Review: Sales person from your Clearwater office called us and was very rude. We don't appreciate that. Also, his "sales pitch" was misleading.Desired Settlement: Don't call again

On 6/19/2014 It was bought to my attention that there was a complaint about the service that EnLibra Corporation had rendered to one [redacted] the CFO of [redacted] doing business as [redacted]. After a thorough investigation of the complaint here are the findings:EnLibra Corporation is a Management Consulting firm that provides services to businesses that market products and services in the commercial and Federal Government sectors. One of the services we provide is proposal assistance to firms that are submitting proposals to the General Services Administration for evaluation to determine if they are qualified to become a Multiple Award Schedule (MAS) recipient. Our contracts do not guarantee that an applicant will be awarded a MAS nor do we stipulate the amount of time it will take GSA to render a decision. (Please see an attached copy of the signed contract)EnLibra Corporation made contact with [redacted] -DBA [redacted] during one of our marketing campaigns. On June 23, 2013 EnLibra Corporation signed a contracted with [redacted] to assist them with the preparation of a proposal to be submitted to The General Services Administration in response to the RFP for schedule 65 IIF. The investment for this service was $5,500.00 and the terms of payment were as follows: $1,833.33 as consideration to start the contract and two equal monthly payments of $1,833.33 beginning 30 days from the date of this agreement. (See the attached contract)On June 23, 2013[redacted] signs a contract with EnLibra Corporation for proposal support. (These are emails between [redacted] and a GSA/VA contract specialist)On October 21, 2013**. [redacted]’s partner **. [redacted] received an email from the GSA/VA Contract Specialist **. [redacted] U.S. Department of Veterans Affairs| VA Federal Supply Schedule Service that stated the following:**. [redacted],Based on the conversation today Monday 10/21/2013 you will be providing the following additional information. Because your D&B report listed below supplier risk is 8 out 9 (very high risk), your firm’s bank statements for the last 6 months is required, your firm’s taxes from 2011, and 2012 are required to move forward to perform a complete and thorough analysis of your offer. In addition, you listed 18 manufactures and all products were made in the USA. However you did not provide letters of commitments from each company. As such you are to provide letters of commitment from an official officer from each manufacturer, via email directly to me. Manufactures are to provide specific line items and place of origin for the products being offered. Based on the additional information discussed you will be able to provide all requested documents in the next day or so. However, if you could provide all requested information by next week Tuesday 10/30/2013, if you are unable to provide the required documents your offer may be in jeopardy of being returned.On 11/4/2013[redacted] sent a rejection letter to **. [redacted] and It reads:**. [redacted],Because you have not submitted the requested information listed below, that was also discussed on 10/21/2013 via phone. That you would provide all documents promptly and or by 10/21/2013, as of to date 11/4/2013. I have not received and or heard from you regarding this matter. Based on nonresponsiveness, in addition providing additional information is non-compliance. Your offer will be returned today without further consideration. Be mindful that VAFSS is open continuous, once you have gathered all necessary documents, if you choose to you may submit a new offer. Thank you for your interest in the VAFSS. [redacted]| U.S. Department of Veterans Affairs Contract Specialist | VA Federal Supply Schedule Service(These are email between EnLibra and [redacted])4-30-14I received an email from **. [redacted] wanting a refund or his GSA finished up. Our files indicated the offer had been submitted (it’s a medical file so not submitted electronically) I spoke to Jenny our senior process and was advised to reach out to the VA to get status on his offer. I contacted the VA help desk and left a voice mail with the customer’s information and mine.I immediately followed up with **. [redacted] to let him know what actions I had taken, and as soon as I heard back from the VA I would contact him. I gave him our main office number as well as my direct line for future reference.5-1-14I sent **. [redacted] a follow up email to let him know that I left another voice mail for the VA helpdesk and will continue to work to get a status for him.He sent an email back to thank me.[redacted] from the VA contacted me and advised that she would have to speak with **. [redacted] directly, I provided her phone number to him ###-###-####.5-6-14**. [redacted] emailed me back that he lost [redacted]’s number, could I provide to him again, I did.5-7-14**. [redacted] emails me to call him. He stated that they we rejected. I advised there should have been a rejection letter to advise why. And asked that he send to me so we can see what happened.I then contacted [redacted] since she now knew that Enlibra was the company that submitted his paperwork if she might talk to me. She could not because I was not on the paperwork.5-8-14**. [redacted] send me a copy of the email from [redacted] from the VA that was sent to **. [redacted] ( [redacted]’s partner) dated 10/21/135-9-14I sent **. [redacted] an email back thanking him for the information and I restated exactly what the email from the VA had advised, what action items were requested and the date that they had to be received by. I asked if they were sent he said yes, I asked if they got confirmation from the VA that they were received he said yes.1. 6 months of your companies bank statements.2. 2011 & 2012 tax returns.3. Letters of commitment for your 18 manufactures from an official officer of the manufacturer.He responded back saying yes received , and she ( VA ) advised that their D&B rating is not good.I again took him back to the email from the VA and pointed out that it states in the rejection letter as of 11/4/13 that the action items were not received and that is why the file was rejected. When GSA is doing clarification they set very specific time frames and you did not comply.5-20-14 [redacted] emails me for a copy of the email string with the VA.HI [redacted]I can’t find the email string from November 2013 is there anything we can do now I would like to get a GSA contact if not please refund me the amount we paid for the filling as promised. I contacted **. [redacted] and he was in a meeting and could not talk. I sent a follow up email for him to contact me when he is available.5-21-14I had conference call with **. [redacted] to advise that there will not be a refund, we fulfilled our contract requirements. He said that we guaranteed a schedule, I explained we can’t make that guarantee the decision is up to GSA. Our contract is for preparing and submitting the paperwork. I sent this follow up email to recap our phone conversation.Good afternoon [redacted],Thank you for speaking with me today, I wanted to recap our conversation. As I stated Enlibra Corporation has fulfilled its contractual obligation with your company.Our contract states that Enlibra Corporation does not assume any liability for denial of GSA contractor status due to incorrect, omitted, or incomplete information or data provided by the proposed applicant or any denial based on the proposed applicant’s financial condition or business history. However, EnLibra Corporation will utilize all available information to attempt to obtain GSA contractor status for the proposed applicant we will process and submit all of the necessary paperwork required by the GSA.Enlibra Corporation can make no guarantee that any company will be awarded a GSA schedule. You stated that your GSA contracting officer said that your offer was rejected due to your low D&B score and that once your score has improved your company can reapply.Enlibra Corporation would be able to resubmit your file, but this would be at a cost of $ 3,000.00 and the fees would have to be paid prior to processing that paperwork.Thank you [redacted]Based on the facts, that [redacted] promised and failed to submit paperwork that the VA contract specialist requested in their 10/21/2013 phone conversation and backed up by a subsequent email. It is evident that their rejection was a result of their own negligence and no fault of EnLibra Corporation. I believe that the staff at EnLibra Corporation went above and beyond to help the client when called upon.
