discovered what RG had committed.- RG's statement that they "worked under direct supervision of De-Spec" is a statement in totality? as we had terminated DE Spec in the summer of 2016, and the two botched attempts at repairing the initial improper installation of the slabs was done when DE Spec was not in my employ anymore.I would like to add that even if RG and I cannot agree that they totally destroyed my floors by not installing properly and then twice attempting to repair without success only to make the floors worst, they are acting in bad faith because they unprofessionally continued to ignore my multitude of attempts at having them contact me to find an amicable solution, and that does not change the fact that they have embezzled my property, which is the stone that they had in their safeguarding which they have yet to? compensate me for.My claim against RG includes the make whole for the botched job which I am having redone by someone else and I will have that professional company document everything in order to further provide proof to the Revdex.com as well as refunding me for materials that they should have kept in good faith but that they have either sold to someone else or lost, and have admitted as such without ever providing any proof of what happened, but regardless owe me financial compensation for.? The former claim is a professional claim, the latter claim could be viewed as a criminal claim as it could be considered grand larceny in the state of New York. There is a simple solution for RG, they need to compensate me for what I paid for the work they "performed" and to compensate me fully for the materials of mine they had in their possession.? I am willing to negotiate, but they clearly are acting in bad faith and are finding excuses, as Rafael G*** has done all along when I was begging him to come and fix his mess.? Kind Regards
